Our company has been contracted by Nathan and Mariel Lewis to construct a vinyl lined, in-ground swimming pool in the backyard of the property at 3196 Driftwood Court in Carmel, IN 46033. In planning the project,given the location of the swimming pool,the location of the house's utility supplies,and the elevation and change of grade in the yard, it was determined that there would be only one logical location for placement of the swimming pool equipment. While all other aspects of the project have been able to meet proper zoning requirements, it is the desired placement of the pool equipment on this project that has led to our request for approval by the zoning board for a variance. We thank you for your time and consideration in this matter. Respectfully, Matthew E. Harms Statement of Support In asking for this variance,there are compelling reasons necessitating the placement of the pool equipment at this location. The first is its proximity to the pool. As mentioned,the swimming pool is placed around the northwest corner of the house. This was the only available place for the pool given the grade change in the property's backyard. It also provides direct access from an existing walk out patio door. As such,there was no option for locating the pool any further to the east which would have made a potential relocation of the equipment pad to the other side of the house more viable. Secondly, the rear face of the house is covered by a wood deck that, because of the grade change, not only takes up most of the wall space,but also ends up creating an overhang that is inaccessible and thus not a potential equipment location. Furthermore, both the electric and gas meter which are required to power elements of the equipment,are located on the west side of the house. To locate the equipment anywhere else would require both utilities to be trenched all the way around the property to the alternate equipment pad location. Lastly, and probably most compelling, is the fact that even with board approval of the variance,the actual elements of the equipment pad(pump, heater,filter)will not extend past the already existing footprint of the house given the location of the fire place chimney chase. It is true that the concrete base pad would have to be poured slightly further past, however it seems far less disruptive than the alternative options would be. Of small note, but not withstanding,the proposed pool pump and heater are both fully automated and so will be programmed to only run as necessary. Furthermore,the pump is a variable speed pump which will only requires to be set at a speed fast enough to turn over the water 2-3 times daily, essentially making it inaudible. The heater, an electric-ignite,gas powered unit,will only create the noise of a small furnace. Given the fact that the closest neighbor is over twenty feet away with no direct-facing windows or doors,the placement of this pad will be no different than thousands of others that did not contend with easement lines as it pertains to any neighborhood disruption. Harms STATEMENT OF VARIANCE REQUEST We are seeking a variance from section 5.02.C.7 of the UDO in the matter of how close the pool equipment can be to an easement boundary. The Unified Development Ordinance requires that all pools,decking, and equipment shall be at least 3 feet away from any easement. On this particular property,according to the plot plan/survey, a portion of the house itself(bump out for a fireplace) is already extended approximately 1.2 feet past the same easement line in question. Our intention, if approved,would be to place the equipment pad in the setback created by the fireplace bump out, essentially putting our pool equipment behind the setback, but would require the small concrete pad that the equipment sets on to extend over the easement boundary by 2',or a mere 4-6" past the prior mentioned fireplace chase that already extends 1.2 feet past the same easement. All of the distances described above can be viewed in the included visual documents highlighting the property,the survey, and our proposed placement. The parties agree that the terms of this Agreement shall be binding upon and inure to the benefit of their respective heirs,administrators,successors and assigns. 9. The parties executing this Agreement represent and warrant that they are authorized to enter into and execute this Agreement for and on behalf of the patty which they represent. 10. This Agreement shall be effective as of the date on which it is last executed by a party hereto. 11. The Owner agrees to provide full disclosure of this Agreement to all persons,entities and others who acquire by or through Owner any interest in the Lot on and after the effective date of this Agreement_ 12. Owner agrees not to alter the ground surface elevation within the limits of the casement at any time. 13. Owner agrees to remedy any drainage problems or issues,saturated soil or standing water on the Lot or adjacent properties determined by the City to be resulting from the Encroachment. Any changes to the scope of work after permit issuance impacting city rights-of-way or dedicated easements may require additional approvals and must be coordinated with the Engineering Department prior to performing the work. This includes, but is not limited to, pavement cuts, lane/street closures, path/sidewalk closures, easement encroachments,and new utility poles or aerial service lines. CONDITIONS OF RIGHT-OF-WAY PERMIT 1. The applicant/contractor is required to post and maintain a valid License and Permit bond with the City of Carmel for the duration of the project. 2. Indiana's "Call Before You Dig" law (IC 8-1-26) requires everyone that digs to contact Indiana 811 at least two (2) full working days before starting their project in order to have existing underground facilities properly identified and located. 3. The City Engineer's office (317-571-2441) is to be notified before the start of a Right of Way pavement repair so that a City Inspector can observe the placement of patch materials. A minimum of two (2) hours of notice is required. Failure to notify may result in removing and replacing the repair. 4. Asphalt pavements that are required to be removed shall be saw cut, and then carefully removed to minimize pavement damage. The cut must be repaired with flowable fill with 12" of concrete and 1 1/2" of surface asphalt. All seams shall be tack coated and shall be ironed as necessary to provide a perfect joining of the patch with the surrounding pavement. No cold mix asphalt is to be used except as temporary patches. 5. Concrete pavement shall be saw cut and then carefully removed to minimize pavement damage. The new concrete patch shall be placed using at least 4000psi concrete for driveway aprons and sidewalks, and Class A concrete for road cuts. The edges of the adjoining pavement shall be coated with an epoxy adhesive intended for concrete patching. The patched area shall be properly barricaded for at least seven (7) days and the patch shall be treated with two (2) coats of a curing compound or a curing membrane. 6. All excavations in grassed areas shall be capped with a minimum of 6" of topsoil and seeded with high quality bluegrass seed equal to other existing grass. All excavations within 5' of the edge of pavement shall be filled with a granular fill material and topped with at least 6" of topsoil. All ditches disturbed by excavation shall be properly restored and sodded. 7. Upon completion of all repairs, the Applicant shall request inspection from the City Engineer's office. Upon inspection if all repairs are satisfactory the Inspector shall release the permit. 8. The City of Carmel will hold the Applicant directly responsible for all work performed under this permit. 9. If the City Engineer and/or his Inspector determine that the workmanship is incomplete or unacceptable, the City reserves the right to withhold release of the permit for up to one year.
