DECEMBER 21, 1987
CITY MEETING HALL
The meeting of the Carmel City Council was called to order at 7:00
P M. on December 21, 1987 by Mayor Hancock with Council members,
Miller, McMullen, Doane, Johnson, Garretson, Fleming and Badger
present. Also Present were City Attorney Andrews and Clerk-
Treasurer Susan Jones.
Invocation was given by Miss Doane followed by the Pledge of
Allegiance.
Mr. Johnson made a motion to amend the minutes of December 7, 1987
to reflect under the heading of Public Hearing, Ordinance Z-224,
Proposed Rezone that ten items rather than seven had been asked of
Trammell Crow. The additional three are as follows:
1.) Commitments to cover both Exhibits C and D
2.) Change date in covenants paragraph lA to April 21, 1980
3.) Furnish exhibit F described in paragraph 3B of the
commitments
Motion seconded by Jim Garretson. All members voted aye. Motion
ca]ried.
Mr. Garretson made a motion to add under the heading of Accucable
Agreement, Cable TV Franchise that the Accucable Agreerlent merely
ratified the practice of the means by which the city collected the
revenues. Motion seconded by Mr. Badger. All members voted aye.
Motion carried.
Mr. Badger then made a motion to approve the minutes of the meeting
of December 21, 1987 with the necessary changes. Miss Doane
seconded the motion. All members voted aye. Motion carried.
OLD BUSINESS
PUBLIC HEARING, ORDINANCE Z-224, PROPOSED REZONE : Mr. Johnson read
a statement to the Council members and to all persons present
concerning the rezone. Mr. Johnson stated that while all items he
had asked for had been supplied he was still against the rezone due
to the breaking up of 103rd. He was concerned that while it was
what the public wanted the City Council had no authority for that
street. He also felt the traffic study did not have a good basis
for it's findings. Mr. Johnson wanted it understood that in no way
could the City Council assure the neighborhood thct what was
submitted by Trammell Crow concerning 103rd would in fact be built
and that the authority for that road was under the jurisdiction of
the County Commissioners. Mr. Jim Nelson, Attorney, 3663 Brumley
Way, Carmel representing Trammell Crow read from the real estate
covenants stating that construction to and modifications of 103rd
were subject to approval from the proper governing body. Mr. Badger
made a motion to approve the rezone Z-224. The motion was seconded
by Miss Doane. All members with the exception of Mr. Johnson voted
aye. Mr. Johnson voted nay. Motion carried.
Mr. Johnson then read a statement to the outgoing members of the
City Council, Sue McMullen, Jim Garretson and Bob Badger. Mr.
Johnson thanked them for their years of dedication and service to
the Council and to the community. Mayor Hancock also thanked the
members for their cooperation, understanding and support.
The City Council adjourned at 7:30 P.M.
