CARMEL CITY COUNCIL MEETING
April 20, 1987
The meeting of the Carmel City Council was called to order by Mayor
Reiman at 7;00 P.M. on April 20, 1987 with Council members Miller,
McMullen, Doane, Johnson, Garretson, Flening and Badger present.
Also present were City Attorney Andrews and Clerk-Treasurer
Hancock.
Miss Doane gave the invocation followed by the Pledge of
Allegiance.
Mr. Badger made a motion to approve the minutes of March 16, 1987.
Motion seconded by Miss Doane md passed unanimously.
Diane Chancellor of the Carmel Jaycees presented Distinguished
Service Awards to Carmel High School seniors Brenda Pevasey and
Eric Potts.
Our Town Week Resolution - Clerk-Treasurer Hancock explained that
in association with the proclamation by Governor Orr of the week of
April 20th being Local Government Recognition week and support by
the Indiana Association of Cities and Towns, a resolution had been
prepared declaring the week of April 20, 1987 as "Our Town Week" in
Carmel. Mr. Johnson made a motion to approve Resolution 4-20-87-1.
Motion seconded by Mr. Badger and passed unanimously.
Old Business
Ordinance D-512 - Regulating Taxicabs and Limousines - Mr. William
Whitley, Jr., 1008 Mohawk Hills, Apt. D, Carmel, owner/operator of
Touch of Class limousine service appea]ed before the Council and
stated that the changes proposed for the taxi ordinance should not
be the same as for limousine service. Discussion ensued and it was
suggested that a committee of the council be formed to meet with
the City Attorney and taxi and limousine owners. Ms. McMullen made
a motion to introduce ordinance D-512 and dispense with the reading
of same. Motion seconded by Mr. Johnson. Mr. Johnson made a motion
to suspend the rules and act upon Ordinance D-512 this evening.
Motion scconded by Mr. Badger and failed 4-3. Mr. Johnson appointed
Mr. Miller as chairman of a committee to review the ordinance and
named Miss Doane and Mr. Fleming to the committee.
New Business
Public Hearing - Ordinarce Z-215, Proposed Rezone Kingswood, Inc. -
Mr. James Nelson, attorney ior Kingswood, Inc. appeared before the
Council to present details on a proposed rezone of property on the
east side of Gray Road between 11th Street and 106th Street from S-
1 zoning to S-2 zoning. Mrs. McMullen made a motion to introduce
Ordinance z-215 and dispense with the reading of same. Motion
seconded by Mr. Johnson.
Mayor Reiman opened the meeting for public hearing after Mr.
Nelson's presentation. Mr. Donald Traeger, 11201 Lakeshore Drive
asked petitioners the size of the homes. Mr. Nelson responded there
would be a minimum of 1500 square feet. There being no further
questions from the public, Mayor Reiman closed the public hearing.
Following discussion by the Council, Mr. Garretson made a motion to
suspend the rules and act on Ordinance Z-215 this evening. Motion
seconded by Mr. Miller and passed unanimously. Vote was taken on
Ordinance Z-215 which passed unanimously.
Public Hearing - Ordinance D-513 - Additional Appropriation, CCI
Fund Emerson Road Sidewalk Project - Mr. Miller made a motion to
introduce Ordinance D-513 and dispen£e with the reading of same.
Motion seconded by Mr. Fleming. Mayor Reinan stated that the
ordinance was for an additional appropriation oi $48,000 from the
Cumulative Capital Improvement Fund for the purpose of sicewalk
construction and opened the meeting for public hearing. Mr. Charles
Damler, 463 Emerson Road, stated he lived on the south side of
Emerson and would be happy to relinquish his shrubs if the sidewalk
would be constructed on the south side of Emerson. Kathy Geodde,
525 Emerson Road stlted there was a huge pine tree in her yard on
the south side of Emerscn which would mean if the sidewalk were to
be constructed on the south side the tree would either have to be
destroyed, all the limbs cut off on one side or the sidewalk would
be in her living room. She suggested that the sidewalk be
constructed on the north side of the street. Robert Roblee, 475
Emerson Road, stated there would be a pr4blem with the tree and a
lift station on the south but that the con struction of the sid ewalk
cn the north side would present a problem with the temptation for
children to play in the creek. Mr. Roblee asked that the sidewalks
be constructed far enough from the street that the snow plows would
not dump snow on the sidewalks when the streets were plowed. Pat
Strausberger, 623 Emerson stated she would prefer to have the
sidewalk constructed on the north side because residents on the
south side had small yards and because the pine tree would have to
be destroyed. Juanita Rankin, 817 Emerson, suggested that since
there was sidewalk on the south side of the street at the west end,
that the city start where the other sidewalk leaves off and
continue on the south side. Janet Sterling, 136 York, stated it was
difficult to see children crossing the street at the west end of
Emerson at Guilford and suggested that white lines be painted to
help. Janet Craig, 451 Emerson Rcad stated that there was parking
only on the south side of Emerson and suggested that the sidewalk
be constructed on the south side so that the pedestrians using the
sidewalk would be further from the traffic flow. Betty Claytcn, 816
Emerson, stated that the creek was behind her property and that
children played there regardless of whether or not there was a
sidewalk and suggested that the sidewalk be constructed on the
north side because their yards were larger. Mayor Reiman stated
that due to several problems the sidewalk may have to be
constructed partly on the north and partly on the south. Steve
Goedde, 525 Emerson suggested that the sidewalk be constructed all
on one side so the children not have to cross the street. Mayor
Reiman stated that the suggestions of the public would be taken
into consideration and if some of the residents would put their
name and address on a sheet of paper, that after the plans were
prepared, they would be contacted prior to the beginning of
construction so that they may see the plan. There being no one else
from the public to speak to the ordinance, the public hearing was
closed. Mr. Johnson made a motion to amend Ordinance D-513 to read
Emerson Road instead of Emerson Street.
Motion seconded by Ms. McMullen and passed unanimously. Mr.
Garretson made a motion to suspend the rules and act on Ordinance
D-513 this evening. Motion seconded by Miss Doane and passed
unanimously. Vote on Ordinance D-513 was taken and the same passed
unanimously.
Resolution 4-20-87-2 - Expansion of PERF Coverage - Mr. Garretson
made a motion to approve Resolution 4-20-87-2, expanding the PERF
Coverage to include the Council Members. Motion seconded by Mr.
Johnson and passed unanimously.
There being no further business to come before the meeting, the
same was duly adjourned.
