MEETING MINUTES
JULY 18, 1988

CARMEL CITY MEETING HALL
The meeting of the Carmel City Council was called to order by mayor
Dorothy J. Hancock. Councilors in attendance were: Tom Irvin, Frank
Fleming, Lee Lonzo, Jim Miller, Ted Johnson, Alan Potasnik, and
Minnie Doane. City Attorney Steve Andrews and City Clerk-Treasurer
Susan Jones were also in attendance.
The invocation was given by Councilor Doane followed by the Pledge
of Allegiance.
Councilor Fleming made a motion to approve the minutes of June 27,
June 20 (special meeting and regular meeting) and July 6, 1988.
The motion was seconded by Councilor Lonzo.
Councilor Lonzo made a motion to amend the minutes of July 6, 1988,
adding "A-60 as amended" to the last sentence. All members voted
aye. The amended minutes of 9-6-88 and all other minutes were
approved unanimously.
ORDINANCE Z-233 DUKE REZONE - Mayor Hancock stated the public
hearing On the rezone had already been held and that questions from
the council and discussion would be all that was allowed.
Wes Bucher Director of Department of Community Development
addressed the Council in regards to questions they had On density.
Steve Andrews reviewed the two options of the Council in regards to
the legality of the Plan Commissions actions. One being the City
Council is not in a position to decide whether or not the PC acted
in a legal manner and they should proceed to act on the rezone.
The second option would be for the Council to file a declaratory
judgement action and let P.R. Duke and Century Mortgage go to court
and have the court make a decision.
Councilor Johnson called for the question. The vote was as
follows: Councilors Doane, Potasnik, Miller, Lonzo, Irvin and
Fleming voted aye. Councilor Johnson voted nay. Motion carried.
ORDINANCE D-555 - Establishing a 4-Way Stop at Congressional
Boulevard and College Avenue - City Attorney Andrews stated that
stop signs must be a certain height and must be reflective in
nature.
Councilor Fleming made a motion to pass Ordinance D-555. The
motion was seconded by Councilor Miller. All members voted aye.
Motion carried.
Street Commissioner Klingensmith was directed by the Council to get
with the Browning people and get the proper sign up for
enforcement.
PUBLIC HEARING/ORDINANCE D-561/LOCAL LAW ENFORCEMENT CONTINUING
EDUCATION FUND - $2,796.00 - Councilor Johnson made a motion to
introduce D-561 and suspend the rules for reading of the same. The
motion was seconded by Councilor Miller. All memhers Voted aye.
Motion carried.
Mayor Hancock opened the hearing to the public. There being no
comments or objections from the public the hearing was closed and
opened to the Council for questions comments and/or objections.
There being none a motion was made by Councilor Johnson to suspend
the rules and act on Ordinance D-561 tonight. The motion was
seconded by Councilor Miller. All members voted aye. Motion
carried. The mayor called for the question. All members voted aye.
PUBLIC HEARING - ORDINANCE Z-237 - ENFORCEMENT OF ZONING THRU FINES
AND PENALTIES - Councilor Potasnik made a motion to introduce
Ordinance Z-237 and suspend the rules for reading of the same. The
motion was seconded by Councilor Johnson. All members voted aye.
Motion carried.
Mayor Hancock opened the hearing to the public. There being no
comments or objections from the public the hearing was closed and
opened to the Council for questions comments and/or objections.
There being none Councilor Irvin made a motion to suspend the rules
and act on Z-237 tonight. The motion was seconded and all members
voted aye. Motion carried. Councilor Johnson called for the
question. All members voted aye.
PUBLIC HEARING/ORDINANCE Z-235 - Rezone for Dr. Perkins, 170 W.
106th - This was withdrawn because of improper notice to the public
for the hearing. It will be re-advertised and back on the August 1
Agenda.
ORDINANCE C-129 - Lynwood Farms Annexation - Councilor Johnson made
a motion to introduce Ordinance C-129 and suspend the rules for
reading of the same. The motion was seconded by Councilor Irvin.
All members voted aye. Motion carried.
Jim Nelson, Attorney, 3663 Brumley Way, representing Browning
Investments gave a brief outline of the annexation. The annexation
would include 535 acres.
Councilor Johnson made a motion to suspend the rules and act on C-
129 tonight. The motion was seconded by Councilor Irvin. All
members voted aye. Motion carried.
Mayor Hancock called for the questlon. A11 members voted.
Ordinance C-129 passed unanimously.
Stop signs at Jennings Drive and Harrison Drive and Limberlost
Trace and Harrison Drive - Councilor Miller introduced a petition
for possible stop signs at Jennings Drive and Harrison Drive and
also at Limberlost Trace and Harrison Drive. This petition was
from approximately 30 residents of Mohawk Crossing. Councilor
Miller requested a traffic study be done by the City Engineer and
Police Departments and have a draft ordinance prepared for the
August 1 meeting.
SPECIAL MEETING OF CITY COUNCIL/POLICE/FIRE DISPATCH - A special
meeting of the City Council was called for July 27, 1988, 7:00pm at
City Meeting Hall for the purpose of reviewing a proposal submitted
by the Carmel Fire and Police Departments for combining dispatch
services. This meeting would also be a final review of the
tentatively approved 1989 Budget. Agenda to follow.
116th STREET/STREET LIGHTING - Councilor Johnson made a motion for
the Engineers (Commonwealth) to look at the 116th Street project
for additional street lighting especially along 116th between
College and Penn and bring back recommendations and costs to the
Council by August 1st. The motion was seconded by Councilor Fleming
and all members voted aye.
Councilor Johnson said he remembered that Trammel Crow agreed to
participate in the cost of signalization at that intersection thru
their covenants and/or commitments and wanted Don Silvey to check
on that also.
There being no further business before the City Council the meeting
was adjourned.
