HomeMy WebLinkAboutCCM-05-02-88 MINUTES OF THE CARMEL CITY COUNCIL MEETING MAY 2, 1988 The meeting of the Carmel City Council was called to order at 7:05 P.M. on May 2, 1988 at the Carmel City Meeting Hall by Mayor Dorothy Hancock. Council members Irvin, Fleming, Lonzo, Miller, Johnson, Potasnik and Doane were present. Others in attendance were City Attorney Steve Andrews and Deputy-Clerk Treasurer Janet Rogers. Invocation was given by Miss Doane followed by the Pledge of Allegiance. Councilor Fleming made a motion to approve the minutes of April 18, 1988. The motion was seconded by Councilor Potasnik. All members voted aye and the motion carried. Old Business Ordinance D-544/An Ordinance amending the City Code establishing a four-way stop intersection at Hawthorne and Spruce Streets - Councilor Johnson made a comment that on the Police reports this was the first time they have said that a stop sign will be required in the future. There was never a statement on it. He stated that the only problem he had was what kind of criteria the state has for Yield signs. The Council wanted requirements for the Yield signs for their personal knowledge only. Councilor Johnson moved for approval of Ordinance D-544 and Councilor Fleming seconded. All members voted aye. Motion carried. Ordinance D-547/An Ordinance amending Carmel City Code prohibiting parking on certain areas of Emerson Road- Councilor Fleming made a motion to introduce Ordinance D-547 and suspend the rules for reading of the same. The motion was seconded by Councilor Irvin. All members voted aye. Motion carried. Councilor Fleming made a motion to suspend the rules and act on D-547 tonight. The motion was seconded by Councilor Miller. All members voted aye. Motion carried. New Business Annexation Ordinance No. C-126/Dugan & Morris Development Mr. Steve Harlow, Attorney for Dugan & Morris, stated to the Council that Valleybrook Section I has already been annexed and approved. They were now coming before the Council to get Valleybrook II annexed. Steve stated that Section II had already been reviewed by the Board of Public Works. Councilor Irvin made a motion to introduce Annexation C-126 suspend the rules, and act on Annexation C-126 tonight. Councilor Potasnik seconded the motion. All members voted aye. Motion carried. Mayor Hancock asked all in favor of annexation of C-126. All members voted aye. Motion carried. Ordinance D-548/An Ordinance amending the City Code establishing a three-way stop intersection at Lakeshore Drive East and Briar Creek Place - Mr. Lynn Vogt, a resident on Lakeshore Drive East stated that there is an extreme amount of traffic on Lakeshore Drive East and that they are travelling at excessive speeds. He believes that they are using this street as an alternative to Keystone Avenue. Mr. Vogt suggested that there be more than one stop sign placed on that street. Councilor Potasnik stated that he realized the problem and agreed that anything the City can do to deter or slow it down would probably be the best route. Mayor Hancock mentioned that the Street Department would need to post stop ahead signs because of the many curves in the road. Councilor Johnson made a motion to suspend the rules and act on Ordinance D-548 tonight. The motion was seconded by Councilor Doane. All members voted aye. Motion carried. Mayor Hancock asked all in favor of Ordinance D-548. All members voted aye. Motion carried. Zoning Ordinance Amendment - Ordinance taken off this Agenda for May 2, 1988, but will be on the May 16, 1988 Agenda. Ordinance and Agreement/96th and Aronson - Ordinance taken off this Agenda for May 2, 1988, but will be on the May 16, 1988 Agenda. Other Business Councilor Johnson wanted to know if anything had been done about the warning signal at the Fire Station exit. City Attorney Andrews said that Don Silvey is on top of it. The last time he had talked to Don there was a back order problem. Councilor Johnson also asked about the railroad ties. Mayor Hancock said that they were slowly being moved away. There has been a copy of the Nuisance Ordinance sent to them from Wes Bucher telling them that they have only so much time to move them. The Councilor then inquired about the reconstruction on 116th Street. Mayor Hancock stated that the bids were being brought in on June 6, 1988. Councilor Johnson continued with asking that the Insurance Committee be kept informed on insurance matters. Mayor Hancock stated that she will have Dave Resley or Mike Mundy come in and talk to the Insurance Committee. The Councilor also stated that he had a problem with the "No Wading or Swimming" signs at the Civic Square fountain. He stated that when working to get a bond issue signed for Civic Square and the Fire Station, they promoted it as a family place with a wading pool and play area for children. He didn't understand why if the base of the wading pool and the structure of the walk on the outside of the pool were identical, why would one be safe and the other not. Mayor Hancock stated that the problem with the fountain is not the base structure but the spickets in the fountain and children climbing on the waterfalls. City Attorney Andrews mentioned that he was also being told of foreign objects such as glass in the bottom of the fountain, which could cause many injuries and problems for the City. Councilor Fleming was concerned with the guardrail by the restroom and the possibility of kids falling between them. He stated that the rails needed to be closer together. City Attorney Andrews mentioned to the Council that he was going to a Builders Corp. meeting Wednesday night and that Don Silvey and an HNTB Representative would be there, so if they wanted he would mention it to them. They all agreed. Attorney Andrews suggested a warning sign might be an alternative. Councilor Johnson stated that he would rather have a warning sign than the "No wading or swimming" sign that is there now. Councilor Lonzo made a motion that Mayor Hancock be directed to contact the Insurance carrier as to the feasibility of the warning sign. The motion was seconded by Councilor Potasnik. All members voted aye. City Attorney Andrews suggested the motion be made to allow him to be the one to look into the feasibility of the warning sign instead of the Mayor. Councilor Lonzo amended his motion. Councilor Irvin seconded the motion. All members voted aye. Councilor Potasnik asked the Mayor if it would be possible to get all the Departments annual reports. Councilor Irvin asked if anything has been done about the Ordinance for Parking Violation Fines. City Attorney Andrews said that there should be no problem doing it and that he should have it before the Council in the next 30 days.
