HomeMy WebLinkAboutCCM-03-07-88Carmel City Council March 7, 1988 Meeti ng Minutes The meeting of the Carmel City Council was called to order at 7:00 P.M. on March 7, 1988 at the Carmel City Meeting Hall by Mayor Dorothy Hancock. Council members Miller, Doane, Irvin, Potasnik, Fleming, Johnson and Lonzo were present. Also in attendance were City Attorney Steve Andrews and Clerk-Treasurer Susan W. Jones. Invocation was given by Miss Doane followed by the Pledge of Allegiance. Councilor Potasnik made a motion to approve the minutes of February 15, 1988. The motion was seconded by Councilor Lee Lonzo. All members voted aye. Motion carried. - Judge Robert Hughes gave a brief report to the City Court/Report City Council outlining some of the new ideas and changes within his court. Judge Hughes also thanked the Mayor and Clerk-Treasurer for all of their help with the transition. Councilor Doane Resolution 3-7-88-1/PERF for City Court Employees- made a motion to approve Resolution 3-7-88-1 to include the Carmel City Judge and his employees on the PERF Retirement Fund. This motion was seconded by Councilor Miller. All members voted aye. Motion carried. This benefit would be retro-active back to January 1, 1988. Judge Hughes was instructed to come back before the City Council with a Resolution to transfer funds for this employee benefit. - Councilor Miller made a motion to Annexation Ordinance C-123 introduce Annexation Ordinance C-123 and dispense with the reading of the same. The motion was seconded by Councilor Fleming. All members voted aye. Motion carried. Councilor Johnson made a motion to suspend the rules and act on C-123 tonight. The motion was seconded by Councilor Potasnik and all members voted aye. Council Johnson called for the question. The Mayor asked for approval of Ordinance C-123. All members voted aye. Annexation Ordinance C-123 passed unanimously. - Councilor Fleming made a motion Public Hearing - Ordinance Z-230 to introduce Ordinance Z-230 and suspend the rules for reading of the same. The motion was seconded by Councilor Potasnik. All members voted aye. Motion carried. Jim Nelson, Attorney, residing at 3663 Brumley Way presented the rezone to the city council. The Mayor opened the hearing to the public for questions and/or objections. There being none the Mayor then closed the public hearing and opened the hearing to the Council for questions. Councilor Doane asked if TEDCO would consider the possibilities of sidewalks between Summertrace and the new shopping center. Mr. Gill of TEDCO agreed to look into the possibility. Councilor Johnson made a motion to suspend the rules and act on Ordinance Z-230 tonight. The motion was seconded by Councilor Doane. All members voted aye. Motion carried. Councilor Johnson then called for the question. Mayor Hancock called for the voted on Ordinance Z-230. All members voted aye. Ordinance Z-230 passed with a unanimous vote. - Councilor Johnson made a motion Public Hearing - Ordinance Z-228 to introduce Ordinance Z-228 and dispense with the reading of the same. The motion was seconded by Councilor Miller. All members voted aye. Dennis Andrews representing Dr. Linderman on the rezone gave a brief description of what had taken place and the reason for the rezone from R2 to B7 on the property located at 82 6th Street S.E. The Mayor then opened the hearing to the public for questions and/or objections. There being none the Mayor then closed the public hearing and opened the hearing to the Council for discussion and questions. Again there were none. Councilor Johnson made a motion to suspend the rules and act on Z-228 tonight. The motion was seconded by Councilor Miller. All members voted aye. Motion carried. Councilor Johnson called for the question. The Mayor called for a vote on Ordinance Z-228. All members voted aye. Ordinance Z-230 passed with a unanimous vote. - Councilor Fleming made a motion Public Hearing - Ordinance Z-231 to introduce Z-231 and dispense with the reading of the same. The motion was seconded by Councilor Irvin. All members voted aye. Motion carried. Jim Nelson, Attorney representing Browning explained the rezone to the City Council. This rezone is from R1 to B7 a 20 acre parcel of real estate located south of East 111th between Pleasant Grove Church and U.S. 31 overlay zone and Delta Faucet Headquarters. The Mayor opened the hearing to the public for questions and/or objections. There being none the Mayor closed the public hearing and opened the hearing to the Council. A motion was made by Councilor Potasnik to suspend the rules and act on Ordinance Z-231 tonight. The motion was seconded by Councilor Doane. All members voted aye. Motion carried. Councilor Potasnik called for the question. The Mayor called for a vote on Ordinance Z-231. All members voted aye. Ordinance Z-230 passed with a unanimous vote. Ordinance S-48/An ordinance to amend the Carmel Sewer Use Rate - Council Potasnik made a motion to introduce Ordinance S-40 Ordinance S-48 amending sewer ordinance S-40. The motion was seconded by Councilor Miller. All members voted aye. Motion carried. Councilor Johnson made a motion to suspend the rules and act on S-48 tonight. The motion was seconded by Councilor Lonzo and all members voted aye. Motion carried. The Mayor explained to the Council that this was done in order to "clean up" some language within S-40. The Mayor called for a vote. All members voted aye. Motion carried. Ordinance D-542/An Ordinance To repeal No Parking Provision on South side of 2nd Street, N.E. between 4th Avenue N.E. and the - A motion was made by Councilor Lonzo to introduce school Ordinance D-542 amending D-541 and suspend the rules for reading of the same. The motion was seconded by Councilor Potasnik. All members voted aye. Motion carried. Councilor Johnson made a motion to suspend the rules and act on D-542 tonight. The motion was seconded by Councilor Miller. All members voted aye. Motion carried. The Mayor called for a vote on Ordinance D-542. All members voted aye. Ordinance D-542 passed unanimously. - Councilor Irvin checked into possible bus Miscellaneous Business service to Summertrace and St. Vincents and at this time the cost is prohibitive. Councilor Johnson asked about the status of the traffic signal to be installed in front of the new Fire Station. Don Silvey stated it should be ready any day. Councilor Potasnik asked about a possible ordinance regulating tent sales. The Council thought an ordinance had already been passed and the Clerk-Treasurer was asked to check into this.
