MEETING Minutes
7:00 P.M.
CARMEL CITY MEETING HALL
AUGUST 7. 1989
The meeting of the Carmel City Council was called to order by Mayor
Dorothy J. Hancock. Members in attendance were Minnie Doane, Alan
Potasnik, Ted Johnson, Lee Lonzo, David Adams, Frank Fleming and
Tom Irvin. City Attorney Steve Andrews and Clerk-Treasurer Susan W.
Jones were also in attendance.
The invocation was given by Councilor Doane followed by the Pledge
of Allegiance.
Councilor Fleming made a motion to approve the minutes of
MINUTES:
July 17, 1989 and July 31, 1989. The motion was seconded by
Councilor Doane. All members voted aye. Motion carried.

SECOND READING/ORDINANCE Z-244/REZONE/PIA/B-7 TO B-6:
asked for questions and comments concerning Ordinance Z- 244, a
request for a rezone from B-7 to B-6 south of East 111th Street
between the Pleasant Grove Church on the east and the US 31 overlay
zone and Delta Faucet Corporation Headquarters on the west for a
mental health treatment center.
Councilor Irvin had several questions concerning commitments made
by PIA but also thanked the public for their participation and
input on this rezone.
Councilor Irvin asked for a clarification of the commitment from
the development that any person or persons adjudicated mentally
insane shall not be admitted to the treatment center. Jim Nelson,
Attorney for PIA stated that it was a private institution and that
a Judge couldn't order that to happen. Beth DeLucenay, Director of
Development for PIA also agreed with that statement made by Jim
Nelson.
Councilor Irvin asked for a bigger commitment from the developer
than the "fair share" amount stated in their commitment letter
regarding the cost of signalization of the intersection of East
111th Street and Pennsylvania. Jim Nelso stated he has worked very
closely with Wes Bucher and this was the best he could do for now.
Councilor Potasnik questioned Beth DeLucenay on their original
presentation to the surrounding property owners, if they in fact,
had stated they were going to put in a convalescent home. Councilor
Potasnik stated he had received a letter from Miss Melva Guy who
alleged this to be so. Ms. DeLucenay stated for the record, that at
no time did she ever represent that idea to anyone.
Councilor Lonzo asked for a clarification of the release procedures
from Jim Nelson and Ms. DeLucenay. Both individuals outline the
strict procedure used.
Councilor Potasnik called for the question. Minnie Doane, Alan
Potasnik, Lee Lonzo, David Adams, Frank Fleming and Tom Irvin voted
aye. Ted Johnson voted nay. Ordinance Z-244 passed by a majority of
votes.

SECOND READING/ORDINANCE D606/WATER DEREGULATION:
asked for any comments or questions regarding the proposed
Ordinance D-606, Water Deregulation.
Councilor Johnson stated he had studied the code and found some
strange and interesting things about the water utility. Councilor
Johnson stated he could not find anything in our local ordinances
that established the water utility or the Board of Public Works.
Councilor Johnson assumed the ordinances were in place but he was
having difficulty finding them. Councilor Johnson also stated his
concerns regarding loans being made from the utilities to the
general fund. In summary, Councilor Johnson stated the City should
consider getting the proper "papers" in order and to decide what
kind of a board should run the utilities. Councilor Johnson stated
he felt the disadvantages far out weighed the advantages and he was
against the proposal.
Councilor Irvin stated he also felt the disadvantages far out
weighed the advantages. Councilor Irvin felt he lacked the
expertise to run a utility.
Councilor Potasnik questioned the amount knowledge he had in
dealing with a utility and doesn't feel comfortable with the idea
of taking over a utility. Councilor Potasnik stated the Council
does a good job with budgets and local ordinances but to take on a
utility doesn't make him feel real comfortable.
Councilor Adams spoke in favor of deregulation and philosophically
has always believed in keep government close to the people.
Councilor Adams stated that despite the fact he was still in the
learning process he doesn't like the idea of giving the State the
power to determine what is best for local government.
Councilor Fleming echoed Councilor Adam's philosophy and felt that
the City still had the State Board of Accounts to watch over us and
after talking with Jim Dougherty and his thirty years of
experience, he thought it was a good idea.
Councilor Lonzo stated that while he philosophically was in favor
of water deregulation he just didn't feel comfortable with it at
this time.
Councilor Doane stated that she didn't see why we needed to
deregulate at this time.
Councilor Johnson called for the question. David Adams and Frank
Fleming voted aye. Minnie Doane, Alan Potasnik, Ted Johnson, Tom
Irvin, and Lee Lonzo voted nay. Ordinance D-606 was defeated by a
vote of 5 to 2.
Councilor Lonzo gave a brief outline of
SECOND READING D-603/EDC:
his meeting with the EDC. Councilor Lonzo stated that the problem
was a lack of communication between the two boards and that the EDC
was very willing to work with the Council. Councilor Adams made a
motion to table Ordinance D-603 until such time as the Council or
representatives of the Council had a chance to meet and talk again
with the EDC. Councilor Lonzo seconded the motion and all members
voted aye.
COMMITTEE REPORTS:
Comprehensive Plan Update: Councilor Potasnik stated that the work
on the Plan Update was being put on hold until such time as the
committee could get more input from the public. A meeting was being
held on August 8 and 7:30 P.M. at the Carmel City Meeting Hall to
begin this process.
Sidewalk Committee: Would be meeting after the regular meeting of
the Council tonight to assign priorities for sidewalk projects.
Recodification: Councilor Lonzo stated that this committee would be
meeting very soon to begin their work.

RESIGNATION OF COUNCILOR TED JOHNSON:
Councilor Johnson with a plaque for his contributions to the City
Council for the past 9 years. All members of the City Council
echoed their appreciation to Councilor Johnson for his hard work
and dedication.
Richard Frost, citizen from Carmel, spoke to the Council on
FROST:
various areas of concern to him. Mr. Frost volunteered to serve on
a "leaf burning committee" for the Council.
There being no other items of business before the Council the
meeting was adjourned.
