COMMON COUNCIL
MEETING MINUTES
MONDAY, DECEMBER 6, 2021 – 6:00 P.M.
COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE
MEETING CALLED TO ORDER
Council President Sue Finkam; Council Members: Laura Campbell, Kevin D. Rider, Adam Aasen,
Anthony Green, Timothy Hannon, Miles Nelson, Jeff Worrell and Deputy Clerk Jacob Quinn were
present.
Councilor H. Bruce Kimball was not present.
Council President Finkam called the meeting to order at 6:01 p.m.
AGENDA APPROVAL
The agenda was approved unanimously.
INVOCATION
Pastor Tim Ayers, Grace Church, delivered the Invocation
Councilor Rider led the Pledge of Allegiance.

Councilor Hannon recognized that Councilor Kimball may be watching the meeting live and wished him
well.
CONSENT AGENDA
Councilor Rider moved to approve the consent agenda. Councilor Campbell seconded. There was no
Council discussion. Council President Finkam called for the vote. The motion was approved 8-0.

Councilor Worrell reported that the Finance, Utilities and Rules Committee had met and the reports
would be given when the items appear on the agenda.
Councilor Rider reported that the Land Use and Special Studies Committee not met.

Henry Mestetsky, Executive Director of the Carmel Redevelopment Commission, gave the monthly
Redevelopment Commission report.
Michael Klitzing, Director of Parks and Recreation, gave the quarterly Parks Department report.
Jeff McDermott, President & CEO of the Center for the Performing Arts, gave an update to Council.
OLD BUSINESS
Council President Finkam announced the Fourth Reading of Ordinance D-2605-21; An Ordinance of
the Common Council of the City of Carmel, Indiana, Adding Section 3-48 to Chapter 3, Article 1,
Division II of the Carmel City Code. Councilor Worrell reported that the item is returning from the
Finance, Utilities and Rules Committee with a positive 3-0 recommendation and proposed amendments.
Councilor Worrell moved to amend Ordinance D-2605-21 by inserting Version A in Whole. Councilor
Rider seconded. There was no Council discussion. Council President Finkam called for the vote. The
motion to amend was approved 8-0. Councilor Worrell moved to approve Ordinance D-2605-21 As
Amended. Councilor Rider seconded. There was no Council discussion. Council President Finkam called
for the vote. Ordinance D-2605-21 As Amended was approved 8-0.
Council President Finkam announced the Third Reading of Ordinance D-2606-21; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Chapter 8, Article 5, Sections 8-45 and 8-48
of the Carmel City Code. Councilor Worrell reported that the item is returning from the Finance, Utilities
and Rules Committee with a positive 3-0 recommendation and proposed amendments. Roger McMichael,
Associate Superintendent of Carmel Clay Public Schools, addressed Council. Toby Steele, Assistant
Principal of Carmel High School, addressed Council. Benjamin Legge, Assistant Corporation Counsel,
Councilor Worrell moved to amend Ordinance D-2606-21 by inserting Version A in Whole. Councilor
Nelson seconded. There was no Council discussion. Council President Finkam called for the vote. The
motion to amend was approved 8-0. Councilor Worrell moved to approve Ordinance D-2606-21 As
Amended. Councilor Rider seconded. There was no Council discussion. Council President Finkam called
for the vote. Ordinance D-2606-21 As Amended was approved 8-0.
PUBLIC HEARINGS

Council President Finkam announced the First Reading of Ordinance Z-670-21; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending the WestClay Village Planned Unit
Development District Ordinance. Councilor Worrell moved to introduce the item into business. Councilor
Rider seconded. Jon Oberlander, Interim Corporation Counsel, presented the item to Council. Council
President Finkam opened the public hearing at 7:13 p.m.
Jackie Phillips, Carmel Healthy Neighborhoods Alliance, spoke in favor of Z-670-21 and presented on the
dangers of vapors from gas stations.
Heather Misra spoke in favor of Ordinance Z-670-21 stating that the proposed sight is within 500 feet of a
senior care facility and numerous private residences.
Sunjay Kamath spoke in favor of Z-670-21 and encouraged the City Council to continue to be forward
thinking.
Sebastian Zavoian spoke in favor of Z-670-21 and talked about the dangers of benzene.
Allison Brown spoke in favor of Z-670-21 and how passing it would improve air quality in the
community.
Bruce Fleming spoke in favor Z-670-21 and talked about the dangers of benzene.
Mary Gerbracht, Laurel Lakes HOA President, spoke in favor of Z-670-21.
Seeing no one else who wished to address Council, Council President Finkam closed the public hearing at
7:37 p.m.There was Council discussion about the status of the proposed gas station. Council President
Finkam referred the item to the Land Use and Special Studies Committee.
Council President Finkam announced the First Reading of Ordinance Z-672-21; An Ordinance of the
Common Council of the City of Carmel, Indiana, Rezoning a 5 Acre Parcel Located at 2140 E. 116th
Street in the Merchants Square Shopping Center from the B-8 Business District to the C2/Mixed Use
District. Councilor Rider moved to introduce the item into business. Councilor Campbell seconded.
Adrienne Kelling, Department of Community Services, presented the item to Council. Council President
Finkam opened the public hearing at 7:42 p.m.
Seeing no one who wished to address Council, Council President Finkam closed the public hearing at
7:42:10 p.m. Council President Finkam referred the item to the Land Use and Special Studies Committee.
Council President Finkam announced the First Reading of Ordinance D-2607-21; An Ordinance of the
Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional
Appropriation of Funds from the General Fund #101 to the 2021 Carmel Police Department Budget;
Sponsor. Councilor Campbell moved to introduce the item into business. Councilor Worrell seconded.
Councilor Campbell introduced the item to Council. Council President Finkam opened the public hearing
at 7:45 p.m.
Seeing no one who wished to address Council, Council President Finkam closed the public hearing at
7:45:10 p.m. Councilor Rider moved to suspend the rules and act on this tonight. Councilor Campbell
seconded. There was no Council discussion. Council President Finkam called for the vote. The motion
was approved 8-0. Councilor Campbell moved to approve Ordinance D-25607-21. Councilor Nelson
seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-
2607-21 was approved 8-0.

Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional
Appropriation of Funds from the Operating Balance of the General Fund to the 2021 Carmel Fire
Department Budget. Councilor Worrell moved to introduce the item into business. Councilor Campbell
seconded. Councilor Worrell introduced the item to Council. Council President Finkam opened the public
hearing at 7:46 p.m.
Seeing no one who wished to address Council, Council President Finkam closed the public hearing at
7:47 p.m. Councilor Worrell moved to suspend the rules and act on this tonight. Councilor Campbell
seconded. There was no Council discussion. Council President Finkam called for the vote. The motion
was approved 8-0. Councilor Worrell moved to approve Ordinance D-25608-21. Councilor Campbell
seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-
2608-21 was approved 8-0.
Council President Finkam announced the First Reading of Ordinance D-2609-21; An Ordinance of the
Common Council of the City of Carmel, Indiana, Authorizing and Approving an Appropriation of Funds
from the Operating Balance of the Motor Vehicle Highway Fund (Fund #201). Councilor Campbell
moved to introduce the item into business. Councilor Worrell seconded. Councilor Campbell introduced
the item to Council. Council President Finkam opened the public hearing at 7:48:10 p.m.
Seeing no one who wished to address Council, Council President Finkam closed the public hearing at
7:48:17 p.m. Councilor Campbell moved to suspend the rules and act on this tonight. Councilor Worrell
seconded. There was no Council discussion. Council President Finkam called for the vote. The motion
was approved 8-0. Councilor Campbell moved to approve Ordinance D-25609-21. Councilor Worrell
seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-
2609-21 was approved 8-0.

Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional

Council President Finkam announced the First Reading of Ordinance D-2611-21; An Ordinance of the
Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional
Appropriation of Funds from the Storm Water Management Fund to the 2021 Storm Water Budget.
Councilor Campbell moved to introduce the item into business. Councilor Worrell seconded. Councilor
Campbell introduced the item to Council. Council President Finkam opened the public hearing at 7:50:20
p.m.

Council President Finkam announced the First Reading of Ordinance D-2613-21; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 3, Division II, Section 2-
54 of the Carmel City Code. Councilor Nelson moved to introduce the item into business. Councilor
Rider seconded. Councilor Nelson introduced the item to Council. Councilor Rider moved to suspend the
rules and act on this tonight. Councilor Nelson seconded. There was no Council discussion. Council
President Finkam called for the vote. The motion was approved 8-0. Councilor Nelson moved to approve
Ordinance D-25613-21. Councilor Rider seconded. There was no Council discussion. Council President
Finkam called for the vote. Ordinance D-2613-21 was approved 8-0.
Council President Finkam announced Resolution CC-12-06-21-11: A Resolution of the Common
Council of the City of Carmel, Indiana, Expressing Interest in the Purchase of Certain Properties Valued
at Over $25,000 and Associated with City Improvement Projects. Councilor Rider moved to introduce the
item into business. Councilor Worrell seconded. Councilor Hannon recused himself from discussion of
the item. Councilor Rider introduced the item to Council. Councilor Rider moved to approve Resolution
CC-12-06-21-11. Councilor Worrell seconded. There was no Council discussion. Council President
Finkam called for the vote. Resolution CC-12-06-21-11 was approved 6-0 (Campbell absent and Hannon
recused)

Council of the City of Carmel, Indiana, Approving a Transfer of Funds Within the 2021 Carmel Law
Department Budget. Councilor Worrell moved to introduce the item into business. Councilor Rider
seconded. Councilor Worrell introduced the item to Council. Councilor Rider moved to approve
Resolution CC-12-06-21-01. Councilor Worrell seconded. There was no Council discussion. Council
President Finkam called for the vote. Resolution CC-12-06-21-01 was approved 7-0 (Hannon absent)
Council President Finkam announced Resolution CC-12-06-21-02: A Resolution of the Common
Council of the City of Carmel, Indiana, Approving a Transfer of Funds Between the Grant Fund
(CFD)(#900) and the General Fund (#101). Councilor Campbell moved to introduce the item into
business. Councilor Worrell seconded. Councilor Campbell introduced the item to Council. Councilor
Rider moved to approve Resolution CC-12-06-21-02. Councilor Worrell seconded. There was no Council
discussion. Council President Finkam called for the vote. Resolution CC-12-06-21-02 was approved 8-0

Highway Fund Engineering Department Budget. Councilor Nelson moved to introduce the item into

moved to approve Resolution CC-12-06-21-05. Councilor Nelson seconded. There was no Council

and the Storm Water Management Fund (#250). Councilor Worrell moved to introduce the item into

moved to approve Resolution CC-12-06-21-06. Councilor Nelson seconded. There was no Council

Illinois Street Improvement Fund (#212) and the Motor Vehicle Highway Fund (#201). Councilor Nelson

item to Council. Councilor Worrell moved to approve Resolution CC-12-06-21-07. Councilor Nelson

Communication System (ICS) Department Budget. Councilor Worrell moved to introduce the item into
business. Councilor Rider seconded. Councilor Worrell introduced the item to Council. Councilor Worrell
moved to approve Resolution CC-12-06-21-08. Councilor Rider seconded. There was no Council
discussion. Council President Finkam called for the vote. Resolution CC-12-06-21-08 was approved 8-0

moved to approve Resolution CC-12-06-21-12. Councilor Campbell seconded. There was no Council
discussion. Council President Finkam called for the vote. Resolution CC-12-06-21-12 was approved 8-0

Approval of CRC Purchase of 611 3rd Ave SW. Henry Mestetsky presented the item to Council. There
was extensive Council discussion. Council President Finkam referred the Item to the Finance, Utilities
and Rules Committee.
