HomeMy WebLinkAboutAsherwood Waiver Request Reduction of 30-foot Drainage Easementskimley-horn.com 250 East 96th Street, Suite 580, Indianapolis, IN 46240 317 218 9560 November 11, 2021 City of Carmel Engineering Department One Civic Square Carmel, IN 46032 Attention: Jeremy Kashman Re: Asherwood Waiver Request for reduction of 30’ drainage easements to 20’ Dear Mr. Kashman, On behalf of Asherwood Carmel, LLC, we would like to request a waiver to Stormwater Technical Standard Section 306.02.A requiring all new channels, drain tiles equal to or greater than 12 inches in diameter, inlet and outlet structures of detention and retention ponds, and appurtenances thereto as required by this Article, that are installed in subdivisions requiring a stormwater management permit from the City of Carmel shall be contained within a minimum 30 feet of drainage easement (15 feet from centerline on each side) and shown on the recorded plat. This subdivision will have a minimum 20’ Tree Preservation Easement around the perimeter of the site. Rear yard drainage swales or pipes will be adjacent to this 20’ easement. An additional 30’ drainage easement will restrict the back 50’ of the perimeter lots from any lot improvements for future homeowners. This is will be a high-end custom home neighborhood, so footprints of homes are unknown at this time of development. In addition, these homeowners will most likely add decorative patios or swimming pools to enhance their lot. 50’ of restricted area on the rear of some of these lots will greatly impact what area they have in the rear of their home for improvements. In addition to this and probably most importantly, the drainage system including storm sewers in this development will be private and maintained by the developer/HOA. Lastly, there is a restrictive covenant currently in place on this property that requires a 75’ minimum front setback. We are pursuing getting that reduced to 40’. If unsuccessful, a 75’ front setback and 50’ rear yard restrictive easement would extremely minimize area for homes.
