Members Present: Alan Potasnik(President),James Hawkins(Vice President),Leo Dierckman,Kent Broach,Brad Grabow

Approval of Meeting Minutes of the previous BZA Meeting:
A Motion made by Dierckman and seconded by Grabow to approve the Sept.27,2021 BZA meeting minutes.Approved 5-0.
Reports,Announcements,Legal Counsel Report,and Department Concerns
1. BZA Rules of Procedure and voting method: Angie Conn:
• The BZA Rules of Procedure were amended and approved by the BZA members to no longer to cast your vote
on a ballot, but rather by raising your hand.
2. 2022 BZA Calendar Dates&Deadlines: Angie Conn:
• The 2022 BZA calendar has been distributed for your review.All meetings will occur on the 4th Monday of
each month except in December.
A Motion made by Dierckman and seconded Hawkins to adopt the 2022 BZA Calendar. Approved 5-0.
Public Hearings
(UV)Helen Coffee Shop Walk Up Window.
The applicant seeks the following use variance approval:
1. Docket No.PZ-2021-00172 UV UDO Section 235 Permitted Uses,Use Variance requested for
Restaurant with Walk Up Window. The site is located at 211 W. Main St.,at Monon and Main-South.It is
zoned C2/Mixed Use. Filed by Sandra Newkirk,owner.
Petitioner: Sandra Newkirk
• 250 sq.ft. space,and to add a walk-up window for customers
• There's 3-ft from the window to the sidewalk
• The sidewalk is 7'8"wide
• Two other businesses in the downtown area have walk-up windows
• We have received positive recommendations from the public
Public Comments: None
Department Report: Angie Conn:
• Pictures of Rita's Ice Cream off of Main Street were given to the BZA members. It has similar walk-up window.
• Staff recommends approval of this Use Variance request
Board Comments:
Brad: Will there be a trash can by the walk-up window? Sandra Newkirk: We do not have one, but we can provide one

if needed. There's a trash can already present along Main Street in this area. We never had any problems with customers
leaving their trash at our other location.
A Motion made by Dierckman and seconded by Broach to approve Docket No. PZ-2021-00172 UV with the
adoptions of the Findings of Fact. Approved 5-0.
(SUA)Faith Apostolic Church Expansion.
The applicant seeks the following special use amendment approval for a building addition and site improvements:
2. Docket No.PZ-2021-00175 SUA UDO Section 2.07 Institutional Special Use for
Church/Temple/Place of Worship. The site is located at 1212 E. 116th St.It is zoned R1/Residence and
SFHA/Special Flood Hazard Area. Filed by Jim Shinaver of Nelson&Frankenberger LLC on behalf of Faith
Apostolic Church.
Petitioner: Jim Shinaver
• Presented a site location map
• Special Use approval is needed by the BZA since the use-Church-is an institutional special use of the Ordinance
• We received variance approvals by the BZA hearing officer for front yard building setback,and building height
• Presented landscape plan, site improvements include parking additions,perimeter landscape buffering,and
parking lot landscaping
• Presented a street view and aerial perspective/renderings of the new proposed new building and expansion
• The elevations,engineering plans,and building materials are included in the info packet
• No new signage will be proposed
• The Church is agreeable to Staffs conditions of approval
• We received one letter of support from an adjacent neighbor
Public Comments: None
Department Report: Angie Conn:
• The Petitioner did go through the TAC,and did address most of the BZA review comments
• Staff recommends approval upon the condition of approval with addressing all remaining TAC comments
Board Comments:
Kent: Where did the letter of support come from?Jim Shinaver: The letter came from a property owner to the south,
across the street in Monon Farms. We have been in contact to with the adjacent neighbor to the west(1200 E 116th St.)
and they are in support.
Brad: Did TAC review the sidewalk plans on the older or newer version of the site plan?Angie Conn: I can follow up
with the CFD to make sure pedestrians would not congest that area around this site.
Leo: Will there be any bells or loudspeakers?Jim Shinaver:No exterior bells or loudspeakers.
A Motion made by Dierckman and seconded by Broach to approve Docket No.PZ-2021-00175 SUA contingent
upon all TAC comments are addressed and the adoptions of the Findings of Fact. Approved 5-0.
