SPECIAL MEETING
MINUTES
SEPTEMBER 30, 1993
7:00 P.M.
ONE CIVIC SQUARE / COUNCIL CHAMBERS
The special meeting of the Carmel Board of Public Works and Safety
was called to order by Mayor Johnson. Board members Rick McKinney
and Steve Brown were in attendance. City Attorney, Gordon Byers
and Clerk-Treasurer Susan W. Repp were also in attendance.
ADMINISTRATIVE LEAVE - CARMEL POLICE DEPARTMENT OFFICER JEFFREY D.
City Attorney, Gordon Byers outline the cause for the
JELLISON:
special meeting of the Board of Public Works and Safety which
related directly to a recommendation by the Chief of the Carmel
Police Department, Roger C. Conn, that Carmel Police Officer,
Jeffrey Jellison continue his administrative leave with no pay.
Byers stated, for the record, the Board was bound by a new statute
enacted in July of 1993 to stay the proceeding of disciplinary
action against Officer Jellison, pending final determination of
criminal charges placed against him by the Hamilton County
Prosecutor.
Byers explained to the Board, their sole action for the evening
would be to determine if Jellison's administrative leave would
continue with or without pay or the Board could opt to remain at
status quo and take the matter under advisement for determination
at a later date.
Carmel Police Chief Roger Conn recommended that the Board continue
Jellison's administrative leave with no pay.
Officer Jellison's attorney, John F. Kautzman, appealed to the
Board to consider Jellison's record and his right to due process
and allow continuation of his salary until Jellison was able to
complete his defense against the criminal charges. Kautzman
advised the Board it would be their right to reconsider their
action and revisit their decision, if they believed the legal
process was moving too slow.
Extensive discussion ensued among Board members, Byers, Kautzman
and Conn pertaining to the Board's rights and options with
relationship to Jellison's salary.
McKinney made a motion to allow continuation of Jellison's
administrative leave with no pay. The motion was seconded by
Johnson. Board members, Kautzman, Byers and Conn continued
discussion.
Brown made a motion to amend the motion by stating Jellison be
allowed administrative leave with salary to cease after 45 days.
The motion was seconded by Johnson for the purpose of discussion.
Brown stated it was his desire to allow pay for work done in the
police department. Byers advised Brown no civilian-type positions
were available to accommodate Jellison. Brown motioned to withdraw
his amendment, seconded by Johnson.
Continued discussion ensued among Board members, Byers and
Kautzman.
Call for the question. All members voted aye.
There being no further business before the Board, the Board meeting
was adjourned.
