1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
It is an engineered structure which will be attached to the building frame and embedded in concrete footings
to ensure stability and longevity. It will be on a single family lot and used only for their personal enjoyment
and protection from the weather.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
Several other properties in the neighborhood currently have Smart Pergolas and the builder of the homes in
the neighborhood now includes Smart Pergolas in their new home construction.The neighborhood HOA
ARB has approved the project.The pergolas are made of weather-resistant materials to avoid maintenance.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties
in the use of the property because:
The patio area extends to the property line,and thus cannot be protected from weather without a cover that
also extends to the property line. The north property line leads to a landscaped area kept open for community
beautification and cannot be used as a future residential lot.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
Docket No. is granted,subject to any conditions stated in the minutes of this Board,
which are incorporated herein by reference and made a part hereof.
