COUNCIL CHAMBERS/CITY HALL/ON E CIVIC SQUARE The meeting of the Carmel Board of Public Works was called to order by Mayor Ted Johnson. Members present were Steve Brown and Rick McKinney. City Attorney Gordon Byers, Clerk- Treasurer Susan Jones and her Deputy Anne Hartman were also in attendance. APPROVAL OF MINUTES: Mayor Johnson made a motion to approve the minutes of October 5, 1994. Rick McKinney seconded the motion with an amendment that a sentence be inserted that he would approve Saturday or Monday for the Howlin' Halloween Happening but not Sunday. Mayor Johnson called for the question. All members voted aye. BID OPENING/146TH STREET AND CAREY ROAD SIGNAL INSTALLATION: The following bids were opened and read aloud for the Traffic Signal Installation at Carey Road and 146th Street: Michiana Electrical $55,452.36 James Drew Corp 59,720.51 Signal Construction Inc 49,998.25 Midwestern Electric 51,936.85 Hoosier Company 52,588.35 The bids were given to City Engineer Tom Welch for his review and recommendation. Mayor Johnson made a motion to allow the Mayor to sign and award the contract upon the recommendation of the Engineer. Rick McKinney seconded the motion. All members voted aye. Motion carried. BID AWARD/STORM DRAINAGE PROGRAM: Upon the recommendation of City Engineer Tom Welch, Mayor Johnson made a motion to award D.R. Childs Corp. with the bid of $233,650 for storm drainage. Steve Brown seconded the motion. All members voted aye. Motion carried. REQUEST TO SPEAK TO BOARD OF PUBLIC WORKS: Mayor Johnson recognized Alan Klineman of 11707 Forrest Drive and serves on the Plan Commission and Board of Zoning Appeals who wished to speak. Klineman spoke of his concerns with the traffic patterns at the new Kroger. Klineman stated the width of Executive Drive is too narrow for trucks to enter and the Right In/Right Out is not working. He feels that there is a serious problem that needs to be addressed before the subdivision is fully developed. Mayor Johnson stated that the road has been designed by engineers and the City can't do anything about the street at this time, that proper signage is not up yet for "Right In/Right Out", trucks should not be entering from Executive Drive, and asked that engineers go back and recalculate figures. WATER REIMBURSEMENT AGREEMENT/ASHMORE TRACE: Mayor Johnson made a motion to approve Water Reimbursement for Ashmore Trace in the amount of $146,800. Rick McKinney seconded the motion. All members voted aye. Motion passed. WATER & SEWER AVAILABILITY/REFUND OF FEE/WALGREENS: Mayor Johnson made a motion to approve a refund in the amount of $15,720 for water connection fees and $9,540 for sewer connection fees due to a reduction from 13 EDU's to 1 EDU. Steve Brown seconded the motion. All members voted aye. Motion passed. UTILITY AGREEMENTS FOR 116TH STREET: Mayor Johnson made a motion to approve the Utility Agreements with Indiana Gas, Ameritech and Indianapolis Power and Light for the 116th Street Project. Rick McKinney seconded the motion. All members voted aye. Motion passed. BOND RELEASES/BROOKSHIRE ESTATES/BAYHILL/DANBURY ESTATES: Mayor Johnson made a motion to approve the following bond releases: Brookshire Estates Sidewalks $ 5,600 Bayhill Section 6 Sanitary Sewers 135,255 Danbury Estates Section 1 Water Main & San. Sewer 114,605 Danbury Estates Section 1 Storm Sewers 79,838 Rick McKinney seconded the motion. All members voted aye. Motion passed. CONTRACT AMENDMENT/DATA LINK INC: Mayor Johnson made a motion to approve Data Link Amendment #4 in the amount of $11,794.75 for the Utilities Department. Steve Brown seconded the motion. All members voted aye. Motion passed. MAINTENANCE CONTRACT/DEPARTMENT OF TOXICOLOGY: Mayor Johnson made a motion to approve the Maintenance Contract with the Department of Toxicology for the Police Department. The one- year agreement price is $355. Rick McKinney seconded the motion. All members voted aye. Motion passed. AGENDA ADD ON/AMENDMENTS TO CONTRACTS WITH CLAY TWP REGIONAL WASTE DISTRICT AND HAMILTON WESTERN UTILITIES: City Attorney Gordon Byers explained that the amendments to the agreements between the City of Carmel and Clay Twp. Regional Waste and Hamilton Western Utilities are raising the rates from the 1987 Agreements. This reflects a 34.46% rate increase and will take effect November 1, 1994. Mayor Johnson made a motion to approve the Amendments. Rick McKinney seconded the motion. All members voted aye. Motion carried. SWEARING IN OF NEW POLICE OFFICER : Assistant Police Chief Tim Green introduced Stephen A. Stalets to the Board of Public Works and swore him in as Patrolman 3rd Class. REQUEST FOR BOARD OF PUBLIC WORKS HEARING/JEFF JELLISON: Upon request of the Carmel Police Department there will be a hearing for Jeff Jellison on November 9, 1994 at 6:15 P.M. if okay by statute. City Attorney Gordon Byers will contact Jellison's legal counsel and report back when they can meet. Gordon Byers also requested that a court reporter be present. HEALTH INSURANCE/NYHART CLAIMS: Mayor Johnson moved to approve claims dated 9/30 in the amount of $2,440, 10/4 in the amount of $17,002.75, 10/6 in the amount of $13,937.68 and 10/11 in the amount of $11,905.34. Rick McKinney seconded the motion. All members voted aye. Motion passed. REQUEST FOR PERMISSION TO CLOSE FOUNTAIN SQUARE TO TRAFFIC: Mayor Johnson made a motion to grant the request to close Fountain Square to traffic on Tuesday, November 22 for the Lighting of the Square Event. Rick McKinney seconded the motion. All members voted aye. Motion passed. REQUEST FOR PERMISSION TO USE GAZEBO FOR CONCERT: Mayor Johnson made a motion to approve the request from Joe Filipow to use the Gazebo for a concert on October 21 from 5 to 9 P.M., along with a request for electricity and Public Address system. Mayor Johnson told him to contact his office to set up the Public Address system and electricity, and that cleaning up after concert would be his responsibility. Steve Brown seconded the request. All members voted aye. Motion carried. LETTER OF INQUIRY REGARDING INTERSECTION AT GRAY ROAD & WOOD CREEK DRIVE: Mayor Johnson stated that this was for information only that a letter was written by Carmel resident Robert Halpin as to the potentially dangerous intersection at Wood Creek Drive and Gray Road. There will be warning signs of the blind intersection posted before the crest of the hill. There being no further business before the Carmel Board of Works the meeting was duly adjourned.
