PUBLIC HEARING/AUCTION OF CITY REAL ESTATE
SEPTEMBER 21, 1994
4:30 P.M.
CITY HALL/ONE CIVIC SQUARE/C OUNCIL CHAMBERS
The meeting of the Carmel Board of Public Works was called to order
by Mayor Ted Johnson. Member present was Steve Brown. Clerk-
Treasurer Susan Jones and City Attorney Gordon Byers was also in
attendance. Rick McKinney arrived late for the meeting and
participated in the vote for the acceptance of the high bid for 11-
15 1st. Avenue.
OPEN BIDS FOR CITY PROPERTIES AT 40 EAST MAIN STREET AND 11-15
The following bids were received, opened and

AUCTION FOR 40 EAST MAIN STREET:
Gordon Byers then began the open auction. Each person or company
that had submitted a written bid was given an opportunity to raise
their bid through the auction process. Byers began with the 40
East Main property at the price of $70,000. After 6 rounds of
biding the final bid taken was $105,000 with no contingencies from
Stamp-Altman Associates. Byers stated Altman's written proposal
was in compliance and that a certified check or cashiers check in
the amount of 10% needed to be submitted to the clerk's office and
would be held until the City Council gave their final approval.
Steve Brown moved to accept the final bid of $105,000 from Stamp-
Altman Associates with no contingencies and to accept the final
sale of the property provided the City Council also approves the
bid price. Mayor Johnson seconded the motion. All members voted
aye. Motion carried.
Byers warned Stamp-Altman Associates that the Council could reject
the bid or could make certain stipulations and/or contingencies on
the final sale. Altman stated they would consider any changes or
stipulations as a counter offer and would then have the right to
counter the Council's offer. Byers stated the final price could
not be changed regardless of any contingencies the Council may
place on the building.

were tenant's rights involved with this building and the building
would have to be made available for election purposes on November
8th.
Byers then began the open auction. Each person or company that had
submitted a written bid was given an opportunity to raise their bid
through the auction process. Byers began with the base auction
price of $71,000. After 43 rounds of biding the final bid taken
was $125,500 with no contingencies from Mike Keen. Byers stated
Keen's written proposal was in compliance and that a certified
check or cashiers check in the amount of 10% needed to be submitted
to the clerk's office by the close of tomorrow's business and would
be held until the City Council gave their final approval.
Steve Brown moved to accept the final bid of $125,500 from Mike
Keen with no contingencies and to accept the final sale of the
property provided the City Council also approves the bid price.
Mayor Johnson seconded the motion. All members voted aye. Motion
carried.
Byers again warned Keen that the Council could reject the bid or
could make certain stipulations and/or contingencies on the final
sale. Keen said he understood. Byers stated the final price could
not be changed regardless of any changes or contingencies the
Council may place on the building.
A copy of the original bid proposals is attached to these minutes
as a part of the permanent record.
There being no further business before the Board the meeting was
duly adjourned.
