CITY HALL/ONE CIVIC SQUARE/COUNCIL CHAMBERS The meeting of the Carmel City Council was called to order by Mayor Ted Johnson. Councilors present were Tim Story, Christopher Painchaud, Alan Potasnik, Tom Kendall, Frank Fleming, James Quinn and Luci Snyder. Clerk-Treasurer Susan W. Jones and City Attorney Gordon Byers were also in attendance. A motion was made by Councilor Quinn to approve the MINUTES: minutes of the May 2, 1994 Council meeting. The motion was seconded by Councilor Fleming. All members voted aye. Motion carried. Councilor Kendall made a motion to approve the following CLAIMS: claims. The motion was seconded by Councilor Quinn. All members voted aye. Motion carried. Claims dated 4/28/94 in the amount of $ 412,485.57 Claims dated 4/27/94 in the amount of $ 387,098.20 Claims dated 5/04/94 in the amount of $ 424,365.23 Claims dated 5/06/94 in the amount of $13,200,909.58 Claims dated 5/10/94 in the amount of $ 63,477.32 Claims dated 5/11/94 in the amount of $ 374,043.40 A representative of the Park Board gave a brief COMMITTEE REPORT: report on the new Flowing Well Park and the construction on the Carey Grove Park. Councilor Story commented on the financial statements submitted by the township and stated he couldn't understand them. The Mayor stated this would be the responsibility of the township trustee to explain the reports and not a member of the Park Board. Councilor Kendall suggested a pay telephone be installed at all the parks for emergency use. SECOND READING/D-1079/AN ORDINANCE CREATING A STOP INTERSECTION AT A motion was made by Councilor CAREY ROAD AND HAWTHORN DRIVE WEST: Quinn to adopt Ordinance D-1079. The motion was seconded by Councilor Kendall. Petitions and letters in support of the stop intersection were presented by Debbie Tidler, Cherie Culler and Janie Narain, members of the Smokey Ridge, Foster Estates and Foster Ridge Homeowners Association meetings. Mayor Johnson called for the question. All members voted aye. Ordinance D-1079 passed by a unanimous vote. ORDINANCE Z-290/FIRST READING AND PUBLIC HEARING/ REQUEST FOR A ZONING CHANGE FROM R-1 TO B-1/YOUNG ASPHALT/839 NORTH Councilor Painchaud made a motion to introduce Z- RANGE LINE ROAD: 290. The motion was seconded by Councilor Snyder. E. Davis Coots, attorney for the petitioner, gave an outline of the zoning request. Mr. Coots stated that a restraining order was filed by the City against any commercial activity taking place on this property back in 1987. Coots went on to state that the petitioner is presently in violation of that restraining order and is using the land for commercial use. Mr. Coots said the Plan Commission gave the zoning request a negative recommendation to the Council but asked the Council for approval in order to bring the petitioner into compliance. The Mayor then opened the meeting to the public. Lynn Nevit of 1840 East 136th Street testified that Young was not only storing trucks on the property but was also dumping and has destroyed the land. Nevit asked how this man can be stopped. Councilor Kendall made a motion to suspend the rules and act on Z- 290 tonight. The motion was seconded by Councilor Snyder. Councilor Painchaud voted nay. Motion did not carry. Seeing and hearing no other persons wishing to testify the Mayor closed the public hearing. Councilor Potasnik asked Mr. Coots if it was the intent of the owner to continue current use of the land. Mr. Coots replied yes. Councilor Snyder asked Gordon Byers what the status was on the violation of the restraining order. Mr. Byers said this violation of the restraining order came to the attention of the Department of Community Development in March when the petition was filed. Byers said there was a hearing set for May 27, 1994. Byers also said the DNR and DIEM were also doing investigations of possible violations on the property. A second reading will take place on June 6, 1994. ORDINANCE D-1074/ADDITIONAL APPROPRIATION/$25,000/CCS FUND: Councilor Snyder made a motion to introduce Ordinance D-1074. The motion was seconded by Councilor Story. The Mayor opened the meeting to a public hearing. Seeing and hearing no one that wanted to address the Council, the Mayor closed the hearing. Councilor Quinn made a motion to suspend the rules and act on Ordinance D-1074 tonight. The motion was seconded by Councilor Snyder. All members voted aye. Motion carried. Councilor Quinn made a motion to adopt D-1074. The motion was seconded by Councilor Snyder. Mayor Johnson called for the question. All members voted aye. Councilor Snyder asked the Council for possible BUDGET MEETINGS: meeting dates for the budget hearings. Councilor Quinn said he was open to suggestions but definitely wanted the meetings televised. Councilor Painchaud suggested Snyder set the meeting dates and go from there. Councilor Quinn asked the Clerk when the budget notebooks would be done. The Mayor said he was submitting the notebooks for his departments and would have them to the Council and to the Clerk on June 6. Councilor Quinn again asked the Clerk when the notebooks would be done. The Clerk replied she needed two weeks. Councilor Snyder asked the Clerk when the last date was to consider the budgets. The Mayor said sometime in August. Councilor Story then suggested that the Mayor consider a 3% raise for all employees of the City with an additional 1% for the police department and another 1% beyond that for merit raises for some special police officers. Story felt those men and women of the police department who lay their life on the line every day should be properly compensated. Councilor Kendall, Snyder and Quinn agreed with Story's proposal. Councilor Quinn said he was not in favor of giving raises to elected officials during his term but was considering giving significant raises to those elected to the next term. Quinn asked the other Councilors to consider such a proposal. The Clerk stated the salary ordinance that was now in place, expires at the end of this year and something would have to be done in order for the Clerk, the Judge and the Mayor to get paid in 1995. There being no further business before the Council the meeting was adjourned.
