Mayor James Brainard, Board Members Billy ~Valker and Mary Ann Burke. Deputy Clerk Robin
Butler also artended.
Mayor Brainard called the meeting to order at 10:06 a.m.
APPROVAL OF MINUTES
Board Member Burke moved to approve the minutes from the January 5, 2000, regular meeting.
Board Member Walker seconded. The minutes were approved 3-0.
BID/OUALIFICATION OPENINGS
Award for 2000 Traffic Sienal Maintenance: Mayor Brainard read a letter dated January 11, 2000
from David Klingensmith, Street Department which recommended that the Board accept the quote
from Zeal Construction Ser~-ices, Inc. forthe Traffxc Signal Maintenance for 2000. Mayor Brainard
moved to approve the quote as recommended. Board Member Walker seconded. The quote was
awarded 3-0.
PERFOR~IANCE RELEASES
Mayor Brainard moved to approve the following resolutions:

Board Member Burke seconded the motion. The resolutions were approved 3-0.
CONTRACTS:
A~reement for Professional Services with Truex Appraisal Ser~-ices; Mayor Brainard moved to
approve the a~eement. Board Member Burke seconded. The a~eement was approved 3-0.
A~reement for Purchase of Goods and Ser~-ices with Kridan Business Equipment & Supplies
(Copier Ser~-ice Contract); Mayor Brainard moved to approve the agreement. Board Member Burke
seconded. The a~eement was approved 3-0.
REOUEST TO USE CITY PROPERTY/CLOSE STREET:
Request to Close Streets for Two Foot Races: Nelson Steele. Indv Runners; Sunday~ February 6~
2000 and Sunday. March 26. 2000: Police Chief Fogarty stated that Mr. Steele had cleared the
courses with Major James Balow of the Police Department. Mayor Brainard moved to approve the
request. Board Member Walker seconded. The request was approved 3-0.
Request to Use Gazebo for Performances of Godspell: Susan Creviston, Carmel Community' Pla~'ers;
June 1-3, June 8-10, June 15-17, 2000:7:00 p.m. to 11:00 p.m.; Mayor Brainard moved to approve
the request with the conditions mentioned in the request letter. Boad Member Burke seconded. The
request was approved 3-0.
Request to Use 2.'3 Caucus Room for Meetinas: Ronald Carlet, Carmel Farmer's Market Committee;
Wednesdays, January 26 and February 9, 2000:7:00 p.m. to 9:00 p.m.; and Council Chambers on
Wednesday, February 16, 2000:6:00 p.m. to 9:00 p.m.: Mayor Brainard moved to approve the
requests. Board Member Walker seconded. The request was approved 3-0.
Request to Use Gazebo for Garden Faire: Mark Varnau, Citizens for Greenspace; Thursday' through
Saturday, May 10, 11 and 12, 2001:8:00 a.m. to 4:00 p.m.: Mayor Brainard moved to approve the
request. Board Member Burke seconded. The request was approved 3-0.
Request to Use Gazebo for Houndstock: Charles Lazzara_ Speaker of the House and Lee Lonz%
Advisor: Carmel Hiah School: Saturday, May 20, 2000:12:00 p.m. to 11:00 p.m; Mayor Brainard
moved to approve the request. Board Member Walker seconded. The request was approved 3-0.
Request to Use Gazebo for Weddina: Josh I<:neifel: Saturday, July 8, 2000; 2:00 p.m. to 7:00 p.m.;
Mayor Brainard moved to approve the request. Board Member Burke seconded. The request was
approved 3-0.
OTHER:
Consideration of Disciplinary Action; Chief Michael Fogart_v, Carmel Police Department
recommended the suspension and demotion of Carmel Police Officer Tracy L. Taylor. Chief
Fogarty summarized the law suit brought against the City of Carmel by Officer Taylor, which she
dropped. He then briefly summarized the disciplinary action recommended. Mayor Brainard asked
if the City had paid any money in settlement of the law suit. Douglas Haney, City Attorney stated
that there was no money paid by the City to settle the case. The Mayor asked what the difference in
pay would be after the demotion. Chief Fogarty stated that he did not have exact numbers, but the
annual salary would be about $5,000 less. The Mayor asked if Officer Taylor will continue as a
supervisor. Chief Fogarty stated that she would not. Board Member Walker asked if Officer Taylor
will be on any type of probation when she returns. Chief Fogarty stated there would be no official
probation. Mayor Brainard asked if there were previous law suits filed by Officer Taylor. City
Attorney Haney stated there were ~ievances, but not law suits.
Board Member Burke moved to introduce the Findings of Fact into the minutes (Attachment A).
Board Member Walker seconded. The vote was 3-0. Billy moved to suspend Officer Taylor for a
period of six months beginning on January 1, 2000 and to demote Officer Tracy Taylor. Board
Member Burke seconded. The disciplinary action was approved 3-0. City Attorney Haney clarified
that the demotion was from Sargent to Master Patrol Officer.
Mayor Brainard con~atulated the Department of Law and the Police Department for the handling of
this issue.
Request for Promotion of Officer Donald Poorman to Master Patrol Officer; Mayor Brainard moved
to promote Officer Donald Poorman to Master Patrol Officer. Board Member Walker seconded.
The promotion was approved 3-0.
ADD ON ITEMS
Administrative Agreement with Nationwide Retirement Solutions (Deferred Compensation
Matching Program); Mayor Brainard moved to approve the agreement. Board Member Burke
seconded. The agreement was approved 3-0.
ADJOURNMENT
The meeting was adjourned at 10:23 a.m..
