ADJOURN~IENT CAR1MEL CITY COUNCIL MEETING MINUTES MONDAY, APRIL 17, 2000 - 7:00 P.1M. COUNCIL CI-[A_iMBERS / CITY I-[A_LL / ONE CIVIC SQUARE ME~IBERS PRESENT: Ma_vor James Brainard; Council Members I(evin I(irb_v, John I(oven, Bob Battreall, Norm Rundie, Luci Snyder, Ron CarEer and Wayne Wilson; Clerk-Treasurer Diana Cordray and Deputy Clerk Robin Butler also artended. Ma_vor Brainard called the meeting to order at 7:04 p.m. Ma_vor Brainard led the Pledge of Allegiance. RECOGNITION OF CITY E1MPLOYEES AND OUTSTANDING CITIZENS: Councilor Battreall congratulated Fred and I(aren Glaser on their recent marriage. APPROVAL OF MINUTES: RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL: COUNCIL~ ~L~_YORAL AND CLERK-TREASURER CO~I~IENTS/OBSERVATIONS: Councilor Koven stated that the Council passed Resolution CC-10-04-99-03 on October 4, 1999 which called for a 6 month moratorium on issuing certain building permits on Rangeline Road. He pointed out that the moratorium ended today. CLAI~IS: Councilor Snyder moved to approve Claims in the amounts of $488,442.40 and $63,407.08. Councilor Wilson seconded. Claims were approved 6-0 (Councilor Kirby was not present for the vote). CO~I~IITTEE REPORTS: Councilor Koven stated that the Administration Committee met for the first time on April 13, 2000. They established a regular meeting schedule of the second Friday of each month at 10:00 a.m. in the Caucus Room. The Committee discussed ~ade promotions and the committee's jurisdiction. The City depa~ments they will interface with will be: Human Resources, Information Services, Depa~ment of Law, Deparunent of Community Services, Engineering and Clerk-Treasurer. Councilor Snyder stated that the Annexation and Land Use Committee had not met since the last meeting. The committee's next meeting will be Thursday, May 11, 2000 at 7:30 a.m. in the Council Office. The subject matter will be the guidelines for annexation into the City. Councilor Wilson stated that the Economic Development Committee meeting had been cancelled. Council President Rundle stated that the Finance Committee will meet Thursday, April 20, 2000. Councilor Ca~er reported that the Parks and Recreation Committee met at 5:00 p.m. today. Randy Auler reported to the Council regarding the City:s parks. Councilor Battreall reported that at the previous Public Safety Committee meeting, the3' discussed Police readiness for annexation; Police Department personnel situation; Township Trustee question reggding bike riding on sidewalks; security cameras and new fire stations. Councilor Kirby reported that at the previous Utilities and Transportation Committee meeting the committee met with the Mayor reggding the closing of the street near Conseco. The committee approved the closing. Next meetings scheduled for May 12 and May 26, 2000. Clerk-Treasurer Diana Cordray stated that a listing of all the Council committee schedules had been sent to the Council and Department Directors and will be published in the Carmel newsletter. OLD BUSINESS: Council President Rundie introduced Ordinance D-1457-00: An Ordinance Amending Chapter 8, Article 2, Section 8-8 of the Carmel City Code (re: Street Sign Standards). Councilor Battreall moved the ordinance into business. Councilor Wilson seconded. There was no Council discussion. Ordinance D- 1457-00 was approved 7-0. Councilor Kirby, speaking as Council Parliamentarian, stated that ordinances do not need to be moved and seconded into business at second reading. Council President Rundie introduced Ordinance D-1458-00; An Ordinance Providing for Additional Appropriation of Funds from the General Fund Operating Balance ($246,916 from General Fund to Council, Police and Board of Public Works Budgets). Council President Rundie reviewed the items listed in the ordinance. There was Council discussion regarding the necessity of separate legal council for the City Council and the cost of the Council's cell phones. Ordinance D-1458-00 was approved 6-1. Councilor Battreall voted against the ordinance. Council President Rundie introduced Ordinance D-1459-00; An Ordinance Approving an Interlocal A~eement with Hamilton Count_v, Indiana, and Approving a Joint Road Construction Project (re: 146th Street and U.S. 31 Project). Councilor Snyder stated that she was incorrect earlier in the meeting when she stated the Annexation and Land Use Committee had not met since the last Council meeting. She stated that they had met to discuss this ordinance. Councilor Snyder moved to replace the TIF district numbers with a revised list. Councilor I<2oven seconded. The amendment was approved 7-0. A map produced by the City of Carmel's GIS department was distributed to the Council (Exhibit A). The map reflected the amended TIF district numbers. There was Council discussion. Ordinance D-1459-00 was approved 7-0. Council President Rundie introduced Ordinance Z-344; An Ordinance Establishing the 146th Street and I<2eystone Avenue Planned Unit Development District. There was Council discussion with Mr. Reis of The Reis Law Firm and John Molitor, Plan Commission Attorney regarding the ordinance and enforcement of violations. Councilor Snyder referred to a letter dated April 11, 2000 from the President of the Danbury Estates Homeowner's Association, David Rushing in favor of the project (Exhibit B). Councilor Carlet moved to amend the title of Section 3 to E.,cclud~dPrimarj,, and S~condarj,, {~s~s and to add into those exclusions the rental of hear), durj,, equijgmenr. Councilor Battreall seconded. The amendment was defeated 2-5. Councilors Carlet and Battreall voted for the amendment. Councilor I<2oven moved to approve the ordinance as written. Councilor Snyder seconded. Ordinance Z-344 was approved 5-2. Councilors Battreall and Carlet voted against the ordinance. PUBLIC HEARINGS: Councilor President Rundie introduced Ordinance D-1460-00; An Ordinance Vacating Right-of-Way (2"a Avenue SW between 1zt Street SW and Main Street). Councilor Kirby moved the ordinance into business, to waive the reading and asked for an explanation of the ordinance by the petitioner. Councilor Snyder seconded. Mayor Brainard explained the ordinance. The Public Hearing was opened and closed at 8:32 p.m., seeing no one from the public who wished to speak. There was Council Discussion. Council President Rundie referred Ordinance D- 1460-00 to the Annexation and Land Use Committee. Councilor Battreall seconded. Steve Engelking, Department of Community Services explained the ordinance. Mayor Brainard also commented on the ordinance. The public hearing was opened and closed at 8:46 p.m., seeing no one from the public who wished to speak. Council President Rundie referred Ordinance Z-343 to the Annexation and Land Use Committee. Councilor Wilson moved the ordinance into business. Councilor Kirby seconded. Mr. Engelking explained the ordinance. Mayor Brainard addressed the Council regarding the Ordinance. Rick Roesch, President of Carmel Redevelopment Commission also addressed the Council. There was Council discussion. The Public Hearing was opened and closed at 9:55 p.m., seeing no one from the public who wished to speak. Council President Rundie referred Ordinance Z-342 to the Annexation and Land Use Committee. Council President Rundie introduced Ordinance Z-345; An Ordinance Adopting Proposed Amendments to Certain Definitions in the Carmel .'Clay Zoning Ordinance. Councilor Wilson moved the ordinance into business. Councilor Battreall seconded. Mr. Engelking explained the changes made by the ordinance. John Molitor spoke regarding the legality of the terms referring to group homes. The Public Hearing was opened at 9:01 p.m. Rebecca Mortell from the Sycamore Farms subdivision spoke in favor of the ordinance. The Public Hearing was closed at 9:07 p.m. There was Council discussion. Council President Rundie referred Ordinance Z-345 to the Annexation and Land Use Committee. Council President Rundie introduced Resolution CC-04-17-00-02- A Resolution Regarding the Review of the Park Impact Fee, Impact Zone and Zone Improvement Plan. Councilor Battreall moved the resolution into business. Councilor Garter seconded. Councilor Garter stated that this resolution was discussed at the Parks and Recreation Committee meeting today. The committee recommended this resolution for approval. Resolution CC-04-17-00-02 was approved 6-0. Councilor Snyder was not present for the vote. OTHER BUSINESS: There was none. ADJOURNMENT: Councilor Wilson moved to adjourn the meeting, pending the execution of documents. Councilor Battreall seconded. Rushing 14505 Dublin Drive Carmel, Indiana 46033 April 11, 2000 Carmel City Council c/o Diana Cordray, Clerk-Treasurer City of Carmel 1 Civic Square Carmel, Indiana 46032 Rezone Ordinance No. Z-344 146th Street and Keystone Avenue Dear Council Members: I was unable to attend last evening's Council meeting due to an illness, but wanted to offer the input of the Danbury Estates Homeowner's Association on the rezone proposed by Kite Greyhound, LLC at the southeast comer of 146th Street and Keystone Avenue. Our association has met with Mr. Paul Kite and his representatives on two occasions and we have been kept abreast of the progress of the project for the past five months. We are fully supportive of the rezone application and the specific project that has been proposed for the property. We are especially pleased with the screen wall and landscaping that Kite Greyhound, LLC has agreed to build on their east property line. Overall, Mr. Kite and his representatives have been exceedingly cooperative in addressing the wishes of the Association and we welcome the project to the area. Very truly yours, David E.
