CARMEL CITY COUNCIL MEETING MINUTES
MONDAY, AUGUST 21, 2000 - 7:00 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James Brainard, Council Members Keyin Kirby, John Koven, Bob Battreall, Norm Rundle, Luci
Snyder, Ron Carter and Wayne Wilson; Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer
Cattle Groce were also in attendance.
Mayor James Brainard called the meeting to order at 7:00 p.m.
Wayne Wilson pronounced the Invocation.
Mayor James Brainard led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
APPROVAL OF MINUTES:
Councilor Snyder moved to approve the minutes of the August 7, 2000 Regular Meeting. Councilor
Wilson seconded. The minutes were approved 6-0. Councilor Koven abstained as he was absent at such
meeting.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
CLAIMS:
Councilor Snyder moved to approve Claims in the amounts of $99,642.80, $262,713.22 and
$2,297,311.08. Councilor Kirby seconded. The clamas were approved 7-0.
COMMITTEE REPORTS:
Councilor Koven had no report for the Administraf~on Committee.
Councilor Snyder reported that fi~e Annexation and Land Use Committee met on August 10, 2000, at
which time they discussed the amtcxation of Woodland Country Club (Ordinance No. C-203) and the
introduction of the f~scal plan. The Committee provided a favorable recommendation to Council with a
vote of 2-0 regarding Annexation Ordinance No. C203. The Committee also discussed the annexation
of Carreel Oaks on Guilford (Ordinance No. C-204) for which they provided a favorable
recommendation to Council as well ~vith a vote of 2-0. The annexation of a small section of the pub|ic
right-of-way on 1-465 (Ordinance No. C-205) was also discussed by the Committee. Amendments will
be made by the City Attorney prior' to return of the Ordinance to Council for approval
Councilor Wilson had no report on the Economic Development Committee at this time.
Council President Rundle stated that the Finance Committee had not met; however, a meeting of the
Committee is scheduled for Friday, August 25, 2000.
Councilor Carter stated that the Parks and Recreation Committee had no report at this time.
Councilor Battreall reported that the Public Safety Committee met on August 2l, 2000. The Committee
received reports from most department heads including the status of the new fire engine designed to
accommodate housing in Village of Clay West; new Fire Department recruits; and, the five new Police
Department recruits who will complete their training and become full members of the force in
September. There was a record number of runs reported during the recent two-week storm and Jim
Kindcr with the Communications Department informed the Committee that a public meeting will be
held on September 13th at 5:00 p.m. in order to determine whether or not to combine the 911 systems to
provide county-wide coverage under one supervision. Also discussed was the Fire and Police Chiefs
consideration of a wiring and communications set-up in the new fire stations in order to accommodate a
police sub-station. This will enable the Fire and Police Departments to communicate throughout the
entire Township area.
Council President Rundie stated that the Rules Committee has not met since its last report. The
Committee is scheduled to meet on Friday, August 25, 2000.
Councilor Kirby reported that the Utilities and Transportation Committee met and discussed the Cable
TV Ordinance. He wished to elaborate further when the Ordinance appears on the agenda later.
OLD BUSINESS
Council President Rundie announced Ordinance No. D-1465-00; An Ordinance of the Common Council
of the City of Cannel, Indiana, Adopting an Ordinance Concerning Cable Television, to be Codified as
Carreel City Code Chapter 4, Division IV, Article 2, Section 4-68. Councilor Kirby presented this
matter to Council members and explained the proposed amendments to the Ordinance. There was
Council discussion concerning the Ordinance and proposed amendments. Council President Rundle
inquired of parliamentarian Kirby as to the necessity of a motion to approve the amendments. Councilor
Kirby responded with a motion to approve the proposed amendments to Ordinance NO. D-1465-00.
Councilor Battreall seconded. The amendments to Ordinance No. D-1465-00 were approved 7-0. There
was no further discussion by Council. Ordinance No. D-1465-00 was approved, as amended, 7-0. At
this time, Councilor Kirby asked Bob Smith, Chairman of the Cable TV Advisory Committee, to
provide an update on the companion Ordinance to Ordinance No. D-1465-00. There were questions
from the Council to which Mr. Smith responded.
Council President Rundie announced Ordinance No. D-1473-00; An Ordinance of the Common Council
of the City of Carmel, Indiana, Amending Chapter 9, Article 2, Division IV, Section 9-59(a) and
Chapter 9, Article 3, Division V, Section 9-147Co) of the Cannel City Code. There was no Council
discussion. Ordinance No. D-1373-00 was approved 7-0.
Council President Rundle announced Ordinance No. Z-350; An Ordinance Amending Zoning Ordinance
No. Z-160, As Amended. James Nelson of Nelson & Frankenberger presented this matter to Council.
There was no Council discussion. Ordinance No. Z-350 was approved 7-0
PUBLIC HEARING:
Council President Rundie announced Ordinance No. D-1471-00; An Ordinance of the Common Council
of the City of Cannel, Indiana, Providing for an Additional Appropriation of the Funds from the General
Fund Operating Balance. Councilor Kirby moved to introduce this item into business and waive the
reading of such. Councilor Snyder seconded. Deputy Chief Tim Green presented this matter to
Council. The Public Hearing was opened at 7:27 p.m. Seeing no one who wished to speak, the Public
Hearing was closed at 7:28 p.m. There was Council Discussion. Councilor Kirby moved for the
suspension of the rules and recommended that Ordinance No. D-1471~00 be acted upon as of this
evening and moved for approval of such. Councilor Battreall seconded. The suspension of the rules
was approved by a unanimous vote of 7-0. Ordinance No. D-1471-00 was approved 7-0.
Council President Rundie announced Ordinance No. D-1474-00; An Ordinance for the City of Cannel
2001 Budget in the amount of $41,669,775. Council President Rundie advised that due to a publication
error, this Ordinance will not be presented but will be introduced at the next meeting of Council on
Wednesday, September 6, 2000.
NEW BUSINESS:
OTHER BUSINESS:
Council President Rundie and D;ana Cordray recommended the scheduling of a Special Meeting of
Council in order to further discuss budget items. There was Council discussion. A Special Meeting of
Council was agreed to commence on Wednesday, August 30, 2000, at 6:00 p.m.
ANNOUNCEMENTS:
Councilor Kirby commended the Annexation and Land Use Committee regarding its submission of an
explanation of the new annexation iaws to each of the Council members. Councilor Kirby expressed his
comments concerning the effects of annexation as to Clay West and other matters.
Councilor Wilson discussed his concerns regarding the 1s~ Avenue N.W. parking situation. He
recommended the possibility of extending the boundaries of the 3-hour parking limits. There was
Council discussion.

ADJOURNMENT:
Council President Rundie turned the meeting over to Mayor Brainard for adjournment. Mayor Brainard
moved to adjourn, pending the execution ofdocumeuts. The meeting was adjourned at 7:41 p.m.
