The Carmel Board of Public Works will meet in executive session on Thursday, July 30,
1998, at 8:30 a.m. in the Mayor's Conference Room, City Hall, One Civic Square.
The purpose of the Executive Session is to discuss a personnel matter pursuant to I.C. 5-14-1.5-
6.1(b)(5).

There is a Special Meeting of the Carmel Board of Public Works scheduled for Thursday, July
30, 1998, at 9:30 a.m. in the Council Chambers, City Hall, One Civic Square.
The purpose of this Special Meeting is to take action on personnel matters discussed during the
preceding executive session.

Special Meeting
THURSDAY, JULY 30, 1998 -- 9:30 A.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT: Mayor James Brainard; Board Members Mary Ann Burke and Billy
Walker. Deputy Clerk Rebecca Martin also attended.
Mayor Brainard called the meeting to order at 9:39 a.m.
Fire Chief Douglas Callahan explained that Firefighter John Mummert called him this past
Saturday morning (July 25) to tell the chief he had been arrested for driving while intoxicated.
Chief Callahan stated Assistant Chief Terry Fleming looked into the situation and confirmed that
Mr. Mummert had been arrested. The chief stated he met with Mr. Mummert Tuesday morning
(July 28) and placed him on administrative leave with pay pending today's hearing.
Chief Callahan recommended the board place Mr. Mummert on administrative leave without pay
pending the disposition of criminal charges currently against him. The chief also recommended
that if the criminal charges are delayed more than 30 days due to no fault of Mr. Mummert, the
board reconsider keeping him on administrative leave without pay. City Attorney Douglas C.
Haney clarified the chief's statement.
Mayor Brainard stated the board's policy was to put those who are accused of crimes on
administrative leave without pay pending resolution of the charges. The mayor encouraged Mr.
Mummert to enroll in a good treatment program for drug and alcohol abuse, and stated the City's
Human Resources Department could help. The mayor explained that he would consider Mr.
Mummert's participation in such programs very carefully when the board meets to vote on the
issue later. Board Member Walker asked if Mr. Mummert drove any vehicles on the job. Chief
Callahan stated he did. Board Member Walker asked where Mr. Mummert was arrested. Chief
Callahan stated Mr. Mtmnnert was pulled over in Fishers, registering. 12 at his vehicle and .14 at
the Fishers Police Station.
Bruce Boje, an attomey with Richards, Boje, Picketing, Benner and Becker, stated he was Mr.
Mummert's counsel. He explained that three months could pass before the court would set a trial
date for Mr. Mummert. Mayor Brainard asked Mr. Boje if he represented the City on another
case. Mr. Boje stated he represented the City of Carmel as local counsel on the annexation matter
involving Clay West (Carl S. Mills. Suzanne H. Mills. et al v. Common Council of the City of
Carmel, !~tti~na. The City of Carmel. Indiana and James Brainard), and that he had not
withdrawn his appearance oh that case. Mayor Brainard stated this issue needed to be resolved.
Mr. Boje stated that if the Mayor were correct, he would withdraw his appearance in the
annexation matter. He stated that he had made his involvement in the annexation matter known
to Mr. Mummert. Councilor Walker asked what time Mr. Mummert was pulled over. Mr. Boje
stated he was pulled over by himself at 3:30 a.m.
Mayor Brainard explained the City had high standards for its public safety officials, and even
though this was an unpleasant task, the City was responsible to the public. He stated the board's
policy was to suspend without pay public safety officials who have been charged with a crime.
The mayor encouraged Mr. Mummert to complete the process as quickly as possible.
Board Member Walker moved to suspend Mr. Mummert for 30 days, at the end of which time
the board would review the situation if the case is still in court. Board Member Burke seconded.
Mr. Haney, the city attorney, confirmed that the intent of the motion and the second were to
place Firefighter Mummert on administrative leave without pay, pending the resolution of his
criminal charges, and that the board was reserving the right to reconsider the 'without pay' aspect
of its decision after thirty (30) days, in the event Mr. Mummert's criminal case is not resolved by
that time. Board Members Walker and Burke stated Mr. Haney was correct. The motion, as
clarified by Mr. Haney, was approved 3-0.
Board Member Walker moved to adjourn the meeting. Board Member Burke seconded. The
meeting was adjourned at 3-0 at I0 a.m.
