THURSDAY, JULY 30, 1998 - 4 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT: Mayor james Brainard; Council President Robert Battreall, Councilors
Kevin Kirby, Norm Rundle, Luci Snyder, Run Carter and Billy Walker. Clerk-Treasurer Diana
Cordray and Deputy Clerk Rebecca Martin also attended. Councilor Jim Miller was absent.
Mayor Brainard called the meeting to order at 4:09 p.m.
Councilor Rundle moved to introduce Ordinance D-1379-98. an ordinance fixing salaries of
appointed officers and employees of the City of Carmel for 1999. Councilor Battreall seconded.
Clerk-Treasurer Cordray spoke regarding several last-minute changes made to the ordinance. She
stated that shift differentialpay in Section 13 should be changed to 24-hourfire schedule pay.
Councilors discussed the change. Councilor Battreall explained the wording had been changed
because payment had nothing to do with shifts--it was a 24-hour differential pay. Councilor Battreall
moved to have shift differentialpay deleted from Section 13. Councilor Carter verified that the
motion was to remove shift differentialpay throughout the ordinance and replace it with 24-hourfire
schedule pay. Councilor Carter seconded. Councilor Battreall clarified his motion at the request of
Clerk-Treasurer Cordray. He stated the motion was to replace shift differentialpay with 24-hourfire
schedule pay in any place in the ordinance pertaining to the fire department. Councilor Rundle stated
he had read a letter t~om the fire chief using the terminology shift differentialpay and was concerned
that changing these words would make the ordinance non-comphant with the FLSA. Councilor
Battreall explained that the words shift differentialpay were the fire chief's words, not those of the
labor representative. Discussion ensued regarding Section 18(b). Councilors agreed this section
referred to other departments besides fire department and therefore was not affected by the
amendment. The council voted 5-0 to amend the ordinance as moved. Councilor Snyder was not yet
present.
Councilor Carter asked Human Resources Director Barbara Lamb to clarify the differences in pay
rates among Administrative Assistant I, II and III. Ms. Lamb explained all these employees were
Grade 8's, but because the salaries of some incumbents already were higher than a Grade 8, Step 6,
which is the maximum recommended pay for a Grade 8 (and since no one received decreases), the
pay rates varied.
Councilor Rundle asked the clerk-treasurer to explain any other changes. Clerk-Treasurer Cordray
stated the fire chief had added the position of mechanic to the specialty pay section earlier in the
week. Fire Chief Douglas Callahan explained that the money already was available, but he had failed
to designated the position until earlier this week. He also explained why he needed the position.
Councilors discussed what changes had been made in the past 24 hours. Clerk-Treasurer Cordray
stated that the probationaryfirefighters and probationary police officers had been added earlier this
week.
Councilor Rundle asked why the ordinance stated that for the purpose of insuring the consistency of
retirees' pension benefits, first class firefighters and police officers will receive an identical salary.
Ms. Lamb stated that currently first class firefighters were being paid slightly above the final step
(Step 6) of their grade. In order to ensure that those hired into the proper grade and step system will
receive equal pension benefits, all firefighters will receive pensions based on the current salary
slightly above Step 6. Councilor Rundle and Ms. Lamb discussed the issue further.
Councilor Rundle stated that because state law required the council to pass the salary ordinance by
August 2, he would move to suspend the rules and vote on the ordinance at this meeting. Councilor
Snyder seconded. The council voted 6-0 to suspend the rules and vote on the ordinance. Councilors
discussed why the ordinance needed to be passed at this meeting. The council voted 6-0 to approve
Councilor Rundle moved to introduce Ordinance D-1380-98, an ordinance fixing salaries of
appointed officers and employees of the Carmel Clerk-Treasurer's Office for 1999. Councilor
Snyder seconded. Councilor Battreall asked for an explanation of the pay increase for the Systems
Admirdstrator position. Ms. Lamb stated she had received some incorrect information from Payroll
about the current salary of the position. Ms. Lamb stated that for the Systems Administrator position
to be equal with other positions ranked the same within the City, it should be a Grade 9, Step 5, but
that she was recommending the position be paid at a Grade 9, Step 6 level. Councilor Snyder verified
with Ms. Lamb that no employees in the Clerk-Treasurer's Office appealed their ranking.
Clerk-Treasurer Cordray explained that she was reorganizing the Clerk-Treasurer's Office and that
the Systems Administrator position was going to have much more responsibility, including
supervisory power. She also stated that this position involved much technical skill and should be
reviewed for classification as a technical position. Ms. Lamb stated that the company contracted to
evaluate city positions did not include sofavare expertise as qualification for a technical
classification. Councilors, Ms. Lamb and Clerk-Treasurer Cordray discussed the clerk-treasurer's
office situation and reorganization. Councilor Battreall stated that if the position was going to
include more responsibility then it needed to be reclassified. Clerk-Treasurer Cordray explained that
this opportunity to reorganize just came fonvard. She stated one employee was leaving for a
maternity and the woman who was to fill this position was being hired at less money in accordance
with the grade and step system. Councilor Kirby recommended the clerk-treasurer immediately file
to reclassify the position. Clerk-Treasurer Cordray and Ms. Lamb discussed the requirements of
classifying a job as a technical position.
Councilor Snyder recommended approving the position as a Grade 9, Step 6 until the consultants
could review the job reclassification request the council was asking the clerk-treasurer to submit.
Councilor Snyder asked Ms. Lamb to make sure the request was processed promptly so the clerk-
treasurer's staff would not be overburdened. Councilor Carter stated the City had spent $50,000 on a
consultant so the council would not have to deal with this type of problem. He asked the clerk-
treasurer to comply with the City on this issue. Councilor Kirby stated he believed the clerk-treasurer
was reacting to a legitimate situation in her office. Councilor Rundle stated the clerk-treasurer
needed to have the Systems Administrator position reclassified if the responsibilities were going to
change. Ms. Lamb committed to working with the clerk-treasurer to amend the situation as soon as
possible. Councilor Rundle moved to change the maximum salary for the systems administrator to
$1,238.04. Councilor Snyder seconded. The amendment was approved 6-0. Councilor Walker moved
to suspend the rules and waive the second reading of Ordinance D-1380-98 and Ordinance D-1381-
98. Councilor Kirby seconded. Ordinance D-1380~98. as amended, was approved 6-0.
Councilor Walker moved to introduce Ordinance D-1381-98. an ordinance fixing salaries of
appointed officers and employees of the Carmel Ci_ty Court for 1999. Councilor Carter seconded.
Ordinance D-1381-98 was approved 6-0.
Mayor Brainard called for a two-minute recess at 5:25 p.m. to sign the ordinances.
Curtis Coonrod, the mayor's financial advisor~distributed financial reports to each councilor. The
mayor, Mr. Cooarod and councilors discussed the figures in the report for about 30 minutes.
Councilor Kirby moved to adjourn the meeting. Councilor Walker seconded. The meeting was
adjourned 6-0 at 6:01 p.m.
