MONDAY, MARCH 2, 1998 --7 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT: Mayor Brainard; Councilors Kevin Kirby, Jim Miller, Robert
Battreall, Norm Rundle, Luci Snyder and Billy Walker. Clerk-Treasurer Diana Cordray and
Deputy Clerk Rebecca Wolf also attended. Councilor Ron Carter was absent.
Mayor Brainard called the meeting to order at 7:02 p.m. Councilor Miller gave the invocation.
Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF OUTSTANDING CITIZENS/CITY EMPLOYEES: Mayor Brainard
called forward Robert Bill from Janus Developmental Services, Inc., and proclaimed March
National Disabilities Awareness Month.
APPROVAL OF MINUTES: Councilor Rundle moved to approve the minutes from the
February 23, 1998, regular meeting. Councilor Miller seconded. The minutes were approved 4-0.
Councilors Walker and Snyder abstained.
RECOGNITION OF CITIZENS WHO WISH TO ADDRESS THE COUNCIL: No one
wished to address to council.
CLAIMS: Councilor Snyder moved to approve General Claims for $21,524.30. Councilor
Walker seconded. Claims were approved 6-0.
OLD BUSINESS: Mayor Brainard announced Ordinance D-1359-98. an amendment to Section
8-120 of the Carmel City Code (changing a yield sign to a stop si_ma on Eastbound Waterstone
Way at Windpointe Pass). Councilor Rundle stated he had spoken with the engineering and street
departments asking them to conduct a study to determine whether the intersection met state
requirements for a stop sign. Councilor Rundle explained he had received a letter earlier today
from the engineering department stating a stop sign was warranted at the intersection. He stated
he had received 139 letters from homeowners in favor of the stop sign and had received no
negative comments on the proposal. Councilor Kirby commended the engineering office for
completing the study quickly. Ordinance D-1359-98 was approved 6-0.
There were no items listed on the agenda.
NEW BUSINESS: John Sullivan, Best Limo Service, Inc., stated he was requesting approval of
a Limousine License Renewal from the council. Councilor Walker moved to approve the request.
Councilor Snyder seconded. Councilor Rundle verified with the clerk-treasurer that the council
had received all required information. The request was approved 6-0.
OTHER: Mayor Brainard announced the agenda item, Cancellation of All Warrants that are
O~ltstanding/Unpaid for a Two-Year Period. Clerk-Treasurer Cordray explained the checks being
canceled were previously drawn on Metro Bank. She explained that this was an item that needed
recorded in the minutes. Councilor Snyder stated she was surprised at the amounts of some of the
uncashed checks. Clerk-Treasurer Cordray stated the checks requested to be canceled had all
been issued twice by her office in an attempt to get them cashed. Councilor Battreall moved to
approve the item. Councilor Snyder seconded. Mayor Brainard verified the council had a list of
each check to be canceled. The item was approved 6-0.
Councilor Rundle moved to re-appoint Charles Weinkauf, the Common Council Appointment to
the Board of Zoning Appeals. Councilor Snyder seconded. Councilor Rundle commended Mr.
Weinkauf on his work as a member of the BZA. Mayor Brainard agreed with Councilor Rundle.
Charles Weinkaufwas re-appointed to the BZA for one year 6-0.
ANNOUNCEMENTS: Councilor B attreall handed copies of the monthly report prepared by the
Clerk-Treasurer's Office to council members and commended the clerk-treasurer on the report.
He asked councilors to review the information and stated the clerk-treasurer had stated her office
would be able to have the report prepared by the 15th of each following month. Councilor Kirby
asked if future reports would include information about all city funds in addition to the General
Fund. Clerk-Treasurer Cordray stated future reports would include all funds, but that her staff
used only the General Fund on this report because it was the first time they had used the new
software to present this type of information. Councilor Kirby stated the council needed to see the
four major funds monthly, but only needed to see breakdowns from the other funds quarterly.
Councilor Battreall stated councilors had received a letter from Councilor Snyder recommending
an attorney to research the council's authority regarding the bond issue for the City Center
Project. He suggested the council meet at 8 a.m. on March 21, 1998, to discuss the item.
Councilors, the mayor and clerk-treasurer discussed the merits of moving the April 6, 1998,
meeting to April 13, 1998, because the schools' spring break was during the week of April 6. The
council agreed to leave the meeting on its scheduled date.
Councilor Kirby moved to engage the law firm of McHale Cook & Welch to review the bond
issue for the City Center Project, as recommended in Councilor Snyder's letter. Councilor
Battreall seconded. The council approved the hiring of McHale Cook & Welch 6-0.
Councilors announced meeting dates of various local boards.
Councilor Rundle moved to adjourn the meeting after signing documents. Councilor Kirby
seconded. This motion was made at 7:30 p.m.

CANCELLATION OF WARRANTS - O{.D OUTSTANDING CHECKS
Pursuant to lC 5-11-10.5, all checks c~,b, tanding and unpaid for a period of two years as cf
December 31 of each year shall be declared cancelled.
Not later than March 1 of each year: t~e t3'easurer shall prepare or cause to be prepared a list in
duplicate cf. ail checks outstanding for two or more years as of December 31 last preceding. The crigin~
copy shall be filed with the board of finance of the dry or town and the duplicate copy maintained by the
disbuming officer cf the city or town. [Since Public Law 10, Acts of 1997, eliminated the Board of Finance in
a ~ or town, we recommend such copy by filed with the city or town coundl.] The treasurer shall enter
the amounts so listed as a receipt to the fund or funds upon which they were originally drawn and remove
the checks from the list of o,,L=t~nding checks, if the fund from which the check was originally drawn is not
fn ex~ence or cannot be asce~teined, the amount of the out=l'-,~ding check shall be receipted into the
general fund of the political subdivision.
The statute provides for ~e issuance of another check to replace a cancelled check if a claim is
properly filed by the vendor or the per~3n to whom the check was issued within seven years after the date
cf issuance of the cdginai check. This check must be drawn upon the fund tn which the cancel[ed check
was receipted. Any check out.=b~nding for more than seven years shall be considered void, and no recovery
shall be made.
