TUESDAY, DECEMBER 10, 1996 -- 4:30 P.M.

Me~oers present: Mayor Brainard; Councilors Kirby, Miller,
Battreall, Rundle, Snyder, Carter and Walker. Clerk-Treasurer
Cordray and Chief Deputy Wolf also attended.
Mayor Brainard called the meeting to order at 4:34 p.m.
OLD BUSINESS: Mayor Brainard introduced Ordinance D-1261-96/An
Ordinance Amending Chapter 2, Article 3, Division II of the City
Code Regarding Longevity. Councilor Battreall moved to amend the
paragraph written under item III in the ordinance to read as
follows: ~Should an employee have an interruption in employment
of ninety (90) or fewer calendar days, the employee shall be
entitled to full credit for service prior to the interruption.
After an interruption of more than ninety (90) calendar days, a
returning employee shall be treated as a new employee for
purposes of calculating vacation time earned and shall not
receive credit for prior service." Councilor Miller seconded.
HUman Resources Director Barb Lamb explained the purpose of the
amendment was to remove the word "continuous." All councilors
voted AYE. The amendment was approved 5-0. Councilors Kirby and
Snyder were not yet present. All councilors voted AYE to approve
the amended ordinance. The amended ordinance was approved 5-0.
Mayor Brainard introduced Resolution CC-12-02-96-03/A Resolution
Excepting Certain Employees from Ordinance D-1261-96. Bonnie
Callahan, a Street Department employee, stated the resolution
should apply to all employees--including those with interruptions
in service of more than a year--instead of just seven employees.
She stated she didn't think it was fair to exclude a handful of
employees because the one year break point was arbitrarily
chosen.
Councilor Kirby arrived.
Ms. Lamb stated the one year cut off point was chosen because of
precedent set by the last council. Councilor Rundle and Ms. Lamb
discussed the ordinance to clarify the wording. Councilor Miller
moved to include all employees in the resolution whose
circUmstances were not remedied by ordinance D-1261-96, including
those with interruptions of service of more than one year.
Councilor Carter seconded. Ms. Lamb stated the payroll records
were not very clear from the mid 1980's and earlier, so she was
not comfortable giving an exact figure of how many employees
would be affected by the amended resolution until she had done
more research.
Councilor Snyder and Clerk-Treasurer Cordray arrived at the
meeting.
Mayor Brainard called for a vote on the amendment. Six members
voted AYE. Councilor Snyder abstained. The amendment was approved
6-0. Mayor Brainard then called for a vote on the resolution. All
members voted AYE. The amended resolution was approved 7-0.
Mayor Brainard introduced Ordinance D-1262-96/An Ordinance
Regarding Overtime Compensation. The mayor stated it had been
amended during the first reading at the previous council meeting,
and that it should have been listed as so on the agenda.
Employees speaking regarding the ordinance were:
Eric Ehlers, liaison to the administration for the Fire
Department, opposed
John DufEy, Utilities Manager, opposed
Tim Green, Asst. Chief of Police, opposed
John Etter, Major for the Police Department, opposed
Councilor Snyder stated that in 1993 a similar ordinance came up
for discussion, but the council decided it wasn't fair to change
the overtime policy. Ms. Lamb stated the issue of sick time abuse
should be researched regardless of whether the council chose to
pass the ordinance. She stated several department heads had come
to her because some employees had been abusing the sick time
policy. Councilor Carter called for the question. No members
voted AYE. The resolution was defeated 0-7.
Mayor Brainard introduced Ordinance D-1263-96/An Ordinance
Approving a Transition Plan for Civilian Employees of the Carmel
Police and Fire Departments. No one from the public wished to
speak. Ms. Lamb stated the changes affected only benefits. All
members voted AYE. The ordinance was approved 7-0.
The meeting was adjourned at 5:39 p.m.
