Tenant will not erect any signs except in conformity with the following policy:
A. NEW STOREFRONT SIGN REQUIREMENTS
1. All signs shall be internally -illuminated, LED signs, mounted on a raceway.
2. The sign may be a sign cabinet, consist of individual channel letters, or a
combination of the two. No blanket restriction on face, trim, or return color, but
Landlord shall retain the right to reject a sign for design, color, or any other reason.
3. The raceway shall be painted the color of the building.
4. The size of the signs shall be no greater than what is permitted by the City of
Carmel Unified Development Ordinance (UDO), which is currently 85 %width of
Tenant's spandrel panel(s) with a 100/ leeway for architectural elements, and 70%
height of Tenant's spandrel panel(s). The spandrel panels per suite are illustrated
by the attached Exhibit "A"- Sign Fascia Elevations / Spandrel Panels. Tenants
shall be entitled to use the spandrel panels for all suites they occupy.
5. For those Tenants who occupy spaces with both Main sign panels and Side sign
Panels (as illustrated in Exhibit "A"- Sign Fascia Elevations / Spandrel Panels),
the copy of the Side sign panel(s) must not be an exact duplicate of that of the Main
sign panel(s). However, the sign panels may share common copy / elements.
B. CURRENT TENANTS WITH EXISTING STOREFRONT SIGNS
If you are a current Tenant with an existing storefront sign, you may: 1) keep your
storefront sign as is, 2) maintain and repair it as needed, and 3) continue to comply
with the Tenant Sign Criteria which was in place when you installed your sign.
2. If you are a current Tenant, and you wish to change your storefront sign, you must
comply with this sign criteria.
3. If you choose to change your storefront sign, the existing fixtures located above
your spandrel panel(s) will be removed, as the power to be provided to your new
sign will be provided by the power currently supplying the existing fixtures.
C. MONUMENT SIGN- TENANT PANELS
There is an illuminated monument sign on Camtel Drive. Tenant may be permitted
to install matching panels for the monument sign. Tenant shall include the
elevation for its Tenant panels with its sign permit application. The cost of the
Tenant panels fabrication and installation shall be home by Tenant.
A monthly sign fee of $75.00 monthly will be added to Tenant's monthly invoice
for the duration Tenant occupies a space on the panel.
3. The approval of a Tenant to have a panel on the monument sign, as well as the
location of said Tenant panel, shall be in Landlord's sole discretion.
D. OTHER SIGNS PERMITTED
Window Sims- All window signs are subject to review and written approval by
Landlord, which shall not be unreasonably withheld. Tenant must comply with
the standards as permitted by the UDO with respect to window signs.
2. New Tenant Banners- Tenant shall be permitted to install an attractive vinyl banner
announcing the new location of Tenant's business and place the banner at the location
of Tenants proposed storefront sign. The banner may be used for a period not to
exceed the time permitted by the UDO. Tenant shall be responsible for repairing
and painting the sign fascia if damaged as part of the installation. The new Tenant
banner shall not be permitted to be installed unless and until Landlord has approved
Tenant's sign permit application for its permanent sign(s), and such application is
filed with the City of Carmel.
D. TENANT RESPONSIBILITY FOR SIGN
1. Tenant shall submit drawings in digital format (.pdf) and a completed sign permit
application to Landlord for written approval before submittal to the City of Carmel.
The drawings will include an elevation with a view of height of storefront showing
dimensions of height and letters and length of sign, as well as cut sheets showing
the type of sign, and the monument sign panel, if applicable.
2. Upon receiving its permit, Tenant shall provide a digital copy (.pdf) of the
approved permit to Landlord. If this is the first internally -illuminated sign at the
location, Landlord will arrange to have its electrician remove the light fixtures
located above Tenant's spandrel panel(s), and provide a power connection for
Tenant's sign.
3. Tenant shall lawfully erect signs at its risk and expense, and must present its
vendor's certificate of insurance, naming Landlord as additional insured, before
installation.
4. It is the Tenant's responsibility to maintain its signs in good repair a all times.
Landlord has no duty of care to Tenant or other Tenants as it relates to the
installation or maintenance of the sign, without exception.
5. Upon vacating, Tenant shall hire Landlord's approved sign contractor or
electrician to safely remove said signs. Tenant shall be responsible for repairing
any damage caused by such removal, including the resurfacing of the sign fascia,
and Landlord may use the security deposit to pay for this removal or resurfacing.
6. The above provisions notwithstanding, Tenant is responsible for conforming
to all local codes and ordinances, including the application of sign permits.
Landlord shall not be liable for any code violation. Tenant shall promptly
take corrective action to comply with all local authorities. If Landlord incurs
a cost due to Tenant's non-compliance with local codes, Tenant shall promptly
reimburse Landlord for said costs.
