MEMBERS PRESENT: Mayor Brainard; Councilors Kirby, Miller,
Battreall, Rundle, Snyder, Carter and Walker. Clerk-Treasurer
Cordray and Chief Deputy Wolf also attended.
Mayor Brainard called the meeting to order at 7:03 p.m. Councilor
Miller gave the invocation. Mayor Brainard led the pledge of
allegiance.
APPROVAL OF MINUTES: Councilor Rundle moved to approve the
minutes as listed on the agenda (Item 4a). Councilor Battreall
seconded. All members voted AYE. The minutes were approved.
RECOGNITION OF CITIZENS WHO WISH TO ADDRESS TRE COUNCIL:
Councilor Kirby read a letter given to him by a constituent, Dick
Frost, 507 Stonehenge Drive, raising questions about the number
of times the city can enter into a contract. Councilor Kirby
stated he wanted the letter to be delivered to the city attorney.
CLAIM: Councilor Snyder moved to approve the claims as listed on
the agenda (Items 7a, 7b, 7c and 7d). Councilor Walker seconded.
All members voted AYE. The claims were approved.
COb~4ITTEE REPORTS: Councilor Snyder reminded everyone to vote and
to be aware of the referendum questions on the ballot.
OLD BUSINESS: Jim Nelson introduced Ordinance C-185, a request to
annex real estate near 131st Street and River Road. All members
voted AYE. The annexation was approved.
Mayor Brainard introduced Ordinance C-187/Annexation of Carey
Grove Park. He explained the park was owned jointly by the city
and Clay Township. Councilor Carter called for the question. All
members voted AYE. The annexation was approved.
Mayor Brainard introduced Ordinance D-1249-96/An Ordinance to
Establish an Impact Fee for the Purpose of Planning and Financing
Park and Recreational Infrastructure. Councilor Snyder explained
she would abstain because, as a member of the Plan Commission,
she had some questions that have not been answered. Councilor
Rundle stated he was concerned about the small amount of money
the city was allowed to collect through the fee. Councilor Carter
stated the impact fee was better for the city than extractions
because the impact fee is more uniform and can be recalculated
every year. Councilor Kirby stated he approved of the fee because
the money for parks wouldn't be collected out of property taxes.
Councilor Walker called for the question. Six members voted AYE.
Councilor Snyder abstained. Ordinance D-1249-96 was approved 6-0.
Mayor Brainard introduced Ordinance D-1250-96/An Ordinance
Enacting and Adopting a Supplement to the City Code. All members
vote AYE. The ordinance was approved.
Mayor Brainard introduced Resolution CC-10-21-96-01/A Resolution
Approving an Agreement Between Carmel and IWC. The mayor opened
the floor for public comment.
Roger Conn, 700 block of E. Main Street, stated the law should be
researched more thoroughly to ensure the safety of natural
resources. He also stated he was against the sale of water to
IWC.
No one else from the public wished to speak.
Councilor Miller stated that allowing IWC to use Carmel's water
was better than IWC using water from the White River. He added
that the actual depletion rate of Carmel's water would be
minimal, even with IWC sharing it. Councilor Kirby stated he
supported the sale because it would help protect Carmel's water
supply. Councilor Snyder motioned to change the wording of the
contract so that if Carmel wanted to increase the flow of water
to IWC beyond four million gallons, the utility would have to
seek approval from city council, not the board of public works.
Councilor Miller seconded. Councilor Battreall stated he was
concerned that there was no cost escalation built into the
contract. Councilor Carter called for the question. Council
members voted 7-0 in favor of changing the wording of the
contract. The amendment was approved. John Skomp of Crowe Chizek,
the Utility's accounting firm, explained depreciation was figured
into the cost. Utilities Manager Duffy stated that the profit of
the water sale will help run Carmel's growing utility. Councilor
Carter stated the city could sell water to IWC without
jeopardizing the water and still maintain the protection of the
aquifer. Six council members voted AYE. Councilor Battreall voted
no. Resolution CC-10-21-96-01 was approved 6-1.
NEW BUSINESS: Mayor Brainard introduced Ordinance D-1253-96/An
Ordinance Establishing an Economic Development Fund and explained
the history of the Economic Development Commission. Councilor
Kirby moved to introduce the ordinance. Councilor Snyder
seconded. The ordinance was carried over to the next meeting.
Mayor Brainard introduced Ordinance D-1256-96/An Ordinance
Amending Chapter 3, Article 1, Division II, Section 3-25 of the
City Code. Councilor Walker moved to introduce the ordinance.
Councilor Carter seconded. The ordinance was carried over to the
next meeting.
Councilor Snyder moved to adjourn the meeting. Councilor Walker
seconded. The meeting was adjourned.
