COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE There is a Special Meeting of the Carmel City Council scheduled for Friday, September 27 at 9:30 a.m. in the Council Chambers, City Hall, One Civic Square. The purpose of this Special Meeting is to make a recommendation regarding the executive session of the City Council held at 9:00 a.m. on September 27, 1996. COUNCIL CPDXN~BERS / CITY H/~LL / ONE CIVIC SQUAPa~ Members present: Councilors Kirby, Miller, Battreall and Rundle. Clerk-Treasurer Cordray and Chief Deputy Wolf also attended. Councilor Miller called the meeting to order at 9:32 a.m. He announced that the council was still in executive session, so the public meeting would be postponed for about 45 minutes. Councilor Kirby moved that the regular meeting be recessed until approximately 10:15 a.m. Councilor Battreall seconded the motion. All members present voted AYE. The meeting was recessed 4-0. Councilor Miller reconvened the special session at 10:54 a.m. Mermbers present: Councilors Kirby, Miller, Battreall, Rundle, Snyder, Carter and Walker. Clerk-Treasurer Cordray and Chief Deputy Wolf also attended. City Attorney Deb Grisham introduced Hamilton County Prosecutor Sonia Leerkamp. Prosecutor Leerkamp stated she was approached by former Mayor Ted Johnson's attorney that there not be a protracted grand jury investigation. She stated she asked Mayor Brainard if she could meet with representatives of the city to obtain their input into filing and disposing the charges. She advised the council that charges have been drafted and were in the process of being filed in Noblesville. She stated she anticipated those charges to be one count of conflict of interest, a class D felony, and one count of official misconduct, a class A misdemeanor. She stated these charges are based on the investigation that was presented to her office from Tim Kaiser of the Indiana State Police and Luckie Carey of the Carmel Police Department. Prosecutor Leerkamp also asked to continue to have input from the council while the charges are pending concerning possible dispositional alternatives. She suggested council members give her direction concerning any input they would like to give as individuals or to appoint representative(s) for her to counsel with as the matter progresses. Councilor Kirby motioned to instruct the city attorney and the Carmel utility manager to work with the prosecutor as she works with Mr. Johnson through the process she described and to keep the council informed. Councilor Battreall seconded. All members voted AYE. The motion was approved. Councilor Miller read a news release and stated the council would make no further statement in addition to the release. Councilor Snyder moved to adjourn the meeting. Councilor Kirby seconded. All members voted AYE. The meeting was adjourned. As the fiscal body of the City, the Council has a duty under the law to review matters of this nature and to represent the citizens of Carreel, as we would on any other matter coming before us. Today is a sad day for our community, it's citizens, aud for Ex-Mayor Johnson and his family. Front my own personal staudpoiut haviog served in prior years with Ted Johnson on the City Council, I thought he was an excellent Council member. He has been a personal friend of mine for inany years. While I and ~ny fellow Council members deplore what the former Mayor has been charged with, he and his fatnily retnain in our prayers. -30-
