COUNCIL CPL~MBERS / CITY HALL / ONE CIVIC SQUAPa Members present: Mayor Brainard and Board Member Watson. Clerk- Treasurer Cordray and Chief Deputy Wolf also attended. Mayor Brainard called the special session to order at 10:31 a.m. The mayor stated Board Member Walker was on vacation, but that the board maintained a quorum. He then read from I.C. 36-8-3-4 about the disciplinary power of safety boards. The mayor stated that, by the law, if a member of the public safety services is subject to criminal charges, the board is required to place the member on administrative leave until the disposition of criminal charges in the trial court. The mayor stated the law gives the board the right to decide if the administrative leave is paid or unpaid. He added that if the board votes for leave without pay, the law also states the board may later award back pay if the member is exonerated in the criminal charge. The mayor stated the board had been informed James P. Foster, a member of the Carmel Fire Department, had been charged with one count of arson, which is a Class C Felony. Mr. Foster stated he was innocent of the charges filed against him and intends to prove that in a court of law. The mayor moved to suspend Mr. Foster in compliance with state law. Board Member Watson seconded. Both members voted AYE. The mayor then asked his motion be corrected in the minutes, changing the word "suspend" to the proper words, "administrative leave." Mr. Foster was placed on administrative leave. Board Member Watson moved that Mr. Foster's leave be without pay. Mayor Brainard seconded. Both members voted AYE. Mr. Foster was placed on administrative leave without pay. The mayor adjourned the meeting at 10:36 a.m. Respectfully submitted, Attest: Approved,
