MONDAY, AUGUST 19, 1996 -- 7 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQU/~RE
Members present: Mayor Brainard; Councilors Kirby, Miller,
Battreall, Rundle, Snyder, Carter and Walker. Clerk-Treasurer
Cordray and Chief Deputy Wolf also attended.
Mayor Brainard called the meeting to order at 7 p.m. Councilor
Miller gave the invocation. The mayor led the pledge of
allegiance.
Recognition of Outstanding Citizens/CityEmployees: Mayor
Brainard recognized Carmel Police Officer Kimberly Pratt and
Dispatcher Benjamin Craig for their efforts in apprehending a
suspect who robbed a bank in Fishers.
Approval of Minutes: Councilor Snyder motioned to approve the
minutes of the July 30, 1996, special meeting and the August 5,
1996, regular meeting. Councilor Walker seconded. All members
voted AYE. The minutes were approved.
Recognition of Citizens Who Wish to Address the Council: Dick
Frost, 507 Stonehenge Drive, asked the council to reduce the
Department of Law budget by $125,000. Frost criticized Clerk-
Treasurer Cordray for not giving him information the preceding
week that included city employees' home addresses. Clerk-
Treasurer Cordray stated she followed recommendations from the
State Board of Accounts and the City Attorney when she gave him
information that did not include employees' home addresses.
Councilor Kirby stated he asked the Indiana Association of Cities
and Towns about the Clerk-Treasurer's procedure and that the
association verified her action was legal and common practice.
Claims: Councilor Snyder motioned to approve the claims as listed
on the agenda, items 7a through 7d. Councilor Walker seconded.
All members voted AYE. The claims were approved.
Old Business: Mayor Brainard read Ordinance D-1227-96, Additional
Appropriation from the General Fund to Line Item 632 for Computer
Equipment. The mayor explained money for training was already set
aside. Councilor Kirby asked if the township was still planning
to reimburse the city for some of the costs since some of the
computer equipment will be used by departments funded by both the
city and the township. Mayor Brainard stated the township still
seemed willing to do this, but that city officials soon would
meet with township officials to discuss the issue. All members
voted AYE. The ordinance was approved.
The mayor explained the budget process and talked about why this
year's proposed budget is more than last year's. He then
introduced the budget, agenda item 9b, by reading all the
ordinances numbers (D-1228-96, D-1229-96, D-1230-96, D-1231-96,
D-1232-96, D-1233-96, D-1234-96, D-1235-96, D-1236-96, D-1237-96,
D-1238-96 and D-1239-96), the fund and amount of each fund. The
city plans to put $700,000 this year into pension funds compared
to $474,241 last year. The mayor stated the city may still need
to make an additional appropriation later this year to bring the
pensions to the proper level. He also stated the city may receive
state funds for the pensions because of a recently passed law.
Councilor Miller stated he was pleased with the increase in funds
put into the park budget. Councilor Kirby explained he was still
uncomfortable with the amount of money budgeted for the
Department of Law. He stated the budget is too much of an
increase even though the legal advice has been helpful. He stated
he added last year's law budgets of Fishers, Noblesville and
Westfield to get a total of $177,836. Carmel's budget this year
for the Department of Law is $262,220. Councilor Kirby motioned
to reduce the Department of Law budget by 15 percent. No one
seconded. The motion failed. Mayor Brainard explained that just
because money is budgeted for a department doesn't mean it will
be spent. Councilor Rundle commended the Police and Fire
Departments, the Park Department, the Department of Law and the
Department of Administration, explaining all of them deserved the
increases in the proposed budget. Councilor Walker called for the
question. Mayor Brainard read the total city budget of
$23,958,493. All members voted AYE. The budget was approved.
Public Hearing: Councilor Kirby moved to introduce Ordinance D-
1240-96, Additional Appropriation of $125,000 from the General
Fund to Line Item 585 for a Special Census. Councilor Battreall
seconded the motion. Mayor Brainard read the ordinance and
explained that having a special census taken would increase the
amount of tax dollars the city receives from the state. The mayor
opened and closed the public hearing at 8:50 p.m. There was no
discussion, so the motion was carried over to the next meeting
for second reading.
New Business: The Mayor stated Agenda Item lla should not have
been placed on the agenda because the ordinance, Ordinance D-
1242-96, was still in rough draft form.
Mayor Brainard stated Resolution CC-08-19-96-02, Amendment to the
2020 Vision Comprehensive Plan, was not really an amendment. The
mayor explained the process of approving the comprehensive plan
which is mandated by state law. The municipality is required
every five years to pass a comprehensive planning document. Once
the document is put together, the plan commission reviews it and
may make changes if it wishes. The commission then sends it to
the city council. The city council has two options: 1) to approve
it as is or 2) to send it back to plan commission with a
recommendation or without a recommendation. Once the commission
receives and reviews the recommendations, it can send the plan
back to council as it originally was, or change it. The council
then can adopt it or change it. The mayor stated that at the last
meeting, this council sent the comprehensive plan back to plan
commission without a formal recommendation passed in the form of
a resolution. The mayor added that several councilors explained
to plan commission members their desires for the comprehensive
plan, but that they decided the council should try to put some of
those ideas in the form of a resolution so the plan commission
would have some written direction. Councilor Battreall moved to
introduce Resolution CC-08-19-96-02. Councilor Carter seconded.
Mayor Brainard read the resolution. Councilor Carter read a
memorandum he wrote to the Department of Community Services
asking the staff to write a formal set of recommendations - based
on concerns specified in his memorandum - for him to distribute
to fellow councilors. These recommendations would be used as a
basis for the formal recommendations the council must provide to
the plan commission. However, due to staff members in DOCS being
on vacation, Councilor Carter stated he had not received the
recommendations from the department. Councilor Snyder asked if it
would be best to wait until council receives formal
recommendations from DOCS to vote on sending any written material
to the plan commission. Councilor Rundle motioned to table the
item. Councilor Snyder seconded. All councilors voted AYE. The
item was tabled until the next meeting.
Mayor Brainard explained Resolution CC-08-19-96-01, a resolution
to set the 1997 General Fund Tax Levy at 3 percent. Councilor
Kirby moved to introduce the resolution. Councilor Walker
seconded. Councilor Rundle asked what would happen if the
assessed valuation comes in higher than expected. He suggested
changing the language of the resolution to state "not to exceed"
1.7288 instead of "equal to." Mayor Brainard explained the State
Tax Commissioners can lower the rate, so the language isn't
completely binding. The mayor added the city will have
established about a $4.5 million to $5 million operating balance.
All councilors voted AYE. The resolution was approved.
Councilor Battreall introduced a motion to spend $1,000 of the
Promotions Fund to help with the Carmel Clay Community Drug Task
Force project. Councilor Miller seconded. Six councilors voted
AYE. Councilor Walker abstained. The expenditure was approved.
Being no further business, the meeting was adjourned.
