COUNCIL CHAb~BERS / CITY HALL / ONE CIVIC SQUARE Meters present: Mayor Brainard; Councilors Kirby, Miller, Battreall, Rundle, Snyder, Carter and Walker. Clerk-Treasurer Cordray, Former Chief Deputy Clerk Vandegriff and Chief Deputy Clerk Wolf also attended. The mayor called the meeting to order at 7:04 p.m. Councilor Miller gave the invocation. The mayor led the pledge of allegiance. Approval of Minutes: Councilor Rundle moved to approve the June 17 minutes. Councilor Snyder seconded. Councilor Rundle moved to approve the June 19 executive session minutes. Councilor Snyder seconded. All members voted AYE. The minutes were approved. Recognition of Citizens: Nyla Johnson, 317 Concord Lane, addressed the council about quadrupling the park budget and asked about the definition of user fees. Johnson also questioned the appropriation of funds to repair the Communication Center's roof and requested the council have legal counsel present at all their meetings. Mayor Brainard explained the city and township settle the expenses covered by the joinder agreements, such as the one involved in funding the repair of the Communication Center, at the end of each year. Councilor Battreall noted legal counsel attended current budget hearings. Mayor Brainard presented Tom Welch, retired city engineer, with a clock for his 16 years of services to the city. Claims: Councilor Snyder moved to approve claims as listed on the agenda. Councilor Walker seconded. All members voted AYE. The claims were approved. There were no committee special reports. Old Business: The mayor explained the proposed changes to the outdoor burning regulations included deleting the word ~residents" and replacing it with "all people." Councilor Walker clarified the rest of the ordinance is unchanged. There was no further discussion. All members voted AYE. Ordinance D-1219-96 was passed unanimously. Public Hearings: The mayor read Ordinance D-1221-96 in its entirety. Councilor Kirby moved to introduce the ordinance. Councilor Walker seconded. Councilor Kirby stated a sentence in the ordinance was incorrect. Councilor Rundle concurred. Clerk- Treasurer Cordray referred to the legal advertisement, stating it had the correct wording. Councilor Rundle wanted the ordinance wording clarified. Cordray explained the project is a Board of Public Works project, not an Engineering department project. The mayor said all fund references in the ordinance should be the General Fund. Councilor Snyder amended her motion to reflect the corrected fund. Councilor Walker likewise amended his second. All voted AYE. The ordinance was introduced. Cordray emphasized the ordinance had been legally advertised, and that ordinances can be corrected by an amendment. The mayor opened the public hearing at 7:24 p.m. Members of the public who addressed the board about Ordinance D-1221-96/(First Avenue N.W. Infrastructure Improvements} included: June M. Hedges, 130 First Ave. N.E., in favor of suspending the rules to vote on Ordinance D-1221-96 tonight; Greg Cooper, 320 First Ave. N.E., in favor of the ordinance; Lance Harting, 641 First Ave. N.W., in favor of the ordinance; The mayor closed the public hearing at 7:29 p.m. Councilor Kirby gave the history of his involvement with the project and an overview of its development stating the work should have been done two years ago. He is meeting with the city engineer to develop a time table for the Olde Towne area. Councilor Kirby said he would vote to suspend the rules and approve the measure tonight. Councilor Carter asked the residents to be patient and wait a little longer. Councilor Snyder remarked she agreed with Mr. Cooper. Councilor Kirby moved to suspend the rules. Councilor Snyder seconded. Councilor Rundle commented about the council's decision at its last meeting to suspend the rules and vote to use $8,900 to repair the roof in the Communications Center. Councilor Rundle said Councilor Walker is correct in his concern about suspending the rules. Councilor Rundle will vote for the project, but not for suspending the rules. Councilor Kirby stated the provision for council to suspend the rules is to help with expediency, and that the project needs to begin as soon as possible to get it finished this year. Councilor Battreall commented since the majority of the council was going to vote for the project anyway, he would vote to suspend the rules. Councilor Rundle said waiting two more weeks to vote was not significant in the long run. Councilor Carter asked Councilor Kirby how long it would take to prepare bids. Councilor Kirby stated bids could be ready in two weeks. Clerk-Treasurer Cordray stated she will ask the State Tax Board to expedite the process. The mayor added the suspension of rules must be unanimous. Councilors voted 5-2. The motion failed. Those voting to suspend the rules were Councilors Kirby, Miller, Battreall, Snyder and Carter. Councilors Walker and Rundle voted against it. Announcements: The mayor commended Carmel Police Officer Kim Pratt for apprehending a Fishers Bank robber on Gray Road. The mayor also acknowledge the Communications Department's effort in the arrest. The mayor reminded the Council that Carmelfest begins the evening of July 3. The amount of fireworks have doubled. Councilor Kirby stated Carmel Main Street Inc. will have a Jukebox Saturday Night July 20 in the parking lot of National City Bank. Councilor Walker moved to adjourn. motion carried.
