Adjournment C3~Da4EL CITY COUNCIL MEETING MINUTES TUESDAY, JULY 30, 1996 -- 8 A.M. COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE Members present: Mayor Brainard; Councilors Kirby, Miller, Battreall, Rundle, Snyder, Carter and Walker. Clerk-Treasurer Cordray and Chief Deputy Wolf also attended. Council President Miller called the meeting to order at 8 a.m. informed the council it was important to suspend the rules and act on the proposed salary ordinances for 1997. He Claims: Councilor Snyder moved to approve the claims, items la through le, as listed on the agenda. Councilor Walker seconded. All members voted AYE. The claims were approved. New Business: Council President Miller introduced the first reading of Ordinance D-1224-96, the 1997 salary ordinance for city employees. Mayor Brainard stated there were two changes including a change in the salary for the new director of the Department of Community Services. The mayor stated the director is not taking benefits worth $4,500 and that during the negotiations the mayor offered a $55,000 salary rather than the current $53,100. The mayor also informed the board that Section 5 of the ordinance allows employees in DOCS to receive $50 whenever they attend a regularly scheduled meeting of the plan commission. The mayor suggested to add the following wording so employees wouldn't get paid $50 for attending meetings that occur during the regular work day: ~if such meeting is held outside regular working hours of 8 a.m. until 5 p.m." Councilor Rundle stated he wanted the wording of Section 5 to declare that employees would receive the $50 compensation for attending meetings only when they were requested to attend them. Mayor Brainard suggested adding the following wording: ~upon request of the department director." Council President Miller asked the council who was in favor of making those changes. All members voted AYE. The changes were approved. (See attached.) Councilor Kirby stated that Ordinance D-1224-96 represented about a 3 percent raise for most city employees with the exception of a Communications Technician, the Director of Human Resources and the Director of the Department of Administration. Mayor Brainard explained the Director of the Department of Administration was not a salaried position but a contractual one and, therefore, was not included in this ordinance. Councilor Rundle expressed concern about why civilian clerk typists received no raise according to the ordinance. Mayor Brainard stated all department heads had received the proposed ordinance and were supposed to change the pay for the typists to reflect the 3 percent pay increase. Mayor Brainard stated the intent of the ordinance was to have an across-the-board 3 percent maximum raise to give the department heads flexibility. The mayor stated that if the ordinance was not typed that way it should be orally amended to reflect that. Councilor Rundle moved that the ordinance include a three percent increase for civilian clerk typists in all departments where that position exists. Councilor Snyder seconded. All members voted AYE. The increase passed. Councilor Rundle expressed concern about pay levels in the communication center, specifically the communication technician and dispatchers. Mayor Brainard stated the math in the ordinance was done incorrectly, and suggested Councilor Rundle should make a motion to allow a 3 percent increase across the board except for the communications technician, the DOCS director and the Human Resources director. Councilor Rundle moved that the salaries of first-class dispatcher, second-class dispatcher and third-class dispatcher in the communications center be amended to only reflect a 3 percent increase over the 1996 salary as established in Ordinance D-1159. Councilor Snyder asked Councilor Rundle why he didn't make a motion that all salaries proposed in the ordinance reflect a 3 percent increase except those heretofore mentioned. Councilor Rundle decided to hold his motion because he had other questions. Councilor Rundle then asked how the awarding of the salaries was determined. Mayor Brainard explained it's at the department head's discretion, and many times the salaries paid are well below the salary cap stated in the ordinance. Councilor Rundle then asked the mayor to confirm that new positions at the fire department were a result of restructuring, questioned the salaries of two clerical positions and asked for clarification about positions in the legal department. Council President Miller asked Councilor Rundle to restate his motion. Councilor Rundle motioned to offer an amendment to Ordinance D- 1224-96 that all salary increases except those of the communications technician, director of Human Resources and the director of DOCS be calculated to reflect the 3 percent increase for the budget year. Councilor Snyder seconded the motion. All members voted AYE. Council President Miller introduced the first reading of Ordinance D-1225-96, the 1997 salary ordinance for the Office of the Clerk-Treasurer. Councilor Carter called for the question. Mayor Brainard reminded the council these ordinances require a public hearing, and that they already had passed the mayor's budget, D-1224-96. He suggested re-opening the floor for public input. Councilor Carter stated he didn't think they had passed the mayor's budget, D-1224-96, because council had not suspended the rules. President Miller opened the public hearing for the mayor's budget D-1224-96 at 8:35 a.m. Alan Potasnik, 572 Melark Drive, asked the board why the Director of Administration is still working via contract and asked the Clerk-Treasurer to check if the city legally can pay training officers and IDACS coordinators as established in Ordinance D- 1224-96. Council President Miller closed the public hearing at 8:40 a.m. Council President Miller stated the council needed to suspend the rules to vote on the ordinance. Councilor Walker motioned to suspend the rules and act on Ordinance D-1224-96, with the stipulation that the council no longer suspends the rules unless it is an emergency. Councilor Kirby seconded the motion. All members voted AYE. Councilor Battreall then moved to approve Ordinance D-1224-96 as amended. Councilor Carter seconded. All members voted AYE. Ordinance D-1224-96 was approved. Council President Miller then opened the public hearing for Ordinance D-1225-96 at 8:44 a.m. No members of the public wished to speak. The public hearing closed at 8:44 a.m. Councilor Carter motioned to suspend the rules to vote on Ordinance D-1225-96. Councilor Walker seconded. All members voted AYE. Council President Miller then asked for all those in favor of passing Ordinance D-1225-96 to signify by saying AYE. All members voted AYE. Ordinance D-1225-96 was approved. Council President Miller opened the first reading of Ordinance D- 1226-96, the 1997 salary ordinance for city court. Judge Bardach presented information to the council. Council President Miller opened the public hearing for Ordinance D-1226-96 at 8:47 a.m. No members of the public wished to speak. The hearing was closed at ATTACHMENT Section 5. That the full-time city employees of the Department of Community Services shall be, upon the request of the department director, entitled to receive the sum of $50.00 per meeting, as additional compensation for attending each regularly scheduled meeting of the Plan Commission/Board of Zoning Appeals, or their respective committees if such meeting is held outside regular working hours of 8 a.m. until 5 p.m. Such additional compensation shall be paid from the budgets of the Plan Commission/Board of Zoning Appeals. 8:47 a.m. Councilor Walker motioned to suspend the rules to vote on Ordinance D-1226-96. Councilor Battreall seconded. All members voted AYE. Councilor Walker moved to approve Ordinance D-1226-96. Councilor Battreall seconded. All members voted AYE. Ordinance D- 1226-96 was approved.
