CARMEL CITY COUNCIL MEETING MINUTES
MONDAY, NOVEMBER 17, 1997 -- 7 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT: Mayor Brainard; Councilors Jim Miller, Robert Battreall, Norm
Rundle, Luci Snyder, Ron Carter and Billy Walker. Clerk-Treasurer Diana Cordray and Deputy
Clerk Rebecca Wolf also attended. Council President Kevin Kirby arrived after the vote on the
elected officials salary ordinance.
Mayor Brainard called the meeting to order at 7:06 p.m. Councilor Miller gave the invocation.
Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF OUTSTANDING CITIZENS: Mayor Brainard presented the first
Volunteer Key of the City award to Coach Bob Kopnisky of Carmel High School. Several
residents spoke about Mr. Kopnisky's achievements. Councilor Snyder talked about Ralph
Wilfong's death on November 5 and his vision for Cannel.
APPROVAL OF MINUTES: Councilor Carter moved to approve the minutes of the November
3, 1997, regular meeting. Councilor Walker seconded. The minutes were approved 6-0.
RECOGNITION OF CITIZENS WHO WISH TO ADDRESS THE COUNCIL: Mayor
Brainard stated this was the public's only chance to address the council about issues not listed as
public hearings on the agenda. He asked speakers to limit their comments to five minutes. No
one from the public wished to speak.
CLAIMS: Councilor Snyder moved to approve the following claims:

Mayor Brainard stated that a claim for Curtis L. Coonrod, CPA included in the General Claims
needed to be reduced by $293 because of an error in a bill submitted by the firm. He stated this
should be changed before council approved the claims. Councilor Snyder amended her motion to
change the $2,196,577.99 for General Claims to $2,196,284.99. Councilor Battreall seconded the
amended motion. Claims were approved 6-0.
~: Mayor Brainard announced Ordinance D-1334-97. salad_ ordinance for
elected o ial f r 1 . Councilor Rundle explained that Judge Gail Bardach had approached
the council at the last meeting and expressed displeasure the council had not included in the
salary ordinance her request for a 5 percent pay increase for herself. He stated the judge told the
council she believed this increase had been approved during the summer budget hearings.
Councilor Rundle stated he had checked his records and the clerk-treasurer had listened to tapes
of the summer budget meetings, and neither found any record of the council discussing the
judge's 5 pement pay increase, but that it had approved her budget which included the 5 pement
increase. Councilor Rundle stated the 5 percent increase would change the judge's proposed
salary for 1998 from $2,045.64 bi-weekly (3 percent increase) to $2,086.55 bi-weekly. He stated
this would make her annual salary $54,250.
Councilor Rundle stated that during the budget process the council approved a salary of $61,800
for the city attomey at 30 hours per week and $65,000 for the assistant city attorney at 40 hours
per week. He stated he saw the increase requested by the judge as valid. Councilor Battreall
agreed.
Councilor Rundle moved to amend the salary ordinance to increase the judges salary for 1998
from $2,045.64 bi-weekly to $2,086.55 bi-weekly. Councilor Battreall seconded. The
amendment was approved 6-0. Ordinance D-1334-97. as amended, was approved 5-0. Councilor
Snyder abstained.
PUBLIC HEARING: Mayor Brainard announced Ordinance C-190. an ordinance annexin~
property ad_iacent to Timber Crest Bend Subdivision. The mayor opened the public hearing at
7:38 p.m. Seeing no one from the public who wished to speak, the mayor closed the public
hearing at the same time. Qrdinance C-190 was carried over to the next meeting.
Mayor Brainard annotmced Ordinance D-1338-97. an additional appropriation for hydrant rental
(.$35.042.30 from the General Fund to Line Item 520-Hydrant Rentals). The mayor explained the
money was to rent hydrants for the growth areas of Carmel not included in the budget. Councilor
Walker moved to introduce the ordinance. Councilor Rundle seconded. The mayor opened the
public heating at 7:40 p.m. Seeing no one from the public who wished to speak, the mayor
closed the public hearing at the same time.
Utilities Manager John Duffy explained the projections the Utilities Department made for the
extra hydrant expenses somehow did not get into the 1997 budget. Ordinance D-1338-97 was
carded over to the next meeting.
Mayor Brainard recognized no one had introduced Ordinance C-190. Councilor Rundle moved to
introduce the ordinance. Councilor Battreall seconded. Mayor Brainard reopened the public
hearing at 7:42 p.m. Again, no one from the public wished to speak, so the hearing was closed at
the same time.
NEW BUSINESS: Councilor Rundle moved to introduce Ordinance D-1339-97. an additional
appropriation for the purchase of real estate ($2.6 million from the General Fund to the BPW
Line Item #600-Land Acquisition). Councilor Carter seconded. Councilor Kirby stated he was
not comfortable with the ordinance and wanted to have an executive session on land acquisition
to discuss the purchase. Mayor Brainard stated the executive session was in the process of being
scheduled. Ordinance D-1339-97 was carried over to tl?e next meeting.
Councilor B attreall moved to introduce Ordinance D-1337-97. adoption of the supplement to the
Carmel City Code. Councilor Walker seconded. Ordinance D-1337-97 was carried over to the
next meeting.
Mayor Brainard announced Resolution CC-11-17-97-01. transfer of funds by DOCS: $25.000
from Line Item #100 Full Time to Line Item #650-01 Motor Equipment-Cars and Trucks
($20,000) and Line Item #640 Office Equipment ($5.000). Steve Engelking, director of the
Department of Community Services, explained he was requesting the transfer of funds to buy a
new Jeep vehicle for a third inspector and an interactive computer set-up f?r the Permits Office.
He stated that part of the money was for other office pumhases. Mr. Engelking explained he
wanted to maintain the $10,000 he had in his budget for vehicles next year so he could replace a
10-year-old pick-up truck. Councilor Snyder moved to introduce the ordinance. Councilor
Rundle seconded. Re~olution CC-11-17-97-01 was approved 7-0.
Mayor Brainard announced Resolution CC-11-17-97-02. transfer of funds by the Fire
Department: $50.493 from Line Item #220 Employer's Health Insurance to #510 Auto Repairs
and Maintenance. Fire Chief Doug Callahan stated the money being transferred would allow the
department to update the safety mechanisms on the aerial vehicle. He explained the large amount
of money in the Employer's Health Insurance Line Item resulted because most of the new hires
this year were singles. Councilor Battmall moved to introduce the resolution. Councilor Walker
seconded. Several councilors and Chief Callahan discussed why the improvements weren't
included in the original budget. Mayor Brainard stated that the township still was responsible for
its part of the expenses. Resolution CC-11-17-97-02 was approved 7-0.
Mayor Brainard announced Resolution CC- 11-17-97-03. transfer of funds by the Carmel City
Court: $500 from Line Item #302 Office Supplies to Line Item #500 Office Equipment.
Councilor Walker moved to introduce the ordinance. Councilor Battreall seconded. Councilor
Rundle stated the council had received a letter from the court chief deputy clerk explaining that
Line Item #500 Office Equipment really should be Line Item #640 Office Equipment. Councilor
Rundle moved to change Line Item #500 to Line Item #640. The amendment was approved 7-0.
Resolution CC-11-17-97-03. as amended, was approved 7-0.
ANNOUNCEMENTS: Councilor Snyder stated the city is paying Curtis L. Coonrod, CPA $803
per month to produce monthly fiscal reports. She explained that the clerk-treasurer will be able to
produce these reports in January when her new software is running. Councilor Snyder stated that
Mr. Coonrod's office still would be responsible for projections, but that she was looking forward
to the clerk-treasurer's new reports. Clerk-Treasurer Cordray agreed. Councilor Kirby stated he
wanted the clerk-treasurer to talk about the capabilities of the new software during the council's
Saturday workshop meeting. Cotmcilor Snyder stated that someone needed to let Mr. Coourod
know he would no longer need to produce the monthly fiscal reports. Councilor Kirby stated he
would talk to Mr. Coonrod.
Councilors discussed a date for the Saturday workshop meeting. They decided on Saturday,
December 13, 1997, at 8 a.m. The mayor then suggested councilors sign the approved legislation.
Councilor Carter pointed out the Boy Scout troop in the audience and told the scouts they were
welcome to ask questions or come forward while councilors signed the papers. At Councilor
Rundle's request, the scout leader addressed the council. Councilors and scouts then discussed
the council's role in local govemment.
Councilor Carter announced the Lighting of the Square event. Mayor Brainard announced, at
prompting by Councilor Kirby, that the police department had received a $300,000 grant from
the state to buy in-car computers for every squad car.
Councilor Kirby moved to adjourn the meeting. Councilor Carter seconded. The meeting was
adjourned 7-0 at 8:26 p.m.
