COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE MEMBERS PRESENT: Mayor Brainard; Council President Kevin Kirby, Councilors Jim Miller, Robert Battreall, Norm Rundle, Luci Snyder, Ron Carter and Billy Walker. Clerk- Treasurer Diana Cordray and Deputy Clerk Rebecca Wolf also attended. Mayor Brainard called the meeting to order at 7:05 p.m. Councilor Miller gave the invocation. Mayor Brainard led the Pledge of Allegiance. APPROVAL OF MINUTES: Councilor Battreall moved to approve the minutes from the July 21, 1997, regular meeting and the July 28, 1997, special meeting. Councilor Snyder seconded. The minutes were approved 7-0. RECOGNITION OF CITIZENS WHO WISH TO ADDRESS THE COUNCIL: Mayor Brainard opened the floor for public comment. The following citizens spoke against the council's decision and/or method to make thc area north of 96th Street between Spring Mill Road and US 31 commercial: Para Lambert. 616 Copley Place Gerald Wagner. 211 West 96th Street, Belle Meade Civic Association Ruth Hayes, Nora-Northside Community Council Dianne de Coursey, 540 West 93rd Street Barbara Kirk, 9154 Compton Street Donna Grubbs, 580 West 92nd Street Bradley Grubbs, 580 West 92nd Street William H. Cummings, 516 West 93rd Street Sen. Murray Clark. 96th Street area resident. Dick Frost, 507 Stonehedge Drive, spoke in favor of adding provisions to the p[oposed animal ordinance that would require owners to be responsible for their pets' defecation. Councilors Snyder, Miller, Carter, Walker and Kirby responded to citizen comment. Bob Book. Clay Township Board, asked the council to table Ordinance D-1309-97, an ordinance Amending Chapter 2, Section 2-101 of the City Code (Paramedic, Emergency Ambulance and Fire Service Capital Fund), until the township board and the council could meet to discuss the issue. Ann Sutt, a citizen who did not identify her residence, asked which streets would carry traffic from commercial development at 96th Street and US 31. Mayor Brainard stated the city would determine how to route traffic as development was proposed for that area. Councilor Battreall added that no development had been proposed yet for the area in question. At 9:38 p.m., Mayor Brainard suggested the council take a short break. The meeting reconvened at 9:49 p.m. The following citizens stated they were opposed to the development of a linear park along the Monon railway: Mary. Mykyta, 49 Granite Court Ruth Moffitt, 120 Winona Drive Vera Bailey, 220 Second Street SW Esther Whisnant, 142 Rolling Hill Jane Graham, 135 Eighth Street NW Barbara Williams, 10670 Highland Drive Linda Harleman, 11080 Willowmere Drive Art Bowers, 28 Cimle Drive Karen Newbert, 322 Stonehedge Drive Tracy Moon, 121 Third Avenue NW Thomas Harleman, 11080 Willowmere Drive Eric Voss, 1135 Clairborne Court. Councilor Kirby responded to citizen comment. John Kirby, 298 West Cannel Drive; Jean Kirby, 298 West Cannel Drive; and Frederick Corban, 9403 North Kenwood Avenue, filled out cards for various topics, but chose not to speak. CLAIMS: Councilor Snyder moved to approve claims in the following amounts: $464,636.34, $566,651.13, $512,718.43 and $373,880.33. Councilor Walker seconded. Claims were approved 7-0. OLD BUSINESS: Councilor Kirby moved to approve Ordinance D-1301-97. As Amended. an ordinance amending Chanter 2. Article 3. Division V. Section 2-81 of the Carmel City Code (Field Training Officer Compensation). Councilor Battreall seconded. Councilor Carter verified the word "Filed" had been changed to "Field" in both places in the ordinance. Ordinance D- 1301-97. As Amended. was approved 7-0. Councilor Kirby moved to table Ordinance D-1307-97. an ordinance deleting, amending and adding to the Carmel City Code regarding animal regulations. Councilor Snyder seconded. Councilor Kirby explained the Department of Law had not had time to answer questions pertaining to the ordinance. Councilor Walker stated he didn't want the ordinance tabled indefinitely. Councilor Snyder stated she had not received any calls about the ordinance and reminded constituents to let their councilors know if they had concerns. ~ was tabled 7-0 until the next meeting. Councilor Kirby moved to introduce Ordinance D-1308-97. an additional appropriation for the implementation of the Carmel Geographical Information System from the General Fund to the Board of Public Works and Safety. Line Item 404 - Consulting Fees (5;125.000). Councilor Battreall seconded. Ordinance D-1308-97 was approved 7-0. Mayor Brainard recommended the council table Ordinance D-1309-97. an ordinance amending Chapter 2. Section 2-101 of the Carmel City Code (Paramedic. Emergency Ambulance and Fire Service Capital Fund) until the council and Clay Township Board had reviewed information provided by the fire chief. Councilor Battreall moved to table Ordinance D-1309-97 indefinitely. Councilor Walker seconded. Ordinance D-1309-97 was tabled 7-0 until the next meeting. Ordinance D-1310-97. an ordinance amending Chanter 2. Article 3. Division II. Section 2-48 of the City Code (employee PERF contribution) was approved 7-0. Councilor Battreall moved to approve Ordinance D- 1311-97. an ordinance creating a special construction fund and providing for an additional appropriation from such fund. Councilor Kirby seconded. Ordinance D-1311-97 was approved 7-0. Councilor Battreall read a letter to the editor in favor of the Monon trail that was printed in the local newspaper. Councilor Walker stated the Monon trail, insofar as it was created as a railway line, was dedicated for transportation and hoped a court might have the oppommity to address this aspect of the issue. Councilor Carter spoke in favor of the trail development and suggested that now was the time for those in favor of the trail to make their wishes known. ADD-ON ITEM: Councilor Snyder explained that the proposed Add-on Item, Resolution CC- 08-04-97-01. a proposal to change the zoning ordinance, was to protect the Meridian Overlay Zone from undesirable retail centers. Councilor Snyder moved to add the item to the agenda. Councilor Miller seconded. Resolution CC-08-04-97-01 was added to the agenda 7-0. Councilor Carter moved to approve the resolution. Councilor Kirby seconded. Councilor Kirby commended the Department of Law for its quick action putting together the resolution. Resolution CC-08-04- 97-01 was approved 7-0. The meeting was adjourned 10 p.m.
