COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE MEMBERS PRESENT: Mayor Brainard; Council President Kevin Kirby; Councilors Robert Battreall, Norm Rundle, Luci Snyder and Ron Carter. Clerk-Treasurer Diana Cordray and Deputy Clerk Rebecca Wolf also attended. Billy Walker arrived during the discussion of Ordinance D-1312-97 (Agenda Item 10b). Mayor Brainard called the meeting to order at 8:06 a.m. APPROVAL OF MINUTES: Councilor Rundle moved to approve the minutes of the July 16 and July 23, 1997, budget meeting. Councilor Battreall seconded. The minutes were approved 5- 0. OLD BUSINESS: Ordinance D-1312~97. An Ordinance Fixing Salaries of Appointed Officers and Employees 0fthe Carmel City_ Court for 1998: Clerk-Treasurer Cordray explained the copies of the ordinances before the council were the ordinances councilors discussed at the first reading. She also explained the court ordinance did not reflect that the city would be paying the employees' PERF contribution. Councilors discussed whether the salary ordinances stated actual salary paid or maximum salary permitted to be paid. Councilor Rundle moved to change the maximum salary for the Clerk of Court/Administrator from $1198.28 to $1153.49 bi-weekly. He stated this included the 3 percent PERF contribution and a 3 percent raise. Councilor Snyder seconded. The motion was approved 5-0. Human Resources Director Barbara Lamb explained the salaries for the Clerk of Court/ Administrator and Assistant Court Clerk were different because the employees in those positions had different longevity and the judge had wanted to keep the take-home pay equal. More discussion occurred about whether the salary ordinances designated a set amount or maximum amount to be paid to employees. Councilor Rundle moved to change the maximum salary for the Assistant Court Clerk from $1018.80 to $1142.29 bi-weekly. Councilor Carter seconded. Discussion occurred about parity of salaries of similar positions. Councilor Rundle withdrew his motion and moved to keep the salary for the Assistant Court Clerk at $1119.89 until the Human Resoumes director finished the parity study next year. Councilor Snyder seconded. Councilor Kirby stated that who made the PERF contribution was an administrative decision, not one covered by the salary ordinance. Councilor Walker arrived. Councilor Carter asked for a summary of the council's action at this meeting. Councilor Rundle stated the council had approved the Clerk of CourffAdministrator salary at $1153.49, up from $1119.89, representing a 3 percent increase to be added to the 3 percent PERF payment made by the city. He explained the council also had approved leaving the Assistant Court Clerk's maximum salary at $1119.89 pending further examination of parity next year by Human Resources. Councilor Battreall verified that all the salary ordinances had increased the amount for part-time/temporary help to up to $12.50 per hour. Ordinance D-1312-97 (Salaries for City Court) was approved 6-0. Ordinance D-1313'-97. An Ordinance Fixing Salaries of Appointed Officers and Employees of the Carmel Clerk-Treasurer's Office for 1998: Clerk-Treasurer Cordray explained she was asking for an increase in salary and reclassification of two employees because their responsibilities and the complexity of their work load had grown. She explained that the proposed Systems Administrator (formerly Accounts Payable Administrator) would be handling contact with Pentamation, her office's new software company. Clerk-Treasurer Cordray stated the other position, a Deputy Clerk-Treasurer, at one time had been considered an Administrative Assistant, but now had increased responsibilities which included microfilming and inventory. Discussion ensued about parity of positions among departments. Clerk-Treasurer Cordray explained the Systems Administrator would work closely with the MIS director once he/she was hired, but would maintain responsibility for the city's financial information. More discussion occurred about parity of positions. Discussion occurred about whether salaries were the actual amounts to be paid or maximum amounts that could be paid to employees. Councilor Battreall moved to increase the Systems Administrator's salary 3 percent plus the PERF contribution, leave the Payroll Administrator's salary as is plus the PERF contribution, and increase the Deputy Clerk-Treasurer's salary 3 percent plus the PERF contribution. Councilor Kirby asked Councilor Battreall to restate his motion. Councilor Battreall stated his motion was giving the increases based offthe current salary, making the bi-weekly salaries $1191.56 for the Systems Administrator, $1156.85 for the Payroll Administrator and $984.20 for the Deputy Clerk-Treasurer. Councilor Snyder seconded. Clerk-Treasurer Cordray stated Councilor Battreall had skipped one of her Deputy Clerk- Treasurers. She explained she was trying to raise the salary of one of her Deputy Clerk- Treasurer's to be equal with the other. Councilors Battreall and Snyder withdrew their motion and second, respectively. Councilor Battreall moved to make the bi-weekly maximum salaries $1191.56 for the Systems Administrator, $1156.85 for the Payroll Administrator and $993.27 for both Deputy Clerk- Treasurers. Councilor Snyder seconded. Ordinance D-1313-97 (Salaries for Clerk-Treasurer's Office) was a_nproved 5-1. Councilor Walker voted no. Ordinance D-1314-97. An Ordinance Fixing Salaries of Appointed Officers and Employees of the City of Carmel: Clerk-Treasurer Cordray explained she and Ms. Lamb had made some changes to the ordinance. Councilors were confused as to which copy of the ordinance was the accurate one. Mayor Brainard suggested the council take a short recess so the clerk-treasurer could provide councilors with the most recent copy of the ordinance. The council recessed at 9:10 a.m. The council reconvened at 9:24 a.m. Councilor Kirby moved that Ordinance D-1314-97 be amended to the version the councilors had before them. Councilor Walker seconded. The amendment was approved 6-0. Clerk-Treasurer Cordray explained that sworn officers were not included in the PERF contribution the city would be making for its civilian employees, so their 3 percent raise was reflected in the ordinance. Councilor Snyder asked why census workers were included in the ordinance. Mayor Brainard explained the position of census worker should be a permanent part of the ordinance so census workers could be paid in accordance with federal law. Clerk-Treasurer Cordray explained she and Ms. Lamb had cleaned up some grammatical mistakes in the ordinance. Councilor Kirby asked why the council had money in its budget to pay part-time employees when, by law, the council was not allowed to hire any. Mayor Brainard stated the money was there in case the city became a second-class city, in which case council would be able to use the money. Councilors discussed whether to increase the assistant city attorney's position by $20,000. They also discussed how much money should be spent on outside counsel. Clerk-Treasurer Cordray asked council for a motion to change the word "is" in Section 12 on the last page to "as." Councilor Rundle moved to do so. Councilor Walker seconded. The amendment was approved 6- 0. Councilor Kirby stated the council had supported the mayor for his projects and ideas and that results have been good so far. Councilor Kirby reminded the mayor that he would be accountable to council. Ordinance D-1314-97 (Salaries for City g. mployees) was approved 6-0. Councilor Carter stated he was unhappy because signs still were being placed in the city's right of way on weekends. Mayor Brainard stated the police chief had talked with the city attorney, and they were trying to resolve some legal issues regarding enforcing the ordinance. Deb Grisham, city attorney, stated that they were trying to decide to what extent the prosecutor should be involved and how to notify offenders about the citations. Mayor Brainard suggested the city continue to confiscate the signs while the attorney worked out the issue of citations. Councilor Kirby stated the city should pick up all signs in the right of way, not just developers. After discussion on which department should pick up the signs, Mayor Brainard asked the director of the Department of Community Services to speak with David Klingensmith of the Street Department to see if the Street Department would need more money for overtime to pick up the signs on Saturday mornings. Councilor Walker suggested having offenders sign their citations when they came to pick up their Signs from the Street Department. Councilor Kirby discussed a possible speeding problem in the Thomhurst subdivision with Police Chief Michael Fogarty. Councilor Kirby moved to adjourn the meeting. Councilor Battreall seconded.
