CARMEL CITY COUNCIL MEETING MINUTES
MONDAY, MARCH 3, 1997 -- 7 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT: Mayor Brainard; Councilors Kirby, Miller,
Rundle, Snyder and Walker. Clerk-Treasurer Cordray and Chief
Deputy Wolf also attended.
Mayor Brainard called the meeting to order at 7:03 p.m. Councilor
Miller gave the invocation. Mayor Brainard led the Pledge of
Allegiance.
/%PPROV/~L OF MINUTES: Councilor Walker moved to approve the
February 24, 1997, minutes with the last sentence before the
adjournment removed from the minutes. Councilor Snyder seconded.
The minutes were approved 5-0.
CITIZENS WHO WISH TO ADDRESS THE COUNCIL:
Sharon R. Clark, county commissioner, made her annual visit to
the council to answer any questions. Councilor Snyder asked for
an update on the 96th Street Bridge project. Commissioner Clark
stated the bridge will be open at the latest by the spring of
1998.
Diana Cordra¥, Carmel clerk-treasurer, responded to concerns
raised in the newspaper. She stated the annexation never would
have had to go to court if her office had been kept abreast of
the annexation process and if legal counsel had been present at
the December 23, 1996, meeting. Clerk-Treasurer Cordray also
presented information about her actions at the December 23, 1996,
meeting and during the following two weeks. Councilor Miller
questioned why Clerk-Treasurer Cordray didn't look at the
documents until January 2, 1997. Councilor Kirby questioned why
Clerk-Treasurer Cordray took the documents home with her. He also
asked why she discussed the documents with opposition attorneys
before consulting with the city attorney. Councilor Snyder asked
that when the council amends a document, how is the clerk-
treasurer supposed to immediately be able to provide the council
with amended versions of documents for the council to sign?
Councilor Kirby stated that a previously approved resolution
directed the clerk-treasurer to write the amendment on the
document before presenting it to councilors to sign. Councilor
Snyder clarified the clerk-treasurer's office read all documents
before putting them on the agenda. Clerk-Treasurer Cordray stated
her office was not responsible for judging the legality of the
documents, that the legal department did this prior to sending
them to the Clerk-Treasurer's Office. Clerk-Treasurer Cordray
asked the council to work together for the future of Carmel.
CLAIMS: Councilor Snyder moved to approve claims for
$1,067,960.33 listed on the agenda as general claims. Councilor
Walker seconded. Councilor Kirby asked who signed the claim
vouchers for the council. Clerk-Treasurer Cordray stated she
could research the claims to find who signed them. Councilor
Kirby stated the council president needed to sign claim vouchers
unless the council had passed a resolution directing a third
party to sign them. He stated he didn't recall the council
passing such a resolution. Clerk-Treasurer Cordray stated she
would, at Councilor Kirby's request, provide him with information
pertaining to all claims filed against the city council budget
from 1997. The claims were approved 5-0.
OLD BUSINESS: Mayor Brainard announced Ordinance D-1277-97, an
additional appropriation for construction/renovation to
Pennsylvania Street. City Engineer Kate Boyle stated an early
estimate for the cost of the project was $3.3 million. Councilor
Kirby stated the city should make a list of project priorities so
money would be properly appropriated. The ordinance was approved
5-0.
Mayor Brainard announced Ordinance D-1278-97, an additional
appropriation for renovations to the Police Department
Headquarters. Councilor Snyder asked to pause the meeting so the
council could sign Ordinance D-1277-97 according to the process
resolved at the previous meeting. Mayor Brainard explained the
third floor of the police station was not built out on purpose
when the building was constructed to allow for growth of the
department. Chief Fogarty explained the police department's plans
to use the renovated parts of the building. He stated the third
floor would be used for record storage and would be designed to
carry the weights of the documents. Councilor Rundle commended
the chief on his diligence in reducing the initial estimate of
the renovations from about $700,000 to the requested
appropriation of $130,000. The ordinance was approved 5-0.
Councilor Kirby asked the council to move forward Agenda Item 10a
Ordinance D-1280-97, an additional appropriation to purchase in-
car cameras for police vehicles, so Chief Fogarty could make his
presentation and be finished.
Councilor Kirby moved to introduce Ordinance D-1280-97. Councilor
Walker seconded. Chief Fogarty explained the police department
had the cameras in some of their cars, but now had the
opportunity to buy enough cameras for its entire fleet. He stated
that outfitting all police vehicles would enable him to establish
uniform policies for officers' use of the cameras. Councilor
Walker stated he wanted to make sure the police department
maintained records from the cameras in compliance with the
statute of limitations. Mayor Brainard opened the public hearing
at 7:53 p.m.
Barbara Richards, member of the Carmel Mayor's Task Force on
Domestic Violence, asked Chief Fogarty if the cameras would be
used at domestic violence scenes to record testimony. Chief
Fogarty responded the cameras could be used, but the officers
would need to bring those involved in the dispute to the car for
questioning. He stated officers would be able to use the audio
more easily. The mayor closed th~ public hearing at 7:56 p.m. The
ordinance was carried over to the next meeting.
Councilor Kirby explained Ordinance D-1279-97, an ordinance
amending the city code regarding special meetings and emergency
sessions. He explained the purpose of the ordinance was to bring
the city code into agreement with the council's actions.
Councilor Walker called for the question. The ordinance was
approved 5-0.
Mayor Brainard announced Ordinance D-1281-97, an ordinance
enacting and adopting the city code supplement. The ordinance was
approved 5-0.
Councilor Walker stated he wanted the Indiana'Attorney General to
give an opinion to the city about when an ordinance becomes an
ordinance. Mayor Brainard stated he would have the city attorney
make that request.
Councilor Kirby stated he wanted the council to start meeting
once a quarter on Saturday mornings to do planning and research
about issues, especially the budget. Mayor Brainard stated he
would check several dates and his office would call councilors to
set up the meeting.
Councilor Rundle moved to adjourn. Councilor Snyder seconded. The
council voted 5-0 to adjourn. The meeting was adjourned at 8:07
p.m.
