CARMEL CITY COUNCIL MEETING MINUTES
MONDAY, MARCH 17, 1997 -- 7 P.M.
COUNCIL CHAMBERS / CITY H~T.T~ / ONE CIVIC SQUARE
.MEMEERS PRESENT: Mayor Brainard; Councilors Kirby, Miller,
Rundle, Carter and Snyder. Clerk-Treasurer Cordray and Chief
Deputy Wolf also attended.
Mayor Brainard called the meeting to order at 7 p.m. Councilor
Miller gave the invocation. Mayor Brainard led the Pledge of
Allegiance.
RECOGNITION OF OUTSTANDING CITIZENS/CITY EMPLOYEES: Mayor
Brainard read and presented a Proclamation of Disabilities
Awareness Month to Robert Bill, executive director for Janus
Developmental Services.
APPROVAL OF MINUTES: Councilor Rundle moved 'to approve the
minutes from March 3, 1997. Councilor Kirby seconded. The minutes
were approved 5-0.
CITIZENS WHO WISH TO ADDRESS THE COUNCIL: Mayor Brainard stated
that anyone wishing to address the council about Agenda Item 10a
could do so during the public hearing for that item. No other
citizens wished to speak.
gLAIMS: Councilor Snyder moved to approve the claims as listed on
the agenda (Items 7a through 7c). Councilor Rundle seconded. The
claims were approved 5-0.
COMMITTEE REPORTS: Mike Hollibaugh from the Department of
Community services stated that Tom Thompson, president of the
Carmel Clay Plan Commission, would present information about the
proposed 146th street bridge across U.S. 31. Mr. Thompson
explained the task force had looked at several styles of bridges
and had picked one it preferred at an additional $350,000 to.the
cost of the basic structure. He added the county said it would
pay only for the basic structure. Mr. Thompson stated Mayor
Brainard suggested seeking funding from Westfield and Clay
Township. Mr. Thompson stated Westfield Town Board Members
indicated they wanted the aesthetic improvements for the bridge
but did not specify how much the town would help financially.
Councilor Snyder explained the township was prohibited by law
from paying for roads and bridges but could pay for improvements
to the bridge via the parks budget. Mayor Brainard asked DOCS to
continue working with Westfield and the township to work out
'exact figures and then return to the council. Mr. Thompson stated
he also would work With the county to see what kind of financing
terms could be arranged. Councilor Kirby stated parks should pay
for sidewalks, not the council. Mr. Thompson assured him the
council,s concern was the aesthetics of the bridge. Councilor
Carter suggested the township pay for a portion of the bike
trail/sidewalk and that the county put what it wouldn't have to
pay for the sidewalk toward the decorative part of the bridge.
Mr. Thompson stated he would propose Councilor Carter, s request
to the county.

PUBLIC HF2%RIN~: Mayor Brainard read and explained Ordinance D-
~dinance implementing policies in the 2020 Vision
Comprehensive Plan regarding low intensity development. COuncilor
Miller moved to introduce the ordinance. Councilor Rundle
seconded. The mayor opened the public hearing at 7:31 p.m.
James Dillon, 507 Cornwall Court, asked the council to make city
ordinances consistent with the comprehensive plan.
Robert McKinne¥, 1425 Gwynmere Run, spoke against government
dictating how people can sell their property.
Tom Murphy, 8060 Knue Road, wanted the area to maintain current
density requirements of 1.8 dwelling units per acre.
Frank Franks, Western Clay Township Resident, stated density
requirements should remain low and that plan commission should
look at exceptions through rezones.
Mark Ratterman, president of Crooked Stick Homeowners
Association, stated he supported low density requirements.
Rom Houck, 315 West 107th Street, stated he supported low density
requirements.
David Warshauer, Brenwick Development, made a presentation
against Ordinance D-1282-97.
Stephen R. Graves, Greenwood resident representing local
landowners, provided information against low density residential
development.

Tom ~endall, 11818 Gray Road' spoke in favor of low density in
Western Clay Township.
No one else from the public Wished to speak. Mayor Brainard
closed the public hearing at 8:35 p.m. No one from the Council
wished to comment on Ordinance D-1282. Mayor Brainard carried the
ordinance over to the next meeting.
The mayor called for a recess at'8:36 p.m. The council reconvened
at 8:46 p.m.
NEW BUSINESS: Mayor Brainard explained Resolution CC-03-17-97-01,
a directive -for the plan commission to prepare a recommendation
regarding the siting of wireless facilities. Councilor Snyder
moved to introduce the resolution. Councilor Kirby seconded. Mr.
Thompson stated he understood the urgency of the request and
would have the plan commission comply with the timetable outlined
in the resolution. Councilor Rundle asked the mayor what the
Board of Zoning Appeals planned to .do about several special use
requests regarding towers. Mayor Brainard said it would be
recommended to the BZA to table the issues. Sally Slinkard, a
representative from Sprint Spectrum, spoke to the council asking
the city to hear four petitions filed by Sprint, two of which
were docketed, two that were not. The council voted 5-0 to
approve the resolution.
ADD-ON ITEM~: Mayor Brainard read Ordinance D-1284-9~, an
ordinance establishing a redevelopment authority. Councilor Kirby
moved to introduce Resolution CC-03-17-97-02. Councilor Snyder
seconded. Mayor Brainard stated Councilors Kirby and Snyder had
moved on a different item than what he had read. Councilor Kirby
amended his motion to move to introduce Ordinance D-1284-97.
Councilor Snyder seconded. Councilor Snyder clarified the date
{March 17, 1997) stamped on the add-on memo was the date the
Clerk-Treasurer's Office received the memo. Clerk-Treasurer
Cordray stated it was, and that her office had received the memo
at about 4:15 p.m. Councilor Snyder asked the clerk-treasurer if
her staff had looked at the document and understood it. CIerk-
Treasurer Cordray said they had. Mayor Brainard explained the
statue. He stated this was being done in anticlpation of bonding

Councilor Rundle moved to introduce Resolution CC-03-17-97-02, a
resolution supporting land acquisition. Councilor Carter
seconded. Mayor Brainard read some of the ordinance and explained
the land was immediately north of the police station. He also
explained the process needed to work toward an agreement to
purchase the land. He stated the city would need to appropriate
money for the purchase if an agreement was reached. The
resolution was approved 5-0.
Councilor Snyder stated that, in light ora memo council members
had received from the clerk-treasurer citing City Code, Section
3-19, the council had failed to properly add the final two items
to the agenda. She stated councilors needed to have the president
ask them after they finished new business if they would like to
deal with the add-on items. Councilor Snyder stated the council
had to call for a vote before having any discussion or debate on
whether to allow the item on the agenda. Mayor Brainard agreed
and stated the council's actions regarding Ordinance D-1284-97
and Resolution CC-03-17-97-02 probably were invalid.
Councilor Snyder moved to add Ordinance D-1284-97 and Resolution
CC-03-17-97-02 to the agenda. Councilor Kirby seconded. The items
were added to the agenda 5-0.
Councilor Kirby moved to introduce and waive the reading of
ordinance D-1284-97. Councilor Snyder seconded. The ordinance was
carried over.
Rundle moved to introduce and waive the reading of

resolution was approved 5-0. Councilor Kirby stated the council
should not have to rush through items at the last minute and
would like to see things handled in a more deliberate fashion.
Mayor Brainard said the city woul'd do its best to comply.
council members and Mayor Brainard discussed dates and locations
for a budget workshop session. Most councilors agreed the whole
council should be able to attend the first meeting. Councilor
Kirby stated the first meeting should be held locally, but that
the council could go out of town on a ~retreat" for a later
workshop. Mayor Brainard said his staff would be in touch with
councilors to determine the date.
