CARMEL CITY COUNCIL MEETING MINUTES
MONDAY, JANUARY 6, 199~g-- 7:30 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT: Mayor Brainard; Councilors Kirby, Miller,
Battreall, Rundle, Snyder, Carter and Walker. Clerk-Treasurer
Cordray and Chief Deputy Wolf also attended.
Mayor Brainard called the meeting to order at 7:32 p.m. Councilor
Miller gave the invocation. Mayor Brainard led the pledge of
allegiance.
RECOGNITION OF OUTSTANDING CITIZENS/CITY EMPLOYEES: Mayor
Brainard presented Charlene Kelsey, Department of Community
Services employee, with the City of Carmel Employee Excellence
Award. Steve Engelking, DOCS director, explained Mrs. Kelsey's
service to the city.
Mayor Brainard presented Joseph Clayton, Carmel citizen and
Thomson Consumer Electronics employee, with the Rangeline Pioneer
Award to recognize his years of service to Thomson and the city.
The mayor announced Channel 13 and American Cablevision had
signed a multi-year agreement after several days of negotiations.
A~PROVAL OF MINUTES: Councilor Walkermoved to approve the
December 16, 1996, minutes. Councilor Battreall seconded. Mayor
Brainard stated he was uncomfortable with the word ~introduced"
being used after his name because the mayor legally cannot move
to introduce ordinances. ~uncilor Snyder moved to amend the
minutes to remove the word ~introduced" following ~Mayor
Brainard" in the minutes and replace it with the word
~announced." Councilor Carter seconded. Councilor Rundle moved to
amend the minutes to add the words ~and department heads'"
following the words ~elected officials'," and to remove the word
~together" and replace it with ~to that of the mayor." Clerk-
Treasurer Cordray stated she didn't think Councilor Rundle had
referred to department heads at the last meeting, but would
listen to the tapes and make any needed changes. The minutes were
approved 7-0 as amended.
CITIZENS WHO WISH TO ADDRESS THE COUNCIL: NO citizens wished to
address the council.
Councilor Rundle apologized to Mayor Brainard and Councilors
Miller, Battreall, Carter and Walker for remarks he made toward
them at the December 23, 1996, meeting.
CLAIMS: Councilor Snyder moved to approve claims as listed on the
agenda (Items 7a and 7b). Councilor Walker seconded. The claims
were approved 7-0.
Clerk-Treasurer Cordray informed the council the special census
had been completed December 20, 1996, and the checks mailed to
workers January 1, 1997. She stated that $112,143.36 was paid to
workers and $6,999.45 was encumbered, making the total spent by
the city on the census $119,142.81. Clerk-Treasurer Cordray
stated this was less than the original appropriation.
Councilor Kirby asked to have the green bar for the year-end
report. Clerk-Treasurer Cordray stated the year-end close out
would be available by the end of the week. Councilor Carter asked
if councilors could have the expenditures/revenues for the city
on a monthly basis. Clerk-Treasurer Cordray stated she would do
everything possible to provide the councilors with that material.
CO~94ITTEE REPORTS: Councilor Battreall stated the Cable TV
Advisory Committee meeting would be open to the public for anyone
who wanted to talk about the rate increase or other topics.
Mayor Brainard asked the council to move discussion about
Ordinance D-1268-97 to before old business. The ordinance would
amend city code to enable the council to elect a council
president for more than one consecutive term. The mayor stated a
member of the audience wanting to speak to it was ill. Councilor
Walker moved to discuss Agenda Item lla before old business.
Councilor Kirby seconded.
James Garretson, former council member, explained why the council
of which he was a member passed the original ordinance preventing
the president pro tempore from succeeding himself in office.
Councilor Miller stated he was honored by the council's attempt
to re-elect him as president, but agreed with Mr. Garretson.
Councilor Miller stated he would prefer not to have the ordinance
passed. Councilor Carter stated he would withdraw the ordinance.
The ordinance was withdrawn.
Mayor Brainard stated the council needed to elect a president.
Councilor Snyder nominated Councilor Kirby. Councilor Rundle
seconded. Councilor Carter nominated Councilor Walker. Councilor
Kirby seconded. Councilor Rundle moved to close the nominations.
Councilor Carter seconded. The nominations were closed. Six
council members voted in favor of Councilor Kirby as president.
Councilor Carter voted in favor of Councilor Walker as president.
Councilor Kirby was elected president of the council for 1997.
Councilor Kirby stated the position of parliamentarian needed to
be filled. He suggested the mayor appoint Councilor Carter.
Councilor Carter accepted. The mayor stated he also needed to
appoint the chaplain and asked Councilor Miller if he would
accept the position of chaplain again. Councilor Miller accepted.
OLD BUSINESS: Mayor Brainard announced Ordinance D-1254-96, an
additional appropriation from the general fund to buy the Monon
Corridor. He explained the procedure to acquire the land and
stated the city hoped to close the acquisition by March and begin
construction during the summer. Councilor Rundle asked if the
township was to reimburse the city for part of the purchase. The
mayor explained that the city would buy the land, but Carmel Clay
Parks and Recreation would develop the trail. He stated Carmel
Clay Parks and Recreation was funded through a joinder agreement
so the township would share in the cost of development. Councilor
Kirby stated it was appropriate for the city to purchase the
trail because it could use the land for many purposes such as
utilities lines. The council approved the ordinance 7-0.
PUBLIC HEARING: Mayor Brainard explained some of the Department
of Community Services' tasks and stated the department was
jointly funded with the township. Mayor Brainard introduced DOCS
Director Steve Engelking to explain Ordinance D-1267-97, an
ordinance appropriating money to pay for salaries in DOCS. Mr.
Engelking explained the department's needs to fund the positions
of inspector, permit services administrative assistant and urban
forestry administrative assistant.
Mayor Brainard opened and closed the public hearing at 8:50 p.m.
No one from the public wished to speak.
The ordinance was carried over to the next meeting.
NEW BUSINESS: Mayor Brainard explained that Ordinance D-1269-97
corrected a typographical error calling the city's health
administrator by name instead of using generic language.
Councilor Battreall moved to introduce the ordinance. Councilor
Walker seconded. The ordinance was carried over to the next
meeting.
Mayor Brainard suggested the council table Ordinance D-1266-96,
the clerk-treasurer's additional appropriation for software, even
though it was not listed on the agenda. Councilor Walker moved to
table the ordinance. Councilor Snyder seconded. The ordinance was
tabled 7-0.
OTHER: Councilor Rundle moved to introduce a resolution making
The Daily Ledger Carmel's designated newspaper for publication of
legal record. The council approved the resolution 6-1. Councilor
Battreall was opposed.
Councilor Kirby moved the city no longer pay for subscriptions to
The Daily Ledger for council members. Councilor Carter seconded.
Councilor Kirby asked the clerk-treasurer to put copies of the
legal notices in councilors' mailboxes. Clerk-Treasurer Cordray
agreed. Councilor Rundle stated he disagreed with Councilor Kirby
because he believed the expenditure was appropriate. Councilor
Walker stated the councilors needed to stay updated on local
issues. Mayor Brainard stated the city no longer subscribes to a
clipping service. Councilor Carter called for the question. The
council approved Councilor Kirby's motion 5-2. Councilors Rundle
and Walker were opposed.
Councilor Battreall presented the clerk-treasurer with a check
for $325 to give to the Paul Harris Fellowship of the Rotary. He
stated the check was about equal to the increase in salary he
received as a result of the new salary ordinance D-1255-96. He
made a request to Carmel citizen Mary Jane Coffing to match the
donation as she said she would at a previous council meeting.
Councilor Snyder moved to adjourn. Councilor Kirby seconded. The
meeting was adjourned at 9:04 p.m.
