CARMEL CITY COUNCIL MEETING MINUTES
MONDAY, APRIL 5, 1999 -7 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT: Mayor James Brainard; Council President Luci Snyder; Councilors Jim
Miller, Ron Carter and Billy Walker. Clerk-Treasurer Diana Cordray and Deputy Clerk Rebecca Martin
also attended. Councilors Bob Battreall, Norm Rundle and Kevin Kirby were absent.
Mayor Brainard called the meeting to order at 7:10 p.m. Councilor Walker gave the invocation. Mayor
Brainard asked everyone to remember the troops fighting in Yugoslavia during the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: Mayor Brainard
read a statement proclaiming the week of April 11, 1999, Telecommunicators Week in Carmel and
recognized Jim KindeL Communications Center director, and several of his staff members.
APPROVAL OF MINUTES: Councilor Snyder moved to approve the minutes of the March 15, 1999,
meeting. Councilor Miller seconded. Councilor Walker stated he would abstain from voting because he
was absent from the March 15 meeting. The minutes were carried over to the next meeting because there
weren't enough votes to approve them.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
Russ Macdonald, 10905 Westfield Boulevard, talked about information he had received from the City
regarding the fire department' s assets (Exhibit A).
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Mayor Brainard and Mr. Macdonald discussed the assets belonging to the Carmel Fire Department and
Mr. Macdonald' s information pertaining to these items. Councilor Garter stated he wasn't clear what
Mr. Macdonald was advocating.
CLAIMS:
Councilor Snyder moved to approve claims in the amounts of $5,137.68, $268,272.26, $157,441.17,
$381,643.42 and $434,387.20. Councilor Walker seconded. Clerk-Treasurer Cordray stated Councilor
Snyder had incorrectly read the second amount. Councilor Snyder corrected the amount to read
$26_0,272.26. Councilor Snyder then took a few minutes to clarify a statement made in Tom Kendall' s
campaign ad in the Highflyer. She stated that Mr. Kendall fictitiously stated that councilors never met
with the clerk-treasurer to review claims. She explained that each of the council presidents had met
regularly with the clerk-treasurer, and that the council had recently established a finance committee to
discuss any unclear claims with the clerk-treasurer and department directors. Councilor Snyder stated
the council worked hard to resolve issues prior to the meetings. Claims were approved 4-0.
COMMITTEE REPORTS:
Clerk-Treasurer Cordray stated that part of her responsibility as clerk-treasurer was maintenance of
records and preservation of documents. She explained that recently Deputy Clerk Rebecca Martin had
found two deeds from the late 1800' s while entering old deeds into a spreadsheet. The clerk-treasurer
explained the Carmel Clay Historical Society had researched the deeds and discovered the signers were
founders of Carmel. The clerk-treasurer showed the deeds, which she had framed, to the council.
Councilor Snyder stated she and several others present had attended the Hamilton County Alliance
annual meeting. She gave councilors copies of a speech given at the meeting and said annual reports
were being mailed to councilors.
OLD BUSINESS: Mayor Brainard announced Ordinance D- 1410-99, an ordinance renumbering
Section 2-72 and making other housekeeping corrections to the Carmel City Code. There was no
discussion. Ordinance D-1410-99 was approved 4-0.
NEW BUSINESS: Mayor Brainard announced Ordinance D-1411-99, an ordinance establishing an
ordinance violation deferral program and explained the ordinance provided a way for qualifying
motorists to avoid court and be put on probation instead. He stated this ordinance would allow Carmel to
keep traffic violation fees in the City. Councilor Carter moved to introduce the ordinance. Councilor
Snyder seconded. Councilor Walker asked if this program would make it difficult for other police and
courts to know a motorist's driving record (i.e. could other police and courts know how many times a
person had been pulled over if the motorist had been allowed to participate in the deferral program?)?
Councilor Walker and Mayor Brainard discussed the rules and procedures of the ordinance. Councilor
Miller stated this ordinance is a good way to improve efficiency and keep dollars local. Ordinance D-
1411-99 was carried over to the next meeting.
Councilor Walker moved to approve Resolution CC-04-05-99-01, a resolution approving payment of
construction costs for Hazel Dell Parkway ($140, 164.55). Councilor Miller seconded. Councilors talked
about construction on Hazel Dell and other projects. Resolution CC-04-05-99-01 was approved 4-0.
Mayor Brainard stated at 7:44 p.m. the meeting would be adjourned after documents were signed.
