CARMEL CITY COUNCIL MEETING MINUTES
THURSDAY, MAY 6, 1999 - 8 A.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT: Councilors Kevin Kirby, Jim Miller, Norm Rundie, Ron Carter and Billy
Walker. Deputy Clerk Rebecca Martin also attended. Council President Luci Snyder and Councilor Bob
Battreall arrived during the motion to approve claims. Mayor Jim Brainard and Clerk-Treasurer Diana
Cordray were absent.
Councilor Rundle accepted the position of presiding officer by council consensus and called the meeting
to order at 8 a.m.
CLAIMS: Councilor Carter moved to approve claims in the amounts of $191,569.40, $16,591.96,
$361,035.40, $51,961.84, $11,389.91 and $209,530.99. Councilor Kirby seconded. Councilor Rundle re-
read the amounts for Councilors Snyder and Battreall. The claims were approved 7-0.
Councilor Rundle turned the gavel over to Council President Luci Snyder.
Councilor Battreall asked Deputy Clerk Martin to deliver claims to councilors more in advance of the
meetings. Councilor Rundle asked the deputy clerk to make sure a list of account numbers were attached
to the claims as was previously done. Councilor Carter concurred with Councilor Rundle's request.
Councilor Snyder asked councilors who they believed should be on a committee to talk to residents in
western Clay Township about annexation. Councilors discussed the issue. Councilor Battreall moved
that the committee should consist of the council president, one at-large member and an appointed person
by the mayor. Councilors discussed the motion.
Councilor Battreall stated that Clay West residents probably wouldn't make any decisions until after the
November elections because they were hoping to put annexation into Carmel on the ballot as a
referendum. Councilor Kirby explained that the referendum would not be binding by law, but would be
just a straw poll of township residents. Councilors continued discussion of the issue.
Councilor Carter stated he was not sure if the council should take the role council members were
suggesting, and that maybe this should be left for the mayor to handle. He reminded councilors that even
though they were taking a stance of "no forced annexation" this would not be an easy or pretty process.
Councilors discussed the role of the committee, whether it would be finding facts or negotiating
annexation options. Councilor Walker asked why the council was negotiating this issue. Councilor
Kirby stated the negotiations could be used to find out what improvements neighborhoods needed and to
develop a schedule showing when the City would provide these needs if the areas were annexed.
Councilor Carter reiterated that he believed the council was stepping over the legislative boundary and
into the executive arena by following this approach. Councilor Snyder disagreed, stating the council is
the body that makes the decision to approve or deny annexations and how to fund them. She also stated
that meeting with Clay West residents, listening to them and working with them would be a good public
relations move for the council.
Councilor Kirby told councilors they should be prepared for an even more pressing issue than
annexation, the renewal of the joinder agreements. He stated the township didn't pay for many benefits
it received from the City such as Human Resources and GIS (Geographic Information System)
completion, but that several members of the Clay Township Board believed the Township was paying
too much into the joinder agreements. Councilors continued their discussion.
Deputy Clerk Martin left the meeting at 8:29 a.m. She and Clerk-Treasurer Cordray returned to the
meeting at 8:31 a.m. Clerk-Treasurer Cordray told the council they were in violation of state law
discussing items other than claims, because this meeting had been noticed as follows: The Carreel City
Council will have a special meetling ot~ Thursday, May 6, 1999, at 8 a.m. it~ Council Chambers, City
Hall, One Civic Square to approve claims. Councilors had some brief discussion and adjourned the
meeting at 8:33 a.m.
