COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE MEMBERS PRESENT: Mayor James Brainard~ Council President Luci Snyder~ Councilors John Koven, Bob Battreall, Norm Rundie, Ron Carter and Billy Walker. Clerk-Treasurer Diana Cordray and Deputy Clerk Robin Butler also attended. Councilor Keyin Kirby arrived late. Mayor Brainard called the meeting to order at 7~08 p.m. Councilor Carter pronounced the invocation. Mayor Brainard led the Pledge of Allegiance. APPROVAL OF Councilor Rundie Koven seconded. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL: Dick Frost of 507 Stonehedge Dr. addressed the Council about a stop sign on 126th Street, 1996 Oaths of Office of Council members and an e-mail sent to the State Representatives and Senators about taxation of dog owners. Barb Richards of 934 Shea Ct. addressed the Council on behalf of Prevail, Inc. which is Hamilton County's Victim' s awareness and support program. She announced a fundraiser for Prevail, Inc. called t Heritage Classic, on October 9 h and 10th. John Benbow of 22 Albert Ct. addressed the Council about the noise from the Library. Carl Burton of 15 Albert Ct. spoke against the stop sign being removed from 126th St. and Lexington. He also would like to see the left turn signal functioning on 126th St. at Rangeline Rd. COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS: Mayor Brainard addressed the stop sign and left turn signal on 126th St. Councilor Battreall spoke about the 126th St. left turn signal, removal of the stop sign on 126th St. and the poor reception of the Council meetings on the public access cable channel. Councilors Rundie, Carter and Koven all spoke regarding the Cable reception. Council President Snyder stated she would write a letter to the Cable Television Committee about this issue. Councilor Koven also spoke regarding the 126th St. left turn signal. CLAIMS: Council President Snyder moved to approve claims in the amounts of $689,388.46 and $201,275.04. Councilor Rundie Seconded. Claims were approved 6-0. COMMITTEE REPORTS: There were no committee reports. OLD BUSINESS: Mayor Brainard announced that Ordinance D-1421-99 would be heard later in the meeting. The Ordinances were approved 5-0 (Councilor Rundle was not present for the vote). Councilor Carter moved to add on Resolution-CC-09-01-99-03; To Set the 2000 General Fund Tax Levy and Rate. Council President Snyder seconded. Councilor Carter moved to introduce the Resolution. Council President Snyder seconded. Resolution CC-09-01-99-03 was approved 5-0 (Councilor Rundle was not present for the vote) Councilor Kirby arrived at 8:30 p.m. PUBLIC HEARINGS: Mayor Brainard announced Ordinance Z-338~ An Ordinance Establishing the Providence at Old Meridian Planned Unit Development District. Councilor Battreall moved to introduce the Ordinance into business. Councilor Walker seconded. ZeffWeiss with Ice Miller Donadio & Ryan gave a presentation about the new development. There was Council discussion. The Public Hearing was opened at 9:06 p.m. Dave Cremeans, President of Carmel/Clay Plan Commission commented on the development. The Public Hearing was closed at 9:07 p.m. Ordinance Z-338 was carried forward to the next regular meeting. The Council revisited Ordinance D-1421-99 at this time. Mayor Brainard announced Ordinance D-1421-99; An Ordinance Authorizing and Approving the Investments of Public Funds in Money Market Mutual Funds. At this time there was further Council discussion about Ordinance Z-338. Diana Cordray, Clerk-Treasurer, corrected the agenda to reflect the correct description of Ordinance D- 1421-99: "Authorizing and Approving the Entry into an Interlocal Agreement for the Investment of Public Funds." Brian Burdick of Barnes & Thornburg, attorney for Mrs. Cordray, presented a summary of Ordinance D- 1421-99. There was Council discussion. Ordinance D-1421-99 was approved 7-0. The Cout/cil resumed the order of busit~ess as listed or/the agenda. Mayor Brainard announced Ordinance Z-339; An Ordinance Making Technical Amendments and Other Corrective Changes to the Carmel/Clay Zoning Ordinance, The Carmel/Clay Subdivision Control Ordinance and the Carmel/Clay Floodplain Ordinance. Council Walker moved to introduce the Ordinance into Business. Councilor Koven seconded. John Molitor, Legal Council for the Carmel/Clay Plan Commission, presented a summary of the Ordinance to the Council. Ordinance Z-339 was carried forward to the next regular meeting. Mayor Brainard announced Ordinance C-200; Annexation of Woodland Springs Christian Church. Council President Snyder moved to introduce the Ordinance into business. Councilor Walker seconded. Todd Ruetz with Campbell Kyle Proffit presented a brief summary of the Ordinance. Mayor Brainard opened the Public Hearing at 9:29 p.m. Seeing no one from the public who wished to speak, the Public Hearing was closed at 9:29. Ordinance C-200 was carried forward to the next regular meeting. Mayor Brainard announced Ordinance D-1423-99; An Ordinance Amending Chapter 3, Article I, Division II, Section 3-17 of the Carmel City Code. Council President Snyder moved to introduce the Ordinance into business. Councilor Koven seconded. Council President Snyder presented a summary of the Ordinance. There was Council discussion. Ordinance D-1423-99 was carried forward to the next regular meeting. Mayor Brainard announced Ordinance D-1424-99; An Ordinance Amending Chapter 8, Article 9, Section 8-120 of the Carmel City Code. Councilor Walker moved to introduce the Ordinance into business. Councilor Snyder seconded. There was Council discussion Councilor Kirby moved to suspend the rules and act on Ordinance D-1424-99 tonight. Councilor Battreall seconded. Councilors Kirby, Battreall and Koven voted in favor. Council President Snyder, Councilors Walker, Carter and Rundle voted against. The motion was defeated. Ordinance D-1424-99 was carried forward to the next regular meeting. Mayor Brainard announced Ordinance D-1434-99; An Ordinance Creating a Tuition Reimbursement Program for City Employees. Councilor Carter moved to introduce the Ordinance into business. Council President Snyder seconded. There was no discussion. Ordinance D-1434-99 was carried forward to the next regular meeting. Mayor Brainard announced Ordinance D-1435-99; An Ordinance Amending Chapter 2, Article 3, Division II, Section 2-56 of the Carmel City Code. Councilor Walker moved to introduce the Ordinance into business. Council President Snyder seconded. There was no discussion. Ordinance D-1435-99 was carried forward to the next regular meeting. Mayor Brainard announced Ordinance D-1436-99; An Ordinance Amending Chapter 7, Article 3, Section 7-10 of and Adding Section 7-27 to the Carmel City Code. Council President Snyder moved to introduce the Ordinance into business. Councilor Carter seconded. Douglas C. Haney, City Attorney, presented a summary of the Ordinance to the Council. There was Council discussion. Councilor Walker moved to change the amounts in Section 7-10 and 7-27 from $100.00 to $1,000. Councilor Koven seconded. The amendment passed 6-0. Ordinance D-1436-99 was carried forward to the next regular meeting. Councilor Walker moved to approve Resolution CC-09-07-99-01; A Resolution Authorizing the Board of Public Works and Safety to Convey .013 Acres to Hamilton County for the Reconstruction of Bridge #139. Council President Snyder seconded. Resolution CC-09-07-99-01 was approved 7-0. Councilor Kirby moved to approve Resolution CC-09-07-99-02; A Resolution Authorizing the Carmel/Clay Board of Parks and Recreation to Convey .043 Acres to Hamilton County for the Reconstruction of Bridge #139. Councilor Koven seconded. Resolution CC-09-07-99-01 was approved 7-0. OTHER BUSINESS: Councilor Carter recommended including Ordinance Z-338 on the agenda for the September 21, 1999 Special Council Meeting. Councilors Kirby, Rundle and Walker stated they would not be at the September 21 st meeting. Councilor Kirby commented about upgrading the audio-visual capabilities of the Council Chambers. ADJOURNMENT: Councilor Walker moved to adjourn the meeting pending execution of documents. Councilor Carlet seconded.
