COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James Brainard~ Council President Luci Snyder~ Councilors Kevin Kirby, John Koven, Bob
Battreall, Norm Rundie, Ron Carter and Billy Walker. Clerk-Treasurer Diana Cordray and Deputy Clerk
Robin Butler also attended.
Mayor Brainard called the meeting to order at 7:02 p.m. Councilor Walker pronounced the invocation.
Mayor Brainard led the Pledge of Allegiance.

RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS
Mayor James Brainard presented Outstanding Citizen Awards to the following members of the
International Arts Festival Steering Committee in recognition of their work on the Festival:

Susan Smith
Connie Voytik
Rosemary Waters
The Rat~geline Pioneer Award was presented to the Co-Chairs of the International Arts Festival; Faye
Graham and Jeff Worrell.
Mayor Brainard also presented Outstanding Citizen Awards to the following volunteers of Camp
Awarene s s:

Katie Ewing Kristen Kiefer
Graham Hogg
Susan Hanson, Founder and Director of Camp Awareness then shared some photos of Camp Awareness
with the Council and expressed her gratitude to the volunteers.
APPROVAL OF MINUTES:
Councilor Rundie moved to approve the minutes of the September 7, 1999, Special Meeting. Councilor
Battreall seconded. The minutes were approved 7-0.
Councilor Rundle moved to approve the minutes of the September 21, 1999 Special Meeting. Councilor
Battreall seconded. The minutes were approved 7-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
Joyce Axelson of 22 Lakeshore Ct. addressed the Council regarding problems obtaining a remodeling
permit for 31 S. Rangeline Rd.
Alan Potasnik of 572 Melark Dr. addressed the Council (also on behalf of Jim Garrettson) opposed to
raising the Council members' Salaries.
William T. Stephens of 9641 N. County Rd. 550 E. addressed the Council regarding problems obtaining
a building permit for 13 1 S. Rangeline Rd.
Judy Edwards of the Carmel Clay Public Library gave an update to the Council of specific actions the
Library has taken to help minimize the noise for the surrounding residents (see Exhibit A).
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
There was Council discussion regarding the Library.
Councilor Koven pointed out a conflict in the City Code regarding Auman Dr. East and West speed
limits.
Clerk-Treasurer Diana Cordray suggested to the Council that next year the Council budget for a
complete re-codification of the City Code to clean up these types of conflicts.
Councilor Battreall asked the Mayor about a letter From Mr. Ungowski concerning a crosswalk for
Cherry Tree Elementary School. Mayor Brainard stated the issue has been referred to the City Engineer
and if a letter has not been sent out already, it will be soon.
Councilor Battreall then addressed Ms. Axelson and Mr. Stephens and told them he will look into the
matter of issuing the permits for their properties on Rangeline
Councilor Fatter addressed the Council regarding the problems with the cable television broadcast.
Councilor Fatter also express concern regarding the Plan Commission write up of the Duke Project
(Hamilton Crossing) in relation to the US 3 1 Overlay Zone Ordinance. Councilor Battreall and Council
President Snyder both reaffirmed Councilor Carter's concerns of the Duke Project.
Council President Snyder clarified that Ms. Axelson's concern is with a piece of property in her district.
She stated that she would work with Councilor Battreall on Ms. Axelson's concerns.
Councilor Fatter requested clarification From Ms. Axelson regarding her permit request.
Mayor Brainard addressed the Council regarding the Cable Television issue.
Mayor Brainard read a portion of a letter From Steve Engelking, Director of the Department of
Community Services which pertained to Ms. Axelson's permit application.
Council President Snyder and Councilor Kirby further commented on the permit issues.
Mayor Brainard addressed the Council and public regarding a Rangeline Rd. Overlay Zone stating that it
was recommended to enhance property ownership in the area. Because of the volume of permits
requested in that area and the fact that some requests would be incompatible with any rules that may be
set in the future in Old Town, a resolution was to be proposed to set a moratorium on issuing permits in
that area.
CLAIMS:
Council President Snyder moved to approve claims in the amounts of $197,683.29, $194,624.87 and
$1,211,482.04. Councilor Walker Seconded. Claims were approved 7-0.
COMMITTEE REPORTS:
Council President Snyder reported that Clerk-Treasurer Diana Cordray was chosen to serve on the
Executive Committee oFthe Indiana Association oF Cities and Towns (IACT).
OLD BUSINESS:
Mayor Brainard introduced Ordinance D-1423-9% An Ordinance Amending Chapter 3~ Article 1~
Division IL Section 3-17 oF the Carreel City Code. Council President Snyder presented a summary oF
the Ordinance. There was no Curther discussion. Ordinance D-1423-99 was approved 7-0.
Mayor Brainard introduced Ordinance D-1424-9% An Ordinance Amending Chapter 8~ Article 9~
Section 8-120 oFthe Carreel City Code. There was no discussion. Ordinance D-1424-99 was approved
7-0.
Mayor Brainard introduced Ordinance D-1434-9% An Ordinance Creating a Tuition Reimbursement
Program For City Employees. There was no discussion. Ordinance D-1434-99 was approved 7-0.
Mayor Brainard introduced Ordinance D-1435-9% An Ordinance Amending Chapter 2~ Article 3~
Division IL Section 2-56 oFthe Carreel City Code. Councilor Battreall moved to amend the Ordinance
as per the attached amendment. Councilor Carlet seconded. Councilor Rundle asked Ms. Lamb For
clarification oFthe Ordinance. The amendment was approved 7-0.
Councilor Koven addressed the Council in opposition to the Ordinance. Councilor Rundle asked Ms.
Lamb to comment. Ms. Lamb explained the intention oFthe Ordinance. There was Council discussion.
Ordinance D-1435-99 was approved 6-1. Councilor Koven voted nay.
Mayor Brainard introduced Ordinance D-1436-9% An Ordinance Amending Chapter 7~ Article 3~
Section 7-10 oF and adding Section 7-27 to the Carreel City Code. There was no discussion. Ordinance
D-1436-99 was approved 7-0.
Mayor Brainard introduced Ordinance Z-33% An Ordinance Making Technical Amendments and Other
Corrective Changes to the Carreel/Clay Zoning Ordinance~ the Carreel/Clay Subdivision Control
Ordinance and the Carreel/Clay Floodplain Ordinance. There was no discussion. Ordinance Z-339 was
approved 7-0.
Mayor Brainard introduced Ordinance C-200~ Annexation oF Woodland Springs Christian Church.
There was no discussion. Ordinance C-200 was approved 7-0.
At 8:35p. m. the Cotmcil was adjottn~ed for a recess.

PUBLIC HEARINGS:
Mayor Brainard announced Ordinance D-1422-9% An Ordinance Establishing Bi-Weekly Salaries For
Elected OFficials For the Calendar Year 2000. Council President Snyder presented a summary oFthe
Ordinance. Councilor Battreall moved to introduce the Ordinance into business. Councilor Carlet
seconded.
The Public Hearing was opened at 8:57 p.m. Alan Potasnik reiterated his earlier comments. There were
no other public comments. The Public Hearing was closed at 8:57 p.m.
Council President Snyder and Councilors Koven and Battreall commented on the Ordinance.
Council President Snyder moved to amend the Ordinance so that salaries will be set every 4 years in the
year of an election for the next term, except for cost of living increases. There was Council discussion.
Councilor Rundle seconded. There was Council discussion. The amendment was approved 6-1.
Councilor Walker voted nay.
Council President Snyder recommended that an ordinance be considered to allow for Council and all
part-time City employees to purchase health insurance coverage through the City.
There was Council discussion.
Councilor Kirby moved to amend the Council Salary to $10,000.00 or $384.62 bi/weekly. Council
President Snyder seconded. There was Council discussion. The amendment was approved 6-1.
Councilor Koven voted nay.
Councilor Rundle briefly commented on the other Elected Official' s salaries.
Ordinance D-1422-99 was carried forward to the next meeting.
NEW BUSINESS
Mayor Brainard announced Ordinance D-1437-99; An Ordinance Amending Chapter 2, Article 2,
Section 2-21 (b) of the Carmel City Code. Council President Snyder presented a summary of the
Ordinance. Councilor Kirby moved to introduce the ordinance and to waive the reading of the
Ordinance. Councilor Battreall seconded. There was Council discussion. Ordinance D-1437-99 was
carried forward to the next meeting.
Mayor Brainard announced Ordinance D-1438-99; An Ordinance Amending Chapter 8, Article 3,
Section 8-15 of the Carmel City Code. Councilor Battreall moved to introduce the Ordinance into
business. Councilor Walker seconded.
Councilor Battreall presented a brief description of the Ordinance. He then moved to add Maplecrest to
the list of streets to be added to the City Code. Councilor Walker seconded. The amendment was
approved 7-0.
Councilor Rundle asked Carmel City Court Judge Gail Bardach to clarify the law regarding enforcement
of speed limits.
Judge Bardach explained the manner in which a speed limit is enforced in the City of Carmel. There
was Council Discussion.
Councilor Carter pointed out a typographical error in the ordinance. The listing of Cook Creek should
be Cool Creek.
Ordinance D-1438-99 was carried forward to the next meeting.
Councilor Kirby moved to approve Resolution CC-10-04-99-01; A Resolution Approving Payment of
Construction Costs for Hazel Dell Parkway. Councilor Walker seconded. Resolution CC-10-04-99-01
was approved 7-0.
Mayor Brainard summarized Resolution CC-10-04-99-02; A Resolution Declaring the Need for a
Housing Authority in the City of Carmel. Councilor Carter moved approval. Councilor Walker
seconded. There was Council discussion. Resolution CC-10-04-99-02 was approved 7-0.
OTHER BUSINESS:
Mayor Brainard summarized the add on item, Resolution CC-10-04-99-03.
Councilor Battreall moved to add on Resolution CC-10-04-99-03. Council President Snyder seconded.
There was Council discussion. Councilor Battreall called for the question. Resolution CC-10-04-99-03
was not added to the agenda because the vote was not unanimous. The vote was 4-2 with one
abstention. Council President Snyder and Councilors Battreall, Carter and Walker voted yea.
Councilors Kirby and Koven voted nay. Councilor Rundle abstained.
Councilor Rundle asked that when there are add-ons that the Councilors receive a courtesy call to let
them know there is an item to be added on, even if it is the same day. He then reminded the Council
about the deadline for filing the financial report for the Election Board. Clerk-Treasurer Diana Cordray
stated that she had spoken to the County Election Office and since there is not an election in Carmel, the
report is not required until the end of the year. There was Council discussion. Councilor Rundle
requested a written statement regarding filing requirements.
Council President Snyder asked the Council about decisions for the City inauguration. There was
Council discussion. Mayor Brainard stated that he is drafting a letter to Senator Richard Lugar on this
issue.
Councilor Kirby addressed the Council regarding Saturday Council sessions or extra Council sessions
for the remainder of the year and into next year. There was Council discussion. No decision was made.
ADJOURNMENT:
Councilor Walker moved to adjourn the meeting pending execution of documents. Councilor Kirby
seconded. The meeting was adjourned at 10:25 p.m.
