CARMEL CITY COUNCIL MEETING MINUTES
MONDAY, DECEMBER 6, 1999 -7 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James Brainard~ Councilors John Koven, Bob Battreall, Norm Rundie, Ron Carter and Billy
Walker. Deputy Clerk Robin Butler also attended. Clerk-Treasurer Diana Cordray attended the
beginning oFthe meeting. Council President Luci Snyder and Councilor Keyin Kirby arrived late.
Mayor Brainard called the meeting to order at 7~01 p.m. Councilor Walker pronounced the invocation.
Mayor Brainard led the Pledge oF Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
APPROVAL OF MINUTES:
Councilor Rundie moved to approve the minutes of the November 15, 1999 Regular Meeting.
Councilor Carter seconded. The minutes were approved 5-0

RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
Thomas L. Harleman oF 11080 Willowmere, addressed the Council opposing the activities surrounding
the City' s acquisition oF property For the Monon Trail.
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Carter expressed his appreciation For Councilor Walker who' s term is ending December 31,
1999.
Councilor Walker spoke in Favor oFthe Monon Trail project.
Mayor Brainard addressed several issues that were brought up by Mr. Harleman.
Mayor Brainard announced the winners For the 1999 Chuck Hole Contest. The winners were Mr. Bob
Giczewski and Ms. LeAnn Schelling Mr. Giczewski was present to accept his prize, a 1999 Carmel
Arts Festival umbrella. Ms. Schelling was not present, but will receive a one month sewer credit on her
utility bill From the City oF Carmel Utilities.
CLAIMS:
Council President Snyder moved to approve claims in the amounts oF $829,890.37 and $1,113,343.48.
Councilor Rundie seconded. Claims were approved 6-0.
COMMITTEE REPORTS:
Council President Snyder reported on the status oFthe changes being made by the Carmel/Clay Public
Library to relieve the noise generated by the chillers.
Mayor Brainard asked John Duffy, Director of Utilities, to report on the City' s Y2K readiness. Mr.
Duffy addressed the Council on that issue. There was Council discussion.
Councilor Battreall asked the Mayor about the Cable Television Board. Mayor Brainard reported that
the Cable Television Board has a meeting in January. He also stated that Time Warner Cable will be
requesting to exchange the Carmel service district for one in Florida which is owned by Comcast. An
audit will take place before any transfer occurs. This issue will be discussed at the meeting in January.
OLD BUSINESS:
Mayor Brainard introduced Ordinance C-201; Annexation of Old Meridian Property. There was no
Council Discussion. Ordinance C-201 was approved 6-0.
Mayor Brainard introduced Ordinance D-1443-99; Enacting and Adopting a Supplement to the Code of
Ordinances of the City of Carmel, Indiana. Councilor Koven brought a previous error in the City Code
to the attention of the Council. Clerk-Treasurer Diana Cordray announced that the City Code would be
available on the Internet beginning in January. Ordinance D-1443-99 was approved 6-0.
Mayor Brainard introduced Ordinance D-1444-99; Amending Chapter 9, Article 2, Division II, Section
9-3 l(a) and Chapter 9, Article 4, Section 9-197 of the Carmel City Code (re: Sewerage Reimbursement
for Legal Costs, etc.); There was no Council Discussion. Ordinance D-1444-99 was approved 6-0.
PUBLIC HEARINGS:
Mayor Brainard announced Ordinance C-202~ Annexation of Cherry Tree Estates. Councilor Carter
moved to introduce the ordinance. Council President Snyder seconded. The public hearing was opened
at 7:36 p.m. Seeing no one from the public who wished to speak, the public hearing was closed at 7:36
p.m. There was Council discussion. Adam DeI-Iart from Keeler-Webb Associates answered the
questions from the Council. Ordinance C-202 was carried over to the next regular meeting.
Cotmcilor Kirby arrived at this time.
NEW BUSINESS:
Mayor Brainard announced Ordinance D-1445-99; Amending Chapter 2, Article 3, Division II, Section
2-81 of the Carmel City Code (re: Salary Ordinance Amendments). Councilor Battreall moved to
introduce the ordinance. Council President Snyder seconded. Barb Lamb, Director of Human
Resources, explained the amendments. There was Council discussion. Ordinance D-1445-99 was
carried forward to the claims meeting on December 29th.
Mayor Brainard announced Ordinance D-1446-99; Amending Chapter 2, Article 3, Division II, Section
2-56 of the Carmel City Code (re: Deferred Compensation Matching Program Amendments). Councilor
Battreall moved to introduce the ordinance. Council President Snyder seconded. Ms. Lamb explained
the amendments. There was Council discussion. Councilor Rundle stated that he believed part-time
employees should not be allowed to participate in this benefit, but if it passes, he would take advantage
of the benefit; therefore, he will abstain from the vote on this issue. Ordinance D-1446-99 was carried
forward to the next regular meeting.
Mayor Brainard announced OrdinanceD- 1447-99; Amending Ordinance D- 1416-99, as Amended,
Regarding City Noise Regulations. Councilor Battreall moved to introduce the ordinance. Council
President Snyder seconded. Council President Snyder explained what this ordinance was amending.
Douglas Haney, City Attorney, commented on the ordinance. There was Council discussion. Ordinance
D-1447-99 was carried forward to the next regular meeting.
Mayor Brainard announced Ordinance D-1448-99; Amending Chapter 4, Article 3, Sections 4-72, 4-74,
4-75 and 4-76 of the Carmel City Code (re: Alarm System Permits). Councilor Carter moved to
introduce the ordinance. Councilor Walker seconded. Mayor Brainard called a recess since Councilor
Koven, the sponsor of this ordinance, had left the room.
The Council recessed at 7:17p.m.
The Council reconvened at 7:25 p. m.
Councilor Koven explained the changes that the ordinance made. There was Council discussion.
Ordinance D-1448-99 was carried over to the next regular meeting.
Mayor Brainard announced Ordinance A-85; Water Utility Budget. Councilor Battreall moved to
introduce the ordinance. Council President Snyder seconded. John Duffy, Director of Utilities, briefly
described the budget. There was Council Discussion. Ordinance A-85 was carried forward to the next
regular meeting.
Mayor Brainard announced Ordinance S-66; Sewer Utility Budget. Councilor Walker moved to
introduce the ordinance. Councilor Carter seconded. John Duffy, Director of Utilities, briefly described
the budget. There was Council Discussion. Ordinance S-66 was carried forward to the next regular
meeting.
Mayor Brainard announced Resolution CC-12-06-99-01; A Resolution to Amend the 2020
Comprehensive Plan to Establish a Specific Master Plan for an Area to be Called the Old Meridian
District. Council President Snyder moved to introduce the resolution. Councilor Kirby seconded. John
Schuller briefly described the resolution. There was Council discussion. Steve Nap, a property owner at
the north end of the Old Meridian Corridor, near St. Vincent' s Hospital was recognized by the Council
to voice his concerns with the resolution. Resolution CC-12-06-99-01 was approved 7-0. There was
further Council discussion.
Mayor Brainard announced Resolution CC-12-06-99-02; Transfer of Funds by the Clerk-Treasurer's
Office ($1,500 from Software Support Fees to Computer Hardware); Council President Snyder moved to
introduce the Resolution. Councilor Battreall seconded. Council President Snyder gave a brief
description of the request. Resolution CC-12-06-99-02 was approved 7-0.
Mayor Brainard announced Resolution CC-12-06-99-03; Additional Appropriation of Funds by the
Carmel Street Department ($4,685 from MVH to Electricity); Mayor Brainard corrected the title of the
resolution. He stated that although it says Additional Appropriation, it is actually a transfer of funds.
Councilor Battreall moved to introduce the resolution. Council President Snyder seconded. David
Klingensmith, Street Commissioner gave a brief description of the Resolution. Resolution CC- 12-06-
99-03 was approved 6-0.
OTHER BUSINESS:
Add On Item Resolution CC-12-06-99-04; Transfer of Funds by the Department of Law ($54,400 from
Wages and Benefits and a combined total of $1,000 from CapitiM Outlay, Office Equipment,
Communications Equipment and Furniture & Fixtures to Legal Fees); Councilor Battreall moved to add
the resolution to the agenda. Councilor Rundle seconded. Resolution CC-12-06-99-04 was not added to
the agenda as the vote was 5-2. Council President Snyder and Councilors Battreall, Rundle, Garter and
Walker voted in favor. Councilors Koven and Kirby voted against.
There was Council Discussion regarding meeting dates for December. It was decided that on December
20, 1999 the regularly scheduled meeting would take place. All items scheduled to carry forward to the
next Council meeting will be carried forward to December 20, 1999. There will also be a claims only
meeting on December 29, 1999.
ADJOURNMENT:
Councilor Rundle moved to adjourn the meeting, pending the execution of documents. Council
President Snyder seconded. The meeting was adjourned at 9:25 p.m.
