MINUTES
MONDAY, SEPTEMBER 17, 2001 - 7:00 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James Brainard; Council President Kevin Kirby; Council Members John Koven, Bob Battreall,
Norm R. undle, Luci Snyder, Ron Carlet and Wayne Wilson; Clerk-Treasurer Diana Cordray and Deputy
Clerk-Treasurer Cartie Gallagher.
Mayor Brainard called the meeting to order at 7:00 p.m.
Councilor Carter pronounced the Invocation.
Mayor Brainard led the Pledge oC Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
Mayor Brainard commended Carmel City emergency personnel who were quick to volunteer their efforts in
New York City following the tragedy of September 11, 2001. Although their immediate assistance was not
called upon, they await the word that they may travel to New York to offer their aid for our country.
Mayor Brainard advised that the City of Carmel and the Cannel Symphony Orchestra have coordinated a
memorial and prayer ceremony entitled, "A Time to Reflect", to help the community ~.n the healing process
following our national tragedy one week ago. The Ceremony will be on Tuesday, September 18, 2001, at
8:00 p.m. in the Carmel High School Auditorium. All citizens are encouraged to attend.
APPROVAL OF MINUTE S:
Councilor Snyder moved to approve the Minutes of the September 4, 2001 Regular Meeting. Councilor
Rundie seconded. The Minutes were approved 7-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
Tim StorV of 14265 Oakbrook Court, addressed the Council in support of its actions in representing the
priorities for the City.
Barbara Richards of 934 Shea Court, spoke on behalf of the League of Women Voters of Hamilton County
concerning social security.
Council President Kirby asked for a motion to accept an add-on item to the Agenda. Councilor Koven so
moved Councilor Snyder seconded. Resolution No. CC-09-17-01-04,' A Resolution of the Common
Council of the City of Carmel, Indiana, to Approve Funds for the American Red Cross' Disaster Relief Fund
on Behalf of the Citizens of Carmel, Indiana, was added to the Agenda b.v a vote of 7-O. Council President
Kirby then asked for a motion to suspend the rules and accept Resolution No. CC-09-17-01-04 at this point
in the Agenda. Councilor Koven moved as such and for approval of Resolution No. CC-09-17-01-04.
Councilor Snyder seconded the motions. Resolution No. CC-09-17-01-04 was approved 7-0. Mayor
Brainard, Carreel Ci.tv Council and Clerk-Treasurer Cordray presented a check in the amount of
$]0,000.00 to John Lyter, Chief Executive Officer of the American Red Cross of Greater Indianapolis. Mr.
Lyter expressed his acceptance and appreciation on behalf of the American Red Cross to Council and the
City of Carmel.
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Battreall commented on the remarks made in his absence at the last meeting of Council
concerning the proposed annexation of Western Clay Township.
CLAIMS:
Councilor Snyder moved to approve a claim in the amount of $1,828,808.22. Councilor Rundle seconded.
Claims were approved 7-0.
COMMITTEE REPORTS:
Councilor Rundle reported that the Administration Committee met on September 17, 2001, at which time
the Committee continued discussion regarding Ordinance No. D-1525-01, an ordinance amending employee
benefits. The next regular meeting of the Administration Committee is scheduled for October 15, 2001, at
8:30 a.m. in the Caucus Room.
Councilor Wilson reported that the Annexation and Land Use Committee met on September 13, 2001, at
which time there was brief discussion regarding proposed annexation Ordinance No. C-210. The next
regular meeting of the Annexation and Land Use Committee is scheduled for October 11~ 2001, at 7:00 p.m.
in the Caucus Room.
At this time, Councilor Wilson presented Mike Hollibaugh, Director of the Department of Community
Services, who addressed Council on behalf of the Plan Commission regarding the Illinois Street Corridor,
Resolution No. CC-07-16-01-02, and requested an additional 60 days to respond back to Council regarding
this subject matter. Councilor l, Vilson moved to extend the Plan Commission an additional 60 days per their
request. Councilor Snyder seconded. The motion was approved 7-0.
Councilor Snyder stated that the Economic Development Conunittee did not meet. The next regular
meeting of the Committee is scheduled for October 15,2001, at 6:00 p.m. in the Council's office.
Council President Kirby reported that the Finance Committee met on September 13,2001, at which time the
Committee discussed and reviewed each of the Salary Ordinances for the City for which the Committee
provided a unanimous recommendation for passage to the Council. The next regular meeting of the
Committee is scheduled for September 28, 2001; however, that meeting is canceled and rescheduled for
October 1, 2001, at 5:30 p.m. in the Clerk-Treasurer's Office.

Councilor Carter stated that the Parks and Recreation Committee has not met. The next regular meeting of
the Committee is scheduled for October 1, 2001, at 6:00 p.m. in the Caucus Room.
Councilor Battreall stated that the Public Safety Committee has not met. The next meeting of the
Committee is scheduled for October 15, 2001, at 10:00 a.m. in the Caucus Room.
Councilor Koven reported that the Rules Committee met at a Special Meeting of the Committee on
September 7, 2001, at which time discussion continued regarding the Indemnification Ordinance No. D-
1533-01. Councilor Koven recommended that the item remain in Committee for further consideration. The
next regular meeting of the Committee scheduled for September 28, 2001, at 9:30 a.m. in the Council's
office.
Council President Kirby stated that the Utilities and Transportation Committee has not met. The next
regular meeting of the Committee is scheduled for October 12, 2001, at 8:00 a.m. in the Council's Office.
OLD BUSINESS:
Council President Kirby announced the Second Reading of Ordinance No. D-1540-01; An Ordinance of the
Common Council of the City of Carmel, Indiana, for Appropriations and Tax Rates for the 2002 Budgets
($46,388,435.00). Councilor Koven moved to reduce the Information Systems Department, Website
Maintenance, from $42,000.00 to $0. Councilor Snyder seconded. The motion was approved 5-2.
Councilors Battreall and Carter voted in opposition. Councilor Wilson moved to transfer the line items
from the Community Relations into the Mayor's Department. Councilor Snyder seconded. There was
Council discussion. The motion to transfer all line items from Community Relations to the department of
the Mayor's Office was approved by a vote of 5-2. Councilors Battreall and Carter voted in opposition.
Councilor Carter then moved to those same line items to the Department of the Mayor's Office Budget.
Mayor Brainard expressed his agreement. Councilor Battreall seconded the motion. The motion was
approved 7-0. There was additional Council discussion concerning longevity and part-time hourly rates.
Councilor Snyder moved to reduce the hourly rate of pay from $18.00 per hour to $15.00 per hour and
adjust the Budget for 2002 accordingly. Councilor Koven seconded. There was discussion. The motion
was approved by a vote of 7-0. Councilor Wilson moved to allow the rate of longevity to remain at
$150.00, instead of increasing it to $160.00, and to again adjust the Budget for 2002 accordingly. There
was Council discussion. The motion was approved 6-1. Based on the approval of all reductions from the
Budget for 2002, Clerk-Treasurer Cordray advised the new Budget for 2002 is $44,329,525.00. Council
President Kirby called for the vote of the new budget amount. The Budget for 2002, in the amount of
$44,329,525.00, was approved by a vote of 7-0.
Council President Kirby announced the Second Reading of Ordinance No. D-1532-01; An Ordinance of the
Common Council of the City of Carmel, Indiana, Fixing the Salaries of the Appointed Officers and
Employees of the Carmel City Court, Carmel, Indiana, for the Year 2002. Councilor Wilson moved to
amend the Ordinance by reducing the Part-Time Hourly Rate of Pay to $15.00 and the Longevity amount
back to $150.00. Councilor Snyder seconded. The motion to amend was approved 6-1. Councilor Battreall
voted in opposition. Ordinance No. D-1532-01 was approved by a vote of 7-0.
Council President Kirby announced the Second Reading of Ordinance No. D-1531-01; An Ordinance of the
Common Council of the City of Carmel, Indiana, Fixing the Salaries of the Appointed Officers and
Employees of the Clerk-Treasurer, City of Carmel, Indiana, for the Year 2002. Councilor Wilson moved to
amend the Ordinance by reducing the Part-Time Hourly Rate of Pay to $15.00 and the Longevity amount
back to $150.00. Councilor Snyder seconded. The motion to amend was approved 6-1. Councilor Carter
voted in opposition. Ordinance No. D-1531-01 was approved by a vote of 7-0.
Council President Kirby announced the Second Readin~ of Ordinance No. D-1530-01; An Ordinance of the
Common Council of the City of Carmel, Indiana, Fixing the Salaries of the Appointed Officers and
Employees of the City of Carmel, Indiana, for the Year 2002. Councilor Wilson moved to amend the
Ordinance by reducing the Part-Time Hourly Rate of Pay for all departments of the City to $15.00, the
Longevity amount back to $150.00, and to move the Community Relations Department to the Department
of the Mayor's Office. Councilor Snyder seconded. The motion to amend was approved 6-1. Conncilor
Carter voted in opposition. Ordinance No. D-1530-01 was approved by a vote of 7-0.
Council President Kirby announced the Second Reading of Ordinance No. D-1535-01; An Ordinance of the
Common Council of the City of Carmel, Indiana, Establishing City "Rainy Day Fund" and Adding Chapter
2, Article 4, Section 2-124.4 to the Carmel City Code. There was extensive discussion. Ordinance No. D-
1535-01 was approved by avote of 5-2. Councilors Battreall and Cartervoted in opposition.
Council President Kirby announced the Second Readin~ of Ordinance No. Z-365-01; An Ordinance of the
' Common Council of the City of Cannel, Indiana, to Add New Provisions to the Cannel Clay Zoning
Ordinance (Ordinance No. Z-289) Creating a Park and Recreation District and Regulating Sexually Oriented
Businesses, Model Homes, Special Use Signs, Variance Signs, and Non-Conforming Signs and to Make
Several Procedural and Corrective Amendments to the Zoning Ordinance. Councilor Wilson requested and
moved that this item be withdrawn from the Agenda and remain in Committee. Councilor Snyder seconded.
Ordinance No. Z-365-01 was withdrawn from the Agenda and will remain in Committee.

NEW BUSINESS:

of the City of Carmel, Indiana, Continuing the City of Carmel Household Hazardous Waste Program.
Councilor Rundle moved to introduce this into business. Councilor Snyder seconded. Councilor Rundle
presented this matter to Council. There was discussion. Resolution No. CC-09-17-01-01 was approved 7-0.
Council President Kirby announced Resolution No. CC-09-17-01-02; A Resolution of the Common Council
of the City of Carmel, Indiana, Regarding Settlement of Cause No. D-01-9709-MI-542 (The Helen M.
Mueller Conservatorship). Councilor Snyder moved to introduce this item into business. Councilor Carter
seconded. Council President Kirby presented this matter to Council. Resolution No. CC-09-17-01-02 was
approved 7~0.
Council President Kirby announced Resolution No. CC-09-17-01-03; A Resolution of the Common Council
of the City of Carmel, Indiana, to Set the 2002 General Fund Tax Levy and Rate. Councilor Carter moved
to introduce this item into business. Councilor Battreall seconded. Councilor Carter presented this matter to
Council. There was Council discussion. Council President Kirby recommended this matter be referred to
Committee for further consideration. Councilor Rundle moved as such. Councilor Carter seconded.
Resolution No. CC-09-17-01-03 was referred to the Finance Committee by a vote of 7-0.
Clerk-Treasurer Cordray advised the Budget amount needs to be adjusted to $44,354,285.00. There was
Council discussion. Councilor Snyder moved to amend Ordinance No. D-1540-01,' An Ordinance of the
Common Council of the Ci.tv of Carmel, Indiana, for Appropriations and Tax Rates for the 2002 Budgets. to
reflect a final Budget amount of $44,354,285.00. Councilor Koven seconded The amendment was
approved 7-0.
OTHER BUSINESS:
There was none.
ANNOUNCEMENTS:
Mayor Brainard again invited the community to attend the memorial and prayer ceremony, "A Time to
Reflect", to assist in the healing process following our national tragedy of a week ago. The Ceremony is
scheduled for Tuesday, September 18, 2001, at 8:00 p.m. in the Carmel High School Auditorium.
ADJOURNMENT:
Council President Kirby turned the meeting over to the Mayor for adjournment pending the execution of
documents. The meeting was adjoumed at 8:33 p.m.
