COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE MEMBERS PRESENT: Mayor James Brainard; Council President Keyin Kirby; Council Members John Koven, Bob BattreaI1, Norm Rundle, Luci Snyder, Ron Carlet and Wayne Wilson; Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer Came Gallagher. Mayor Brainard called the meeting to order at 7:00 p.m. Councilor Carter pronounced the Invocation. Mayor Brainard led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: APPROVAL OF MINUTES: Councilor Rundle moved to approve the Minutes of the September 17, 2001 Regular Meeting. Councilor Snyder seconded. The Minutes were apprnved 7-0. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL: Barbara R.ichards of 934 Shea Court, spoke on behalf of the League of Women Voters of Hamilton County concerning PSI. COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS: CLAIMS: Councilor Snyder moved to approve claims in the amount of $ 246,739.10 and $1,755,442.70. Councilor Rundle seconded. Councilor Koven moved to withdraw specific claim requests from the second claims mn in the amounts of $10,306.20 and $11,747.35, for Barnes & Thornburg, and $3,500.00, for Campbell Kyle & Profrill. There was Council discussion. Councilor Snyder seconded the motion to delete the aforementioned amounts from the second claims run. The claims requests in the amounts of $10,306.20, $11,747.35 and $3,500.00 were deleted from the claims rnn by a vote of 7-0. Councilor Snyder then moved to amend the second claim to reflect the amount of $1,729,889.15. Councilor Rundle seconded. There was no discussion. The new claim amount was apprnved 7-0. Councilor Wilson moved to approve claims, as read. Councilor Snyder seconded. Claims were approved 7-0. COMMITTEE REPORTS: Councilor Rundle stated that the Administration Committee has not met. The next regular meeting of the Administration Committee, scheduled for October 15, 2001, is canceled. Councilor Wilson stated that the Annexation and Land Use Committee has not met. The next regular meeting of the Annexation and Land Use Committee, scheduled for October 11, 2001, is canceled and rescheduled for October 18, 2001, at 7:00 p.m. in the Caucus Room. Councilor Snyder stated that the Economic Development Committee has not met. The next regular meeting of the Economic Development Committee, scheduled for October 15,2001, is canceled. Council President Kirby reported that the Finance Committee met on October 1, 2001, at which time the Committee discussed the Tax Levy Resolution for 2002, for which the Committee provided a negative recommendation to the Council. The next regular meeting of the Finance Committee is scheduled for October 26~ 2001, at 8:00 a.m. in the Clerk-Treasurer's Office. Councilor Carter stated that the Parks and Recreation Committee has not met. The next regular meeting of the Parks and Recreation Committee is scheduled for November 5, 2001, at 6:00 p.m. in the Caucus Room. Councilor Battreall stated that the Public Safety Committee has not met. The next meeting of the Public Safety Committee, scheduled for October 15, 2001, is eanceled. Councilor Koven stated that the Rules Committee has not met. The next regular meeting of the Rules Committee is scheduled for October 26, 2001, at 9:30 a.m. in the Council's office. Council President Kirby stated that the Utilities and Transportation Committee has not met. The next regular meeting of the Utilities and Transportation Committee, scheduled for October 12, 2001, is canceled. OLD BUSINESS: There was none. PUBLIC HEARINGS: There was none. NEW BUSINESS: Council President Kirby announced the Introduction of Annexation Ordinance No. C-211; An Ordinance of the Common Council of the City of Carreel, Indiana, Annexing Certain Territory to the City of Cannel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Cannel (I-465 to 96tn Street). Councilor Wilson moved to introduce this item into business. Councilor Koven seconded. Councilor Wilson presented this matter to Council. There was brief discussion. Councilor Koven moved to suspend the rules sending this matter to Committee. Councilor Snyder seconded the motion to suspend the rules. The rules were suspended by a vote of 7-0. Annexation Ordinance No. C- 211 will return to Council for First Reading and Public Hearing upon expiration of the 60-day remonstration period. Council President Kirby announced the Introduction of Annexation Ordinance No. C-212; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Carmel (USTA~Five Seasons). Councilor Wilson moved to introduce this item into business. Councilor Snyder seconded and presented this matter to Council. Councilor Koven moved to suspend the roles sending this matter to Committee. Councilor Snyder seconded. The rules were suspended by a vote of 7-0. Annexation Ordinance No. C-212 will return to Council for First Reading and Public Hearing upon expiration of the 60-day remonstration period. Resolution No. CC-10-01-01-03 was approved 7-0. Council President Kirby announced Resolution No. CC-10-01-01-04; A Resolution of the Common Council of the City of Carmel, Indiana, Adopting a Fiscal Plan for the Annexation of Property Contiguous to the City of Carmel, Indiana (Morgan-Hart Area). Councilor Koven moved to introduce this item into business. Councilor Snyder seconded. Councilor Koven presented this matter to Council. There was no discussion. Resolution No. CC-10-01-01-04 was approved 7-0. Council President Kirby announced Resolution No. CC-10-01-01-05; A Resolution of the Common Council of the City of Carmel, Indiana, Adopting a Fiscal Plan for the Annexation of Property Contiguous to the City of Carmel, Indiana (South Monon Trail Area). Councilor Wilson moved to introduce this item into business. Councilor Snyder seconded and presented this matter to Council. There was discussion. Resolution No. CC-10-01-01-05 was approved 7-0. Mayor Brainard advised that a correction is necessary for Resolution No. CC-10-01-01-04, the Fiscal Plan for Annexation Ordinance No. C-214. There was Council discussion. Council President Kirby recommended that a revised Resolution be prepared and presented to Council at a later date, since the present Resolution has already been approved. Then, at that time, Council may withdraw the approved Resolution and accept the new, revised Resolution. Council President Kirby announced Resolution No. CC- 10-01-01-06; A Resolution of the Common Council of the City of Carmel, Indiana, Authorizing the Payment of Fiscal Year 2000 Claim from Fiscal Year 2001 Funds ($3,500.00). Councilor Wilson moved to introduce this item into business. Councilor Snyder seconded. Councilor Rundle recommended that this matter be forwarded to the Finance Committee for further review and consideration of the claim. There was extensive Council discussion. Resolution No. CC-10-01-01-06 was forwarded to the Finance Committee by a vote of 4-3. (Councilors Kirby, Carter and Battreall voted in opposition.) Council President Kirby announced Resolution No. CC-10-01-01-07; A Resolution of the Common Council of the City of Carmel, Indiana, Supporting and Endorsing the Interim Report of the U.S. 31 Task Force to be Submitted to the State of Indiana in Regard to the State's Proposed Improvements to U.S. Highway 31. Councilor Wilson moved to introduce this item into business. Councilor Snyder seconded and presented this matter to Council. There was no discussion. Resolution No. CC- 10-01-01-08 was approved 7-0. Council President Kirby announced Resolution No. CC-10-01-01-09; A Resolution of the Common Council of the City of Carmel, Indiana, to Set the 2002 General Fund Tax Levy and Rate (formerly Resolution No. CC-09-17-01-03). Councilor Carter moved to introduce this item into business. Councilor Battreall seconded. Councilor Carter presented this matter to Council. There was brief Council discussion. Resolution No. CC-10-01-01-09 was defeated 2-5. (Councilors Kirby, Koven, Rundle, Snyder and Wilson voted in opposition.) OTHER BUSINESS: There was none.
