COMMON COUNCIL MEETING
MINUTES
MONDAY, DECEMBER 3, 2001 - 7:00 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James Brainard; Council President Keyin Kirby; Council Members John Koven, Bob Battreall,
Norm Rundle, Luci Snyder, Ron Carlet and Wayne Wilson; Clerk-Treasurer Diana Cordray and Deputy
Clerk-Treasurer Cartie Gallagher.
Mayor Brainard called the meeting to order at 7:00 p.m.
Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
Mayor Brainard recognized the following members of the Cannel community
accomplishments:
for their recent
Marsha Brooks received an Outstanding Citizen Award as winner of Emeril Lagasse's National
Contest "Pie of Emeril's Eye";
Christine Latta also received an Outstanding Citizen Award as winner of the First National Pillsbury
Kids Bake-Off Contest;
Carmel High School Marchin~ Band Members received a Certificate of Achievement for taking First
Place at State and Runner-Up at the National Marching Band Competitions. Drum Majors Beth
Doctor, Jordan David and Adam Hammer received awards on behalf of the band;
Carmel High School Greyhound Tennis Team also received a Certificate of Achievement as State
Champs. Head Coach Mike Bostic received the award on behalf of the team;
Carreel Hig-.h School Lady Greyhound Cross Country Team received a Certificate of Achievement as
State Champs. Head Coach Chuck Koeppen received the award on behalf of the team;
Carmel High School Lady Greyhound Soccer Team received a Certificate of Achievement as well as
State Champs. Head Coach Frank Dixon received the award on behalf of the team;
Bob Giczewski received an Outstanding Citizen Award as the winner of the Annual Carmel City
Chuck Hole Contest. In turn, Mr. Giczewski presented Mayor Brainard and the City Council with
an Outstanding Achievement Award for their service to the City in maintaining and improving the
streets of Carmel.
APPROVAL OF MINUTES:
Councilor Battreall moved to approve the Minutes of the November 19, 2001 Regular Meeting. Councilor
Snyder seconded. The Minutes were approved 7-0.
RECOGNITION OF PERSONS WHO V~ISH TO ADDRESS THE COUNCIL:
Judy Hagan, Clay Township Trustee, addressed Council regarding the Parks Resolution on tonight's Agenda
and other matters concerning fiscal issues.
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Koven responded to the fiscal issue between the City of Cannel and Clay Township and provided
a table of balance/budget numbers for the General Fund, a copy of which is made an attachment to the
original Minutes of this meeting. Mayor Brainard responded in turn to Mr. Koven's comments. Mr. Koven
spoke in reply to Mayor Brainard. Councilor Carter also commented with regard to the same issue.
Councilors Snyder and Wilson both advised of some concerns with regard to budgets.
CLAIMS:
Councilor Snyder moved to approve a claim in the amount of $262,740.63.
Claims were approved 7-0.
Councilor Rundie seconded.
COMMITTEE REPORTS:
Councilor Rundle stated that the Administration Committee has not met. The next regular meeting of the
Administration Committee is scheduled for December 17, 2001, at 8:30 a.m. in the Caucus Room.
Councilor Wilson reported that the Annexation and Land Use Committee met on November 29, 2001, to
further discuss proposed annexation Ordinance No. C-210. The next regular meeting of the Annexation and
Land Use Committee is scheduled for December 13, 2001, at 7:00 p.m. in the Caucus Room.
Councilor Snyder stated that the Economic Development Committee has not met. The next regular meeting
of the Committee is scheduled for December 17, 2001, at 6:00 p.m. in the Council's office.
Council President Kirby reported that the Finance Committee met in a Special Meeting on December 3,
2001, to discuss the Communications Center cellular phone agreement as well as the City Capitalization
Fund Ordinance, which will be brought back to the Agenda at the next meeting of Council.
Councilor Carlet reported that the Parks and Recreation Committee met on December 3, 2001, at which
time they discussed the movement of fiscal matters for the Parks DeparLrnent from Clay Township to the
City. The Committee provided no comments and/or votes at this time. There was also discussion
concerning a possible discrepancy in the Parks Budget. The Parks and Recreation Committee is not
scheduled to meet for the remainder of the year.
Councilor Battreall reported that the Public Safety Committee also met on December 3, 2001, to discuss
Ordinance No. D-1543-01 (Solicitation in Streets Prohibited) for which the Committee voted unanimously
in favor of its passage to the Council. The Committee also discussed Ordinance No. D-1544-01 (Jake
Brakes) and voted unanimously to send a negative recommendation for its passage to Council and there was
continued discussions regarding the issue of security at City Hall. The Public Safety Committee is not
scheduled to meet for the remainder of the year.
Councilor Koven stated that the Rules Committee has not met. The next regular meeting of the Committee
is scheduled for December 28, 2001, at 9:30 a.m. in the Council's office.
Council President Kirby also stated that the Utilities and Transportation Committee has not met. The next
regular meeting of the Committee is scheduled for December 14, 2001, at 8:00 a.m. in the Council's Office.
OLD BUSINESS:
Council President Kirby announced the Second Readin~ of Ordinance No. D-1543-01; An Ordinance of the
Common Council of the City of Carmel, Indiana, Adding Section 6-67 to the Carmel City Code (Solicitation
in Streets Prohibited). There was no Council discussion. Ordinance No. D-1543-01 was approved 7-0.
Council President Kirby announced the Second Readin~ of Ordinance No. D-1544-01; An Ordinance of the
Common Council of the City of Carmel, Indiana, Adding Chapter 8, Article 7, Section 8-70 to the Carmel
City Code (Compression Release Engine Brakes Prohibited). Council President Kirby presented this matter
to Council. Councilor Battreall advised of some inconsistencies with the Ordinance and stated that the
Committee recommended no passage of this Ordinance as written, by a vote of 0-3. Councilor Battreall
also advised that the Committee recommended the possibility of addressing the Noise Ordinance as an
alternative. There was Council discussion. Ordinance No. D-1544-01 was defeated by a vote of 0-7.
Council President Kirby announced the Second Reading of Ordinance No. D-1547-01; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 3, Division V, Section 2-
81(c) of the Carmel City Code (Meeting Stipend). Councilor Wilson advised this matter simply needs
action by Council and recommended its withdrawal. Council President Kirby called for the question.
Ordinance No. D-1547-01 was defeated by a vote of 0-7.
PUBLIC HEARINGS:
There were none.
NEW BUSINESS:
Council President Kirby announced the First Reading of Ordinance No. D-1548-01; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 1, Division II, Section 2-9 of
the Carmel City Code (Deputy Mayor). Councilor Rundle moved to introduce this item into business.
Councilor Wilson seconded. Councilor Koven presented this matter to Council. There was brief discussion.
Councilor Rundie moved to suspend the rules sending this matter to Committee. Councilor Snyder
seconded. The rules sending this matter to Committee were suspended by a vote of 7-0. Ordinance No. D-
1548-01 will mmm to the next meeting of Council.
Council President Kirby announced Resolution No. CC-12-03-01-01; A Resolution of the Common Council
of the City of Carmel, Indiana, Regarding Parks Fiscal Matters. Councilor Snyder moved to introduce this
item into business. Councilor Koven seconded. Councilor Snyder presented this matter to Council and
advised this matter was also thoroughly discussed in the meeting of the Parks and Recreation Committee on
December 3, 2001. There was extensive Council discussion. Sue Beesley, counsel to the City Council,
responded to questions and concerns. Councilor Koven moved to strike the following words on Page One,
Last Paragraph, Lines Five and Six: "the Clay Township Board and". Councilor Snyder seconded. There
was Council discussion. The motion to strike was approved by a vote of 5-2, Councilors Rundle and Carter
voted in the opposition. Council discussion continued. Councilor Battreall then moved to strike the
following words on Page One, Last Paragraph, Line Six: "the Common Council of the City of Carmel".
Councilor Carter seconded. The second motion to strike was also approved by a vote of 4-3, Councilors
Koven, Snyder and Wilson voted in the opposition. There was no further discussion. Resolution No. CC-
12-03-01-01 was approved, as fully amended, 7-0.
Council President Kirby announced Resolution No. CC-12-03-01-02; A Resolution of the Common Council
of the City of Carmel, Indiana, Approving Payment of Construction Costs for Hazel Dell and Pennsylvania
Bond Project ($275,000.00). Councilor Rundle moved to introduce this item into business. Councilor
Battreall seconded. Councilor Rundle presented this matter to Council. There was Council discussion.
Resolution No. CC-12-03-01-02 was approved 7-0.
Council President Kirby advised that Resolution No. CC-12-03-01-03 (Formerly Resolution No. CC-11-05-
01-07); A Resolution of the Common Council of the City of Carmel, Indiana, Amending Resolution No.
CC-07-16-01-08, Regarding the Illinois Street Corridor, is still in Committee.
OTHER BUSINESS:
Councilor Carter moved to add-on to the Agenda Ordinance No. D-1549-01; An Ordinance of the Common
Council of the City of Carmel, Indiana, Amending Ordinance No. D-1538-01 (An Ordinance Amending the
Carreel City Code Chapter 8, Article 5, Sections 8-45 through 8-54, Inclusive, and Sections 8-58, Inclusive,
and Chapter 8, Article 8, Sections 8-91 through 8-93, Inclusive). Councilor Battreall seconded the motion
to add Ordinance No. D-1549-01 to the Agenda. Councilor Wilson presented this matter to Council and
advised of an immediate need to amend the Parking Ordinance. There was brief discussion. Councilor
Battreall moved to suspend the rules sending this matter to Committee and act on this matter immediately.
Councilor Snyder seconded. The motion to suspend the rules and act on this matter immediately was
approved by a vote of 7-0. There was continued discussion. City Attorney Douglas Haney responded to
Council questions and concerns. Ordinance No. D-1549-01 was approved 7-0.
ANNOUNCEMENTS:
Councilor Carter stated that the Carmel Farmer's Market was recognized in the "Best of Indy" article in the
December issue of Indianapolis Monthly.
ADJOURNMENT:
Council President Kirby turned the meeting over to the Mayor for adjournment pending the execution of
documents. The meeting was adjourned at 8:58 p.m.
