First Reading of Ordinance No. Z-377-02; An Ordinance of the Common Council of the City of Carmel, Indiana, Rezoning District Classification (Rezoning 4.066+ acres on the northeast comer of West Main Street and U.S. Highway 31 from the S-2/Residence District Classification within the U.S. Highway 31 Corridor Overlay Zone to the B-2/Business District Classification within the U.S. Highway 31 Corridor Overlay Zone); Sponsor: Council President Wilson CITY OF CARMEL COMMON COUNCIL MEETING MINUTES MONDAY, APRIL 1, 2002 - 7:00 COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE MEMBERS PRESENT: Mayor James Brainard; Council President Wayne Wilson; Council Members John Koven, Norm Rundle, Luci Snyder and Ron Carter; Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer Carrie Gallagher. Councilors Bob Battreall and Kevin Kirby were absent. Mayor Brainard called the meeting to order at 7:01 p.m. Council President Wilson pronounced the Invocation. Mayor Brainard led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: APPROVAL OF MINUTES: Councilor Rundle moved to approve the Minutes of the March 18, 2002 Special Meeting. Councilor Snyder seconded. The Minutes were approved 4-0. Councilor Carter stepped out of the meeting just before the vote. RECOGNITION OF PERSONS WHO WISH TO ADDRESS Tm~ COUNCIL: David Klingensmith, Carmel Street Commissioner, addressed Council regarding the Street Department's future building rental needs and requested their consideration of a future transfer Resolution necessary to off-set the additional expense. COUNCIL~ MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS: Mayor Brainard reported that an agreement has been reached between the cities of Carmel and Indianapolis and approved by the Indiana Regulatory Commission for the IWC purchase. CLAIMS: Councilor Snyder moved to approve claims in the amounts of $271,677.15 and $1,073,418.60. Councilor Rundle seconded. Claims were approved 5-0. COMMITTEE REPORTS: Councilor Rundle stated that the Administration Committee has not met. The next regular meeting of the Administration Committee is scheduled for April 12, 2002, at 8:00 a.m. in the Caucus Room. Councilor Wilson reported that the Annexation and Land Use Committee met on March 21, 2002, at which time the Committee reviewed several zoning Ordinances and a Resolution, all of which are returning to Council tonight with a unanimous recommendation for approval. The next regular meeting of the Annexation and Land Use Committee is scheduled for Thursday, April 11, 2002, at 7:00 p.m. in the Caucus Room. Councilor Snyder reported that the Economic Development Committee met on March 25, 2002, to initiate discussions with a company interested in relocating to the City of Carmel. The next regular meeting of the Committee is scheduled for April 15, 2002, at 6:00 p.m. in the Caucus Room. Council President Wilson reported that the Finance Committee met in a Special Meeting on March 21, 2002, at which time they discussed the Parks Joinder Agreement. The next regular meeting of the Committee is scheduled for May 6, 2002, at 4:00 p.m. in the Clerk-Treasurer's Office. Councilor Carter reported that the Parks and Recreation Committee met on April 1, 2002, to continue discussions regarding the Parks Joinder Agreement. The next regular meeting of the Committee is scheduled for May 6, 2002, at 6:00 p.m. in the Caucus Room. Council President Wilson advised on behalf of Committee Chairperson, Councilor Battreall that the Public Safety Committee has not met. The next regular meeting of the Committee is scheduled for May 6, 2002, at 10:00 a.m. in the Caucus Room. Councilor Koven stated that the Rules Committee has not met. The next regular meeting of the Committee is scheduled for April 26, 2002, at 8:00 a.m. in the Council's office. Council President Wilson stated on behalf of Committee Chairperson, Councilor Kirby that the Utilities and Transportation Committee has not met. The next regular meeting of the Committee is scheduled for April 12, 2002, at 8:00 a.m. in the Caucus Room. There was no discussion. Ordinance No. Z-372-02 was approved 5-0. Council President Wilson announced the Second Reading of Ordinance No. Z-373-02; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Certain Provisions of Chapter 20F: C-2/Old Town District of the Cannel/Clay Zoning Ordinance. There was no discussion. Ordinance No. Z-373-02 was approved 5-0. Council President Wilson announced the Second Reading of Ordinance No. Z-374-02; An Ordinance of the Common Council of the City of Carmel, Indiana, Adopting Chapter 23D: Old Town District Overlay Zone of the Carmel/Clay Zoning Ordinance. Councilor Koven stated concerns regarding this matter. There was no further discussion. Ordinance No. Z-374-02 was approved 5-0. Council President Wilson announced the Second Reading of Ordinance No. Z-375-02; An Ordinance of the Common Council of the City of Cannel, Indiana, Adopting Chapter 23E: Home Place District Overlay Zone of the Carmel/Clay Zoning Ordinance. Councilor Koven reiterated his concerns for this matter. There was no additional discussion. Ordinance No. Z-375-02 was approved 5-0. Council President Wilson announced the Second Reading of Ordinance No. Z-376-02; An Ordinance of the Common Council of the City of Carmel, Indiana, Rezoning the Lumberyard Mall from the I-l/Industrial Classification to the C-2/Old Town District Classification. There was no discussion. Ordinance No. Z-376- 0~2 was approved 5-0. Council President Wilson announced Resolution No. CC-04-01-02-01 (Formerly Resolution No. CC-03-18- 02-01}; A Resolution of the Common Council of the City of Carmel, Indiana, Approving an Amendment to the Carmel/Clay Comprehensive Plan Regarding the Home Place District. There was brief discussion. Resolution No. CC-04-01-02-01 was approved 5-0. Councilor Rundle moved to introduce this item into business. Councilor Snyder seconded. Jon Dobosiewicz of the Department of Community Services presented this matter to Council. Council President Wilson opened the matter for Public Hearing at 7:30 p.m. Seeing no one who wished to speak, he closed the Public Heating at 7:31 p.m. Councilor Koven expressed concern to move forward with zoning amendments prior to the financial aspect of the settlement issue being resolved. Mayor Brainard responded and recommended that this matter go to Committee for further review and consideration. Councilor Koven moved to table the matter instead. There was extensive Council discussion. Councilor Koven withdrew his motion to table. Council President Wilson referred Ordinance No. Z-377-02 to the Annexation and Land Use Committee for extensive review and consideration. NEW BUSINESS: Council President Wilson announced the First Reading of Ordinance No. D-1564-02; An Ordinance of the Common Council of the City of Carmel, Indiana, Establishing Certain Stop and Yield Intersections. Councilor Rundle moved to introduce this item into business. Councilor Snyder seconded. David Klingensmith, Caxmel Street Commissioner, presented this matter to Council. There was Council discussion and questions to which Mr. Klingensmith responded. Upon no further discussion, Council President Wilson referred Ordinance No. D-1564-02 to the Utilities and Transportation Committee for review and consideration. Council President Wilson announced the First Reading of Ordinance No. D-1565-02; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 8, Article 3, Sections 8-20 and 8-21 of the Carmel City Code (Street Names). Councilor Rundle moved to introduce this item into business. Councilor Snyder seconded. There was no discussion. Council President Wilson referred Ordinance No. D- 1565-02 to the Utilities and Transportation Committee for review and consideration. Council President Wilson advised that he was aware that Councilor Kirby, sponsor of the two Ordinances listed above under New Business, was not present to introduce each item into business per the rules of Ordinance No. D-1558-02; however, due to the presence of the David Klingensmith, Carmel Street Commissioner, Council President Wilson felt it was necessary to move forward at the meeting. OTHER BUSINESS: ANNOUNCEMENTS: ADJOURNMENT: Council President Wilson turned the meeting over to the Mayor for adjournment pending the execution of documents.
