MINUTES
MONDAY, MAY 6, 2002 -- 7:00 P.M.
COUNCIL CHAMBERS / CITY HALL [ ONE CIVIC SQUARE
MEMBERS PRESENT:
Council President Wayne Wilson; Council Members Kevin Kirby, John Koven, Bob Battreall, Norm
Rundle, Luci Snyder and Ron Carter; Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer Carrie
Gallagher. Mayor James Brainard was absent.
Council President Wilson called the meeting to order at 7:04 p.m.
Council President Wilson pronounced the Invocation.
__ Council President Wilson led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There was none.
Council President Wilson presented an Add-On Item for tonight's Agenda. Councilor Koven moved to add
the item, Resolution No. CC-05-06-02-01, to the Agenda. Councilor Snyder seconded. The Resolution was
added to the Agenda by a vote of 6-O. (Councilor Kirby was not present for the vote.)
APPROVAL OF MINUTES:
Councilor Rundle moved to approve the Minutes of the April 15, 2002 Regular Meeting. Councilor Koven
seconded. The Minutes were approved 6-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
James O'Neal of 11318 Lakeshnre Drive East, addressed Council in favor of breaking the Parks Joinder
Agreement.
Sally Bratton of 11535 Ralston Avenue, spoke in opposition of breaking the Parks Joinder.
__ Harold Bunger of 1170C Golfview Drive, addressed Council regarding a complaint involving Clay
Township Trustee, Judy Hagan.
COUNCIL~ MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Snyder encouraged the community to vote.
Council President Wilson commented on the recent heliport article and statements made by Mayor Brainard.
Councilor Kevin Kirby entered the meeting at 7:24p. m.
ACTION ON MAYORAL VETOES:
Council President Wilson presented vetoed Ordinance No. D-1560-02; An Ordinance of the Common
Council of the City of Carmel, Indiana, Concerning Parks and Recreation (Dissolution) and provided a
summary of the matter. There was Council discussion and comment. Ordinance No. D-1560-02 was
approved by a vote 5-2, to override the Mayor's veto. Councilors Battreall and Carter voted in opposition of
the override.
CLAIMS:
Councilor Snyder moved to approve claims in the amounts of $452,785.28, $714,252.51 and $1,259,241.47.
Councilor Rundle seconded. Claims were approved 7-0.
COMMITTEE REPORTS:
Councilor Rundle stated that the Administration Committee has not met. The next regular meeting of the
Administration Committee, scheduled for May 10, 2002, is canceled.
Councilor Wilson stated that the Annexation and Land Use Committee has not met since the last meeting of
Council. The next regular meeting of the Committee is scheduled to meet on May 9, 2002, at 7:00 p.m. in
the Caucus Room.
Councilor Snyder stated that the Economic Development Committee has not met. The next regular meeting
of the Committee is scheduled for May 20, 2002, at 6:00 p.m. in the Caucus Room.
Council President Wilson stated that the Finance Committee met on April 22, 2002, for further review and
consideration of Ordinance No. D-1567-02. The Committee discussed a possible amendment of the
document to be presented to Council at a later date. The next regular meeting of the Committee is
scheduled for June 3, 2002, at 4:00 p.m. in the Clerk-Treasurer's Office.
Councilor Carter stated that the Parks and Recreation Committee was scheduled to meet on this date;
however, the meeting was canceled in order to attend an Executive Session of the Council scheduled for the
same time. The next regular meeting of the Committee is scheduled for June 3, 2002, at 6:00 p.m. in the
Caucus Room.
Councilor Rundle reported on behalf of Committee Chairperson, Councilor Battreall, that the Public Safety
Committee met on this date, to discuss Ordinance No. D-1557-02. The Committee proposed an amendment
to the document which will be presented at the time the item appears on tonight's agenda. The next regular
meeting of the Committee is scheduled for June 3, 2002, at 10:00 a.m. in the Caucus Room.
Councilor Koven stated that the Rules Committee has not met; however, discussion was held regarding the
preliminary study of redistricting the Council districts. The next regular meeting of the Committee is
scheduled for May 24, 2002, at 8:00 a.m. in the Council's office.
Councilor Kirby reported that the Utilities and Transportation Committee met on April 19 and 26, 2002.
Council President Wilson advised that there was discussion of several matters during those times; however,
no action was taken since a majority of the Committee members were not present. The next regular meeting
of the Committee is scheduled for May 10, 2002, at 8:00 a.m. in the Caucus Room.
OLD BUSINESS:
Council President Wilson announced the Second Reading of Ordinance No. D-1557-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Amending Chapter 6, Article 5, Division II, Section 6-
88 of the Carmel City Code (Removal of Rank Vegetation, Weeds and Debris). Councilor Carter presented
this matter to Council and introduced an amended document to be considered in place of the orig/nal
Ordinance. There was brief discussion. Councilor Snyder moved to accept the amended Ordinance for
consideration, which simply adds a new Section 6-88(b), which reads, (b) It is a violation of this Section to
have Weeds, Rank Vegetation and/or Debris on any real property ("Property'9 located within the City's
-- corporate limits., and renumbers the remaining items. Councilor Koven seconded. The motion was
approved by a vote of 7-0. There was no additional discussion. Ordinance No. D-1557-02, As Amended
was approved 7-0.
Council President Wilson announced the Second Reading of Ordinance No. D-1568-02, As Amended; An
Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 9, Article 3, Division
V, Section 9-166 of the Carmel City Code (Residential Users of Sewer Service - Sprinkling Rate).
Councilor Koven presented this matter to Council. There was no discussion. Ordinance No. D-1568-02, As
Amended, was approved by a vote of 7-0.

City of Carmel (USTA/Five Seasons). Councilor Koven provided a brief summary of this matter. Mike
Shaver of Wabash Scientific presented the details to Council. Council President Wilson opened the matter
for Public Heating at 8:07 p.m. The following person addressed Council:
Robert Daniels of Tabbert Hahn Earnest & Weddle, LLP, on behalf of his client, Five
Seasons, addressed Council in opposition of the proposed armexation and advised that, if
necessary, his client will remonstrate;
-- Seeing no one else who wished to speak, Council President Wilson closed the Public Heating at 8:10 p.m.
There was no Council discussion. Ordinance No. C-212 will return to Council upon the expiration of 30
days.
Council President Wilson announced the First Reading of Annexation Ordinance No. C-214; An Ordinance
of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of Carmel,
Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the
City of Carmel (Morgan-Hart Area). Councilor Koven provided a brief summary of this matter. Mike

for Public Hearing at 8:21 p.m. The following person addressed Council:
David Belford of 11232 Westminster Way, addressed Council in favor of the proposed
annexation;
Seeing no one else who wished to speak, Council President Wilson closed the Public Heating at 8:23 p.m.
There was no Council discussion. Ordinance No. C-214 will return to Council upon the expiration of 30
days.
NEW BUSINESS:
Council President Wilson announced the First Reading of Ordinance No. D-1569-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 4, Section 2-96 of the
Carmel City Code (Carmel Fire Department Fees). Councilor Battreall moved to introduce this item into
business. Councilor Snyder seconded. Councilor Battreall presented this matter to Council. There was no
discussion. Council President Wilson referred Ordinance No. D-1569-02 to the Public Safety Committee
for further review and consideration.
Council President Wilson announced the First Reading of Ordinance No. D-1570-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Establishing an Ordinance Violation Deferral Program Fee
Fund. Councilor Carter moved to introduce this item into business. Councilor Battreall seconded and
presented this matter to Council. There was no discussion. Council President Wilson referred Ordinance
No. D-1570-02 to the Finance Committee for further review and consideration.
Council President Wilson announced the First Reading of Ordinance No. D-1573-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Creating and Adopting Chapter 8, Article 4, Section 8-39
of the Carmel City Code (Authorized Speed Hump Locations). Councilor Rundle moved to introduce this
item into business. Councilor Carter seconded. Councilor Rundle presented this matter to Council and
recommended that it be referred to Committee. There was no additional discussion. Council President
Wilson referred Ordinance No. D-1573-02 to the Public Safety Committee for further review and
consideration.
OTHER BUSINESS:
Council President Wilson announced Add-On Item Resolution No. CC-05-06-02-01, A Resolution of the
Common Council of the City of Carmel, Indiana, for the Consideration and Approval By the Common
Council of the City of Carmel, Indiana, of an Interlocal Cooperation Agreement Between the City of Carmel
and Clay Township for the Provision of Park and Recreational Services to the Residents of the City of
Carmel and Clay Township. Councilor Koven moved to introduce this item into business. Councilor
Snyder seconded. Council President Wilson passed the gavel to Councilor Rundle and presented this matter
to Council. There was no discussion. Council President Wilson referred Resolution No. CC-05-06-02-01 to
the Parks and Recreation Committee for further review and consideration.
ANNOUNCEMENTS:
Council President Wilson and Councilor Snyder again encouraged the community to vote in the upcoming
County and Township election.
ADJOURNMENT:
Council President Wilson moved to adjourn pending the execution of documents.
