MINUTES
MONDAY, MAY 20, 2002 -- 7:00 P.M.
COUNCIL CHAMBERS ! CITY HALL / ONE CMC SQUARE
MEMBERS PRESENT:
Mayor James Brainard; Council President Wayne Wilson; Council Members Kevin Kirby, John Koven, Bob
Battreall, Norm Rundle, Luci Snyder and Ron Carter; Clerk-Treasurer Diana Cordray and Deputy Clerk-
Treasurer Carrie Gallagher.
Mayor Brainard called the meeting to order at 7:00 p.m.
Council President Wilson pronounced the Invocation.
Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
Mayor Brainard presented a Proclamation to Chief Douglas Callahan of the Carmel Fire Department and
James Kinder, Director of the Communications Center, recognizing the value and the accomplishments of
the emergency medical services providers by designating May 19-25, 2002, as "Emergency Medical
Services Week".
Mayor Brainard also presented an Outstanding Service Award to employee, Angela Dolan. Ms. Dolan is a
dispatcher for the City and received a commendation by her shift supervisor for a job well done on a recent
9-1-1 call received from a woman who was concerned because her father was not breathing. Ms. Dolan
remained firm and insistent during the call, followed her Emergency Medical Dispatch Training and stayed
calm until the ambulance crew entered the home and took over emergency care.
APPROVAL OF MINUTES:
Councilor Kirby moved to approve the Minutes of the May 6, 2002 Executive Session. Councilor Snyder
seconded. The Minutes were approved 7-0.
Councilor Kirby moved to approve the Minutes of the May 6, 2002 Regular Meeting. Councilor Snyder
seconded. Councilor Koven moved to amend the First Sentence of Paragraph Two on Page Three to read
". ...... has not met; however, discussion was held regarding the preliminary study of redistricting the Council
districts." Councilor Rundle seconded the motion to amend. The amendment was approved by a vote of 7-
0. The Minutes were approved, as amended, 7-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS T}m COUNCIL:
Vera Henshaw of 9800 Westfield Boulevard, vehemently stated opposition of Annexation Ordinance No. C-
215 to Council;
Kase¥ Kauffman, Council Appointment to the Carmel/Clay Library Board, provided a Quarterly Library
Report to Council;
Richard Mmph¥ of 1505 Orchard Park North Drive, addressed Council in opposition of annexation;
Gene Hull of 10132 Guilford, expressed opposition of any proposed annexations in the College Meadows
and/or College Hills areas;
Judy Singleton of 7820 Holly Creek Lane, questioned the contiguity of family property proposed for
annexation.
COUNCIL~ M~YORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Snyder commented on the Carmel Fire Department fundraiser for the Swails Educational Fund
and thanked Carrabba's for donating food for the benefit.
Council President Wilson provided an updated regarding the new Parks Joinder Agreement.
__ Councilor Snyder responded to the legal status of Aunexation Ordinance No. C-215.
Councilor Rundle commented regarding City services, taxes, etc. for proposed annexation areas.
Council President Wilson and Councilor Carter also responded to annexation concerns.
ACTION ON MAYORAL VETOES:
CLAIMS:
Councilor Snyder moved to approve claims in the amounts of $863.16, $14,170.01, $272,666.65 and
$566,425.89. Councilor Rundle seconded. Claims were approved 7-0.
COMMITTEE REPORTS:
Councilor Rundle stated that the Administration Committee canceled their meeting due to lack of an agenda.
The next regular meeting of the Administration Committee, scheduled for June 14, 2002, may also be
canceled.
Councilor Wilson stated that the Annexation and Land Use Committee met on May 9, 2002, to discuss the
status of current proposed annexations. The next regular meeting of the Committee is scheduled to meet on
June 13, 2002, at 7:00 p.m. in the Caucus Room.
-- Councilor Snyder stated that the Economic Development Committee has no report. The next regular
meeting of the Committee is scheduled for June 17, 2002, at 6:00 p.m. in the Caucus Room.
Council President Wilson reported that the Finance Committee met on May 13 and 20, 2002, at which time
they discussed Ordinance No. D-1567-02. The Committee provided a unanimous recommendation for
approval to Council of that item as well as consideration to donate the Council Chambers' old audio-visual
equipment to Carmel High School. Clerk-Treasurer Cordray advised that the Inventory Committee met as
well concerning the donation of the equipment and agreed to forward the matter to the Board of Public
Works for final approval on June 5, 2002. The next regular meeting of the Committee is scheduled for June
3, 2002, at 4:00 p.m. in the Clerk-Treasurer's Office.
Councilor Carter stated that the Parks and Recreation Committee met to continue Parks Joinder discussion.
The next regular meeting of the Committee is scheduled for June 3, 2002, at 6:00 p.m. in the Caucus Room.
Councilor Battreall reported that the Public Safety Committee met on this date regarding Ordinance No. D-
1569, which they provided a unanimous recommendation for approval to Council. The Committee also
discussed Ordinance No. D-1573-02, which resulted in a 2-1 recommendation to Council. Department
Directors provided updates to the Committee as well. The next regular meeting of the Committee is
scheduled for June 3, 2002, at 10:00 a.m. in the Caucus Room.
Councilor Koven stated that the Rules Committee meeting was canceled and that the next regular meeting of
the Committee, scheduled for May 24, 2002, is also canceled.
Councilor Kirby stated that the Utilities and Transportation Committee has no report. The next regular
meeting of the Committee is scheduled for June 14, 2002, at 8:00 a.m. in the Caucus Room.
OLD BUSINESS:
Councilor Kirby moved to act on Agenda Item No. lOg prior to Item No. lOa. Councilor Koven seconded.
The motion was approved by a vote of 7-0. Item No. lOg, Second Readin~ o_f Ordinance No. D-1573-02,
was moved to the beginning o fOld Business.
Council President Wilson announced the Second Reading of Ordinance No. D-1573-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Creating and Adopting Chapter 8, Article 4, Section 8-
39 of the Carmel City Code (Authorized Speed Hump Locations). Councilor Rundle presented this item to
Council and advised that this matter has been to the Public Safety Committee for considerable discussion
and returns to Council with a 2-1 recommendation. There was Council discussion. Ordinance No. D-1573-
0~2 was approved by a vote of 5-2. Councilors Battreall and Kirby voted in the opposition.
Council President Wilson announced the Second Reading of Annexation Ordinance No. C-211; An
Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of
Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part
of the City of Carmel (I-465 to 96th Street). Councilor Kirby moved to accept an amended Ordinance No.
C-211, as written, to replace the previous document. Councilor Carter seconded. Ordinance No. C-211, As
Amended, was accepted and replaced the previously considered Ordinance, by a vote of 5-0. (Councilors
Battreall and Carter was not present for the vote.) There was brief Council discussion. Ordinance No. C-
211, As Amended, was approved by a vote of 6-0. Councilor Rundle was not present for the final vote.

Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part
of the City of Carmel (116th and Guilford Street). Councilor Kirby moved to accept an amended Ordinance
No. C-213, as written, to replace the previous document. Councilor Carter seconded. Ordinance No. C-
213, As Amended, was accepted and replaced the previously considered Ordinance, by a vote of 6-0.
(Councilor Rundle was not present for the vote.) There was no Council discussion. Ordinance No. C-213,
As Amended, was approved by a vote of 6-0. Councilor Rundle was not present for the final vote.

215, As Amended, was accepted and replaced the previously considered Ordinance, by a vote of 7-0. There
was brief Council discussion. Ordinance No. C-215, As Amended, was approved by a vote of 7-0.
Council President Wilson announced the Second Reading of Ordinance No. D-1567-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Concerning the Construction of Additions and
Improvements to the Waterworks of the City of Carmel, Indiana; Authorizing the Issuance of Revenue
--Bonds for Such Purpose; Addressing Other Matters Connected Therewith, and Repealing Ordinances
Inconsistent Herewith. Councilor Snyder presented this matter to Council and introduced the following
proposed amendments to the document to be considered in place of the original Ordinance: Page Two,
Section 2(a), Sentence Three "... amount not to exceed Six Five Million ?.ye Four Hundred Thousand
Dollars ($65,5400,000)..." and delete from Exhibit A, "Property for Tower;". Councilor Carter moved to
amend as indicated and accept the amended document, as written. Councilor Koven seconded. The motion
to amend was approved by a vote of 7-0. There was Council discussion. Ordinance No. D-1567-02, As
Amended, was approved 7-0.
Council President Wilson announced the Second Reading of Ordinance No. D-1569-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 4, Section 2-96 of the
Cannel City Code (Carmel Fire Department Fees). Councilor Battreall presented this matter to Council.
There was no discussion. Ordinance No. D-1569-02 was approved by a vote of 7-0.
Council President Wilson announced the Second Reading of Ordinance No. D-1570-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Establishing an Ordinance Violation Deferral Program
Fee Fund. Councilor Battreall presented this matter to Council. There was no discussion. Ordinance No.
D-1570-02 was approved by a vote of 7-0.

ANNOUNCEMENTS:
Councilor Battreall announced the grand opening of the new firestation at 106th Street and Shelburne.
