MINUTES
MONDAY, JUNE 17, 2002 - 7:00 P.M.
COUNCIL CHAMBERS ! CITY HALL ! ONE CIVIC SQUARE
MEMBERS PRESENT:
Council President Wayne Wilson; Council Members Kevin Kirby, John Koven, Bob Battreall, Luci Snyder
and Ron Carter; Deputy Clerk-Treasurer Carrie Gallag~er. Mayor James Brainard, Clerk-Treasurer Diana
Cordray and Councilor Norm Rundle were absent.
Council President Wilson called the meeting to order at 7:02 p.m.
Council President Wilson pronounced the Invocation.
Council President Wilson led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Battreall moved to approve the Minutes of the May 20, 2002 Regular Meeting. Councilor Snyder
seconded. The Minutes were approved 6-0.
Councilor Battreall moved to approve the Minutes of the May 20, 2002 Regular Meeting. Councilor Koven
seconded. The Minutes were approved 6-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
There were none.
COUNCIL~ MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
There were none.
ACTION ON MAYORAL VETOES:
There were none.
CLAIMS:
Councilor Snyder moved to approve claims in the amounts of $287,554.67, $902.21 and $746,775.40.
Councilor Koven seconded. Claims were approved 6-0.
COMMITTEE REPORTS:
Council President Wilson stated on behalf of Committee Chairperson, Councilor Rundle that the
Administration Committee has not met. The next regular meeting of the Committee is scheduled for July
12, 2002, at 8:00 a.m. in the Caucus Room.
Councilor Wilson reported that the Annexation and Land Use Committee met on June 4, 2002, in a Special
Meeting to discuss the proposed annexation of Five SeasonsfUSTA. The next regular meeting of the
Committee is scheduled for July 11, 2002, at 7:00 p.m. in the Caucus Room.
Councilor Snyder stated that the Economic Development Committee has not met. The next regular meeting
of the Committee is scheduled for July 15, 2002, at 6:00 p.m. in the Caucus Room.
Council President Wilson stated that the Finance Committee has not met. The next regular meeting of the
Committee is scheduled for July 1, 2002, at 4:00 p.m. in the Clerk-Treasurer's Office.
Councilor Carter stated that the Parks and Recreation Committee has not met. The next regular meeting of
the Committee is scheduled for July 1, 2002, at 6:00 p.m. in the Caucus Room.
Councilor Battreall stated that the Public Safety Committee has not met. The next regular meeting of the
Committee is scheduled for July 1, 2002, at 10:00 a.m. in the Caucus Room.
Councilor Koven stated that the Rules Committee has not met. The next regular meeting of the Committee
is scheduled for June 28, 2002, at 8:00 a.m. in the Council's office.
Councilor Kirby reported that the Utilities and Transportation Committee met on June 14, 2002; however, a
quorum of the Committee was not in attendance. The next regular meeting of the Committee is scheduled
for July 12, 2002, at 8:00 a.m. in the Caucus Room.
OLD BUSINESS:
Council President Wilson announced the Second Reading of Annexation Ordinance No. C-214; An
Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of
Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part
of the City of Carmel (Morgan-Hart Area). Councilor Snyder moved to accept an amended Ordinance No.
C-214, as written, to replace the previous document. Councilor Carter seconded. Ordinance No. C-214, As
Amended, was accepted and replaced the previously considered Ordinance, by a vote of 6-0. There was no
Council discussion. Ordinance No. C-214, As Amended, was approved 6-0.
Council President Wilson announced the Second Reading of Annexation Ordinance No. C-216; An
Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of
Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part
of the City of Carmel (96t~ Street and White River). Councilor Snyder moved to accept an amended
Ordinance No. C-216, as written, to replace the previous document. Councilor Carter seconded. Ordinance
No. C-216, As Amended, was accepted and replaced the previously considered Ordinance, by a vote of 6-0.
There was no Council discussion. Ordinance No. C-216, As Amended, was approved 6-0.

Council President Wilson announced the Second Reading of Ordinance No. D-1576-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Approving and Adopting Intertocal Agreement
(Firearm Range Training Facility - Town of Fishers). Councilor Battreall presented this matter to Council.
There was no discussion. Ordinance No. D-1576-02 was approved 6-0.
PUBLIC ItEARINGS:
Council President Wilson announced the First Reading of Ordinance No. Z-386-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Establishing the U.S. Highway 31 and 146th Street
Planned Unit Development District. Councilor Kirby moved to introduce this item into business. Councilor
Snyder seconded. Paul Reis of Drewry Simmons Pitts & Vornehm, LLP, representing Lauth Property
Group, provided a brief introduction of this matter to Council, while Joe Downs of Lauth Property Group
and Jeff Gunning of RTKL Associates provided a detailed presentation. Council President Wilson opened
the matter for Public Heating at 7:53 p.m. The following person addressed Council:
John Schuler of the Carmel-Clay Chamber of Commerce on behalf of the Business Issues
Committee and the unanimous vote of the Chamber's Board of Directors, addressed Council in
support of the proposed Lauth Clay Terrace Project; (a copy of such response is made an attachment
to the original Minutes of this meeting).
Seeing no one else who wished to speak, Council President Wilson closed the Public Heating at 7:57 p.m.
There was Council discussion. Council President Wilson referred Ordinance No. Z-386-02 to the
Annexation and Land Use Committee for further review and consideration.
Note: Councilor Snyder rescinded herself from the Council meeting during the presentation and discussion
of Ordinance No. Z-386-02.
NEW BUSINESS:
Council President Wilson announced the First Reading of Ordinance No. D-1574-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Authorizing the City of Carmel to Issue Its "Taxable
Economic Development Revenue Bonds, Series 2002 (Duke Realty Project)" and Approving Other Actions
in Respect Thereto. Councilor Snyder moved to introduce this item into business. Councilor Koven
seconded. Councilor Kirby presented this matter to Council and moved to suspend the rules sending this
matter to Committee as it will be presented in a Public Hearing at the Economic Development Commission
on July 1, 2002. Councilor Koven seconded the motion to suspend the rules. The motion to suspend was
approved 6-0. Ordinance No. D-1574-02 will return to Council on July 15, 2002.
Council President Wilson announced the First Reading of Ordinance No. D-1577-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 3, Division II, Section 2-56
of the Carmel City Code (Deferred Compensation Plan Authorized). Councilor Snyder moved to introduce
this item into business. Councilor Carter seconded the motion. Councilor Battreall presented this matter to
Council. Barbara Lan~b, Director of the Department of Human Resources provided details of this
Ordinance to Council members. There was brief discussion. Council President Wilson referred Ordinance
No. D-1577-02 to the Administration Committee for further review and consideration.

Common Council of the City of Carmel, Indiana, Amending Chapter 8, Article 5, Section 8-48(I) and 8-
48(j) of the Carmel City Code (Parking Regulations). Councilor Carter moved to introduce this item into
business. Councilor Snyder seconded. Councilor Battreall presented this matter to Council. There was no
discussion. Council President Wilson referred Ordinance No. D-1578-02 to the Public Safety Committee
for further review and consideration.

Common Council of the City of Carmel, Indiana, Approving and Adopting Interlocal Agreement (Fishers

Snyder moved to suspend the rules sending this matter to Committee and act on this matter tonight.

approved by a vote of 6-0. Ordinance No. D-1579-02 was approved 6-0.

recommended that the rules be suspended sending this matter to Council and act on this matter tonight.
Councilor Kirby moved as such. Councilor Koven seconded the motion. The motion to suspend the rules
and act on this matter tonight was approved by a vote of 6-0. Ordinance No. D-1582-02 was approved 6-0.
Council President Wilson announced Resolution No. CC-06-17-02-01; A Resolution of the Common
Council of the City of Carmel, Indiana, Ratifying Action Taken By the City of Carmel Board of Public
Works and Safety Approving the Contracts for Fire Protection Between the City of Carmel and Clay
Township. Councilor Carter moved to introduce this item into business. Councilor Snyder seconded.
Councilor Koven presented this matter to Council. There was no discussion. Resolution No. CC-07-17-02-
01 was approved by a vote of 6-0.
