MINUTES
MONDAY, AUGUST 5, 2002 - 7:00 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James Brainard; Council President Wayne Wilson; Council Members Kevin Kirby, Bob Battreall,
Norm Rundle, Luci Snyder and Pon Carter; Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer
Carrie Gallagher. Councilor John Koven was absent.
Mayor Brainard called the meeting to order at 7:01 p.m.
Council President Wilson pronounced the Invocation.
Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
Mayor Brainard presented a Proclamation to Chief Michael Fogarty of the Carmel Police Department
recoguizing "National Night Out" on August 6, 2002 from 6:00 p.m. to 9:00 p.m. in the City of Carmel.
This Proclamation encourages Carmel residents to pull together in order to provide safer neighborhoods in
our community.
APPROVAL OF MINUTES:
Councilor Rundle moved to approve the Minutes of the June 28, 2002 Special Meeting. Councilor Battreall
seconded. The Minutes were approved by a vote of 6-0.
Councilor Rundle moved to approve the Minutes of the July 15, 2002 Special Meeting. Councilor BattTeall
seconded. The Minutes were approved 6-0.
Councilor Rundle moved to approve the Minutes of the July 15, 2002 Regular Meeting. Councilor BattrealI
seconded. The Minutes were approved 6-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
Jim Spall of 14329 Adios Pass, addressed Council in opposition of Annexation Ordinance No. C-210.
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Battreall read aloud the Minutes from a 1925 Board of Trustees Meeting demonstrating a sense of
humor for the issues at hand.
ACTION ON MAYORAL VETOES:
There was none.
CLAIMS:
Councilor Snyder moved to approve claims in the amounts of $221.87, $1,222,847.01, $56,707.81,
$2,047.00 and $881,348.25. Councilor Rundle seconded. Claims were approved 6-0.
COMMITTEE REPORTS:
Councilor Rundle stated that the Administration Committee has not met. The next regular meeting of the
Administration Committee is scheduled for August 9, 2002, at 8:00 a.m. in the Caucus Room.
Councilor Wilson stated that the Annexation and Land Use Committee has not met. The next regular
meeting of the Committee, scheduled for August 8, 2002, is canceled and rescheduled for Thursday, August
-- 15, 2002, at 7:00p.m. in the Caucus Room.
Councilor Snyder stated that the Economic Development Committee has not met. Future meetings of the
Committee will be scheduled only as needed.
Council President Wilson reported that the Finance Comanittee met on August 5, to discuss City finances.
A special meeting of the Committee is scheduled for August 12, 2002, at 4:00 p.m. in the Clerk-Treasurer's
Office.
Councilor Carter reported that the Parks and Recreation Committee met on August 5, 2002, at which time
the Committee received a report fi.om Phil Bennett of the Parks Department. The next regular meeting of
the Committee is scheduled for September 3, 2002, at 6:00 p.m. in the Caucus Room.
Councilor Battreall reported that the Public Safety Committee met on August 5, 2002, at which time the
Committee received departmental updates. The next regular meeting of the Committee is scheduled for
September 3, 2002, at 10:00 a.m. in the Caucus Room.
Councilor Rundle stated on behalf of Councilor Koven that the Rules Committee has not met. The next
regular meeting of the Committee is scheduled for August 23, 2002, at 8:00 a.m. in the Council's office.
Councilor Kirby stated that the Utilities and Transportation Committee has not met. The next regular
meeting of the Committee, scheduled for August 9, 2002, is canceled.

OLD BUSINESS:
Council President Wilson announced the Second Reading of Ordinance No. C-210, As Amended; An
Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of
Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part
of the City of Carmel (Approximately 2,200 Acres - Mt. Carmel). Council President Wilson provided a
brief summary of this matter to Council. There was no discussion. Ordinance No. C-210, As Amended was
approved by a vote of 6-0.
PUBLIC HEARINGS:
Council President Wilson announced the First Reading of Ordinance No. D-1583-02; An Ordinance of the
Common Council of the City of Cannel, Indiana, Approving an Additional Appropriation for the
Continuing Education Fund ($37,500.00) and the Carmel Police Depamnent Budget ($261,933.00).
Councilor Battreall moved to introduce this item into business. Councilor Snyder seconded. Councilor
Battreall provided a brief summary of this matter to Council. Chief Michael Fogarty of the Carmel Police
Department presented this matter in greater detail. Council President Wilson opened the matter for Public
Hearing at 7:29 p.m. Seeing no one who wished to speak, Council President Wilson closed the Public
Hearing at 7:30 p.m. There was brief Council discussion. Councilor Kirby moved to suspend the roles
sending this matter to Committee. Councilor Battreall seconded the motion. The rules sending this matter
to Committee were suspended by a vote of 6-0. Ordinance No. D-1583-02 will return to the Council
Agenda on August 19, 2002.
Council President Wilson announced the First Reading of Ordinance No. D-1584-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Approving an Additional Appropriation for the Law
Department ($75,000.00) and the Department of Community Services ($150,000.00). Councilor Snyder
moved to introduce this item into business. Councilor Battreall seconded. Councilor Snyder presented this
matter to Council and advised of an error in the monetary amount noted for the Department of Law.
Michael Hollibaugh, Director of the Department of Community Services, provided a summary of this
request to Council on behalf of his department. Council President Wilson opened the matter for Public
Hearing at 7:35 p.m. Seeing no one who wished to speak, Council President Wilson closed the Public
Hearing at 7:35 p.m. Councilor Sndyer moved to amend the amount of "$75,000.00" in the Ordinance to
reflect "$25,000.00". Councilor Carter seconded the motion to amend. The amendment was approved by a
vote of 6-0. There was no further discussion. Council President Wilson referred Ordinance No. D-1584-02
to the Finance Committee for further review and consideration.
Council President Wilson announced the First Reading of Ordinance No. D-1588-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Approving an Additional Appropriation for the Barrett
Law Revolving Fund ($38,500.00). Councilor Rundle moved to introduce this item into business.
Councilor Battreall seconded. Councilor Rundle presented this matter to Council and read aloud a
Memorandum, dated August 5, 2002, from Douglas C. Haney, City Attorney, a copy of which is made an
attachment to the original Minutes of this meeting. Council President Wilson then opened the matter for
-- Public Hearing at 7:42 p.m. Seeing no one who wished to speak, Council President Wilson closed the
Public Heating at 7:42 p.m. There was Council discussion. Councilor Rundle moved to suspend the rules
sending this matter to Committee. Councilor Snyder seconded the motion to suspend. The motion to
suspend the rules was approved by a vote of 6-0. Ordinance No. D~1588-02 will return to the Council
Agenda on August 19, 2002.

Council President Wilson announced the First Reading of Ordinance No. Z-387-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending the West Clay Village Planned Unit
Development District. Councilor Kirby moved to introduce this item into business. Councilor Snyder
seconded and presented this matter to Council, together with Ordinance No. Z-388-02. Council President
Wilson opened the matter for Public Heating at 7:50 p.m. Seeing no one who wished to speak, Council
President Wilson closed the Public Heating at 7:50 p.m. There was brief Council discussion. George
Sweet, owner/developer of property at issue, responded to Council questions and concerns. Councilor
Kirby moved to suspend the rules sending this matter to Committee and to act on this matter tonight.
Councilor Battreall seconded. The motion suspending the rules to send this matter to Committee and to act
on this matter tonight was approved by a vote of 6-0. Ordinance No. Z-387-02 was approved by a vote of 6-
0.
Council President Wilson announced the First Reading of Ordinance No. Z-388-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending the Zoning Map of Clay Township. Councilor
Kirby moved to introduce this item into business. Councilor Snyder seconded and briefly presented this
matter once again to Council. Council President Wilson opened the matter for Public Hearing at 7:58 p.m.
Seeing no one who wished to speak, Council President Wilson closed the Public Heating at 7:58 p.m. There
was no Council discussion. Councilor Kirby moved to suspend the rules sending this matter to Committee
and to act on this matter tonight. Councilor Battreall seconded. The motion suspending the rules to send
this matter to Committee and to act on this matter tonight was approved by a vote of 6-0. Ordinance No. Z-
-- 388-02 was approved by a vote of 6-0.
NEW BUSINESS:
Council President Wilson announced the First Reading of Ordinance No. D-1581-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Approving and Adopting Interlocal Agreement
(Washington Township/Carmel Fire Departments). Councilor Carter moved to introduce this item into
business. Councilor Snyder seconded. Councilor Battreall presented this matter to Council and moved to
amend the reference to "Hamilton" County within the document to reflect "Marion" County. Councilor
Rundle seconded the motion to amend. The amendment was approved by a vote of 6-0. Councilor Rundle
then moved to suspend the rules sending this matter to Committee and to act on this matter tonight.
Councilor Kirby seconded that motion. The motion to suspend the rules sending this matter to Committee
and to act on this matter tonight was approved by a vote of 6-0. Ordinance No. D-1581-02~ As Amended
was approved by a vote of 6-0.
Council President Wilson armounced the First Reading of Ordinance No. D-1586-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Fixing the Salaries of the Appointed Officers and
Employees of the Clerk-Treasurer, Carmel, Indiana, for the Year 2003. Councilor Snyder moved to
introduce this item into business. Councilor Battreall seconded. Councilor Snyder presented this matter to
Council. There was brief discussion. Council President Wilson referred Ordinance No. D-1586-02 to the
Finance Committee for further review and consideration.

Common Council of the City of Carmel, Indiana, Fixing the Salaries of Appointed Officers and Employees
of the Carmel City Court, Carmel, Indiana, for the Year 2003. Councilor Kirby moved to introduce this
item into business. Councilor Carter seconded. Councilor Snyder presented this matter to Council. There
was no discussion. Council President Wilson referred Ordinance No. D-1587-02 to the Finance Committee
for further review and consideration.
