COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE MEMBERS PRESENT: Mayor James Brainard; Council President Wayne Wilson; Council Members John Koven, Bob Batt~eall, Norm Rundle, Luci Snyder and Pon Carter; Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer Sandy Key. Councilor Kevin Kirby was absent. Mayor Brainard called the meeting to order at 7:00 p.m. Council President Wilson pronounced the Invocation. Mayor Brainard led the Pledge of'Allegiance. Council President Wilson presented the following Add-On Item for tonight's Agenda: Ordinance No. D- 1589-05; An Ordinance of the Common Council of the City of Carmel, Indiana, Prohibiting "Ultimate Fighting" Within the City's Corporate Limits. Councilor Battreall moved to add the item to the Agenda. Councilor Snyder seconded. Ordinance No. D-1589-02 was added to the Agenda by a vote of 6-O. Councilor Snyder moved to suspend the rules to change the order of Agenda and act on the Add-On item prior to the regular Agenda items. Councilor Rundle seconded the motion to suspend the rules. The motion was approved by a vote of 6-O. Councilor Carter then read Ordinance No. D-1589-02 aloud. Council President Wilson called for anyone wishing to address the Council. The following persons spoke with regard to this matter: Mayor James Brainard, presented information he had obtained regarding "Cage Fighting"; ElIiott Noelle Kendall of 11818 Gray Road in Carmel, addressed Council in favor of the Ordinance prohibiting "Ultimate Fighting"; John Manlev and David Pumphrev of l5I Delaware, Suite 1835 in Indianapolis, Attorneys for the Mixed Martial Arts Foundation, spoke against the proposed Ordinance; Gary Myers of 749 Charnwood Parkway in Beech Grove, addressed Council in opposition of the proposed Ordinance; Jason Godse¥ of 459 East S.R. 42 in Mooresville, also addressed Council in opposition of the proposed Ordinance; Chas Bowling of 1222 McGallagher Road in Muncie, spoke against the proposed Ordinance; Thomas Kendall of 11818 Gray Road in Carmel, addressed Council in favor of the proposed Ordinance; Mike Camp of 40 Arrowae Drive in Carmel, addressed Council in opposition of the proposed Ordinance; Council President Wilson then asked for Council comment. Councilor Carter advised that Council had inadvertently neglected to move this item into business and moved to do so, Councilor Battreall seconded the motion to introduce. There was extensive Council comment and discussion. Councilor Battreall then moved to suspend the rules to act on this matter tonight. Councilor Snyder seconded. The motion to suspend the rules was approved by a unanimous vote of 6-O. Accordingly, Councilor Snyder moved to also suspend the rules sending this matter to Committee. Councilor Rundle seconded. The motion to suspend the rules was again approved by a unanimous vote of 6-O. Ordinance No, D-1589-02 was approved 6-0. Council President Wilson called for a recess at 7:35p, m. and reconvened at 7.'40p.m. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: -- There was none. APPROVAL OF MINUTES: There were none. PUBLIC HEARINGS: Council President Wilson announced the First Reading of Annexation Ordinance No. C-220~ As Amended; An Ordinance of the Common Council of the City of Cannel, Indiana, Annexing Certain Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Carmel (King). Councilor Battreall moved to introduce this item into business. Councilor Rundle seconded. Council President Wilson stated that all proposed Ordinances listed under Public Hearings this evening were previously introduced on June 3, 2002, so a separate motion for the remaining items will not be necessary. Council President then opened the matter for Public Hearing at 7:45 p.m. The following person addressed Council: Garry King of 14411 Care¥ Road, spoke in opposition of the proposed annexation; -- Seeing on one else who wished to speak, Council President Wilson closed the Public Hearing at 7:57 p.m. There was brief Council discussion. Council President Wilson also advised that this Ordinance has returned to Council, as amended, due to scrivener's error in the Legal Description, which is the case with all of the proposed annexation Ordinances on the Agenda tonight. Ordinance No. C-220, As Amended, will return to Council upon the expiration of 30 days. Council President Wilson announced the First Reading of Annexation Ordinance No. C-224, As Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Carmel (Russell). Council President Wilson opened the matter for Public Hearing at 8:00 p.m. Seeing no one who wished to speak, the Public Hearing was closed at 8:00 p.m. Ordinance No. C-224, As Amended, will return to Council upon the expiration of 30 days. Council President Wilson announced the First Reading of Annexation Ordinance No. C-225, As Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Cannel (Wareham/Koch). Council President Wilson opened the matter for Public Hearing at 8:02 p.m. Seeing no one who wished to speak, the Public Hearing was closed at 8:03 p.m. Ordinance No. C-225, As Amended, will return to Council upon the expiration of 30 days. 3 Council President Wilson announced the First Reading of Aunexation Ordinance No. C-226, As Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Carmel (Crawford). Council President Wilson opened the matter for Public Hearing at 8:04 p.m. Council President Wilson read aloud a letter received from Mrs. Crawford of 14105 North Gray Road, which stated her opposition to the proposed annexation. Seeing no one else who wished to address Council, the Public Hearing was closed at 8:07 p.m. Ordinance No. C-226, As Amended, will return to Council upon the expiration of 30 days. Council President Wilson announced the First Reading of Annexation Ordinance No. C-227, As Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Carmel (Langston). Council President Wilson opened the matter for Public Hearing at 8:07 p.m. Seeing no one who wished to speak, the Public Heating was closed at 8:08 p.m. Ordinance No. C-227, As Amended, will return to Council upon the expiration of 30 days. Council President Wilson opened the matter for Public Hearing at 8:08 p.m. Seeing no one who wished to speak, Council President Wilson advised of a conversation he had with George Jackson on June 10, 2002, who stated he was in favor of the proposed annexation. Council President Wilson then closed the Public Hearing at 8:08 p.m. Ordinance No. C-228~ As Amended, will return to Council upon the expiration of 30 days. Council President Wilson announced the First Reading of Annexation Ordinance No. C-229, As Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certa/n Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Carmel (Mosbough). Council President Wilson opened the matter for Public Hearing at 8:09 p.m. Seeing no one who wished to speak, Council President Wilson advised of a conversation he had with Mr. Mosbough on June 10, 2002, who stated he was in favor of the proposed annexation. Council President Wilson then closed the Public Hearing at 8:09 p.m. Ordinance No. C-229, As Amended, will return to Council upon the expiration of 30 days. Council President Wilson announced the First Reading of Annexation Ordinance No. C-230, As Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Carmel (McCright/Thornberry/Smith). Council President Wilson opened the matter for Public Hearing at 8:10 p.m. The following persons addressed Council: Doug McCright of 5313 East 126th Street, spoke in favor of the proposed annexation; Karen Thornberry of 5311 East 126th Street, spoke in favor of the proposed annexation; Seeing no one else who wished to speak, the Public Heating was closed at 8:15 p.m. Ordinance No. C-230, As Amended, will return to Council upon the expiration of 30 days. 4 Council President Wilson announced the First Reading of Annexation Ordinance No. C-231, As Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Carmel (Schiering/Taggart).
