MINUTES
MONDAY, AUGUST 19, 2002 - 7:00 P.M.
COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James Brainard; Council President Wayne Wilson; Council Members Kevin Kirby, John Koven, Bob
Battreall, Norm Rundle, Lnci Snyder and Pon Carter; Clerk-Treasurer Diana Cordray and Deputy Clerk-
Treasurer Carrie Gallagher.
Mayor Brainard called the meeting to order at 7:05 p.m.
Council President Wilson pronounced the Invocation.
Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
Mayor Brainard acknowledged both the Carmel Symphony Orchestra and Martin Marietta Aggregates by
presenting a Proclamation to John Shuler declaring the week of August 18, 2002, "Concert in the Quarry"
Week.
APPROVAL OF MINUTES:
Councilor Rundle moved to approve the Minutes of the July 26, 2002 Special Meeting. Councilor Snyder
seconded. The Minutes were approved 6-0. Council President Wilson abstained since he was not present at
that meeting.
Councilor Rundle moved to approve the Minutes o£the August 5, 2002 Regular Meeting. Councilor Carter
seconded. The Minutes were approved 6-0. Councilor Koven abstained since he was not present at that
meeting.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
Major John Etter, Carmel Police Department, addressed Council regarding the Central Indiana Emergency
Training Center (CIETC) and introduced Lt. Dave Dunbar, Fishers Police Department, and Capt. Clinton
Crafton, Fishers Fire Department, who provided a presentation of the proposed training facility for Council
consideration.
COUNCIL~ MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Snyder stated that Rosemary Hensel, Clay Township Board Member, passed away.
ACTION ON MAYORAL VETOES:
CLAIMS:
Councilor Snyder moved to approve claims in the amounts of $313,224.74 and $739,667.75.
Rundle seconded. Claims were approved 7-0.
Councilor
COMMITTEE REPORTS:
Councilor Rundie reported that the Administration Committee met on August 9, 2002, at which time the
Committee discussed Ordinance No. D-1577-02, regarding deferred compensation. The Committee
provided a 1-1 vote to Council regarding this item. The next regular meeting of the Administration
Committee is scheduled for September 13, 2002, at 8:00 a.m. in the Caucus Room.
Councilor Wilson reported that the Annexation and Land Use Committee met on August 15, 2002. There
was extensive discussion concerning Ordinance No. Z-386-02 (Clay Terrace), for which the Committee
provided a 1-1 vote to Council with Councilor Snyder recusing herself from the matter. Upon further
discussion, the Committee provided a 0-3, unfavorable recommendation to Council regarding Ordinance
No. Z-381-02 (Hunter's Creek). There also was brief discussion of Ordinance Nos. Z-389-02 and 390-02,
for which the Committee voted 3-0, in favor of their approval by the full Council. The next regular meeting
of the Committee is scheduled for September 12, 2002, at 7:00 p.m. in the Caucus Room.
Councilor Snyder stated that the Economic Development Committee has not met; however, Committee
members continue to meet with Mayor Brainard and others regarding the possibility for ITT Tech to move
their headquarters to the City of Carmel.
Council President Wilson reported that the Finance Committee met on August 12, 2002, to discuss proposed
salary Ordinances for 2003. The Committee provided a 3-0, favorable recommendation to Council for the
passage of these documents. The next meeting of the Committee is scheduled for September 3, 2002, at
4:00 p.m. in the Clerk-Treasurer's Office.
Councilor Carter stated that the Parks and Recreation Committee has not met. The next regular meeting of
the Committee, scheduled for September 2, 2002, is canceled in observance of the holiday.
Councilor Battreall stated that the Public Safety Committee has not met since the last meeting of Council.
The next meeting of the Committee is scheduled for September 3, 2002, at 10:00 a.m. in the Caucus Room.
Councilor Koven stated that the Rules Committee has not met. The next regular meeting of the Committee
is scheduled for August 23, 2002, at 8:00 a.m. in the Council's office.
Councilor Kirby stated that the Utilities and Transportation Committee has not met. The next regular
meeting of the Committee is scheduled for September 13, 2002, at 8:00 a.m. in the Caucus Room.

OLD BUSINESS:
Council President Wilson announced the Second Reading of Ordinance No. D-1577-02; An Ordinance of
the Common Council of the City of Cannel, Indiana, Amending Chapter 2, Article 3, Division II, Section 2-
56 of the Carmel City Code (Deferred Compensation Plan Authorized). Councilor Rundle presented this
matter to Council. There was extensive Council discussion. Councilor Rundle expressed the possibility of
revising the Ordinance to keep Council included in the decisions of compensation fiscal matters. Discussion
continued. Ordinance No. D-1577-02 was defeated by a vote of 2-5. Council President Wilson and
Councilors Kirby, Koven, Rundlc and Snyder voted in the opposition.
Council President Wilson announced the Second Reading of Ordinance No. D-1583-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Approving an Additional Appropriation for the
Continuing Education Fund ($37,500.00) and the Carmel Police Department Budget ($261,933.00).
Councilor Koven presented this matter to Council and read aloud proposed amendments to the title and first
paragraph of the document. There was brief Council discussion. Councilor Koven moved to amend the title
by replacing the word "For" with "From"; deleting the word "the" from line one and replacing "Continuing
Education Fund" with "Police Department Renovations" in line two of the first paragraph. Councilor
Snyder seconded the motion. The amendments were approved by a vote of 7-0. Brief discussion continued.
Ordinance No. D-1583-02 was approved, as amended, by a vote of 7-0.
Council President Wilson announced the Second Readin~ of Ordinance No. D-1584-02~ As Amended: An
-'-Ordinance of the Common Council of the City of Carmel, Indiana, Approving an Additional Appropriation
for the Law Department ($25,000.00) and the Department of Community Services ($150,000.00).
Councilor Snyder presented this matter to Council. There was brief Council discussion..Ordinance No. D-
1584-02, As Amended, was approved by a vote of 7-0.
Council President Wilson announced the Second Reading of Ordinance No. D-1586-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Fixing the Salaries of the Appointed Officers and
Employees of the Clerk-Treasurer, Carmel, Indiana, for the Year 2003. Councilor Snyder presented this
matter to Council and moved to amend the date in paragraph one, line four, from "December 22," to
"December 19," due to scrivener's error. There was brief Council discussion. Ordinance No. D-1586-02
was approved, as amended, by a vote of 7-0.
Council President Wilson announced the Second Reading of Ordinance No. D-1587-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Fixing the Salaries of Appointed Officers and
Employees of the Carmel City Court, Carmel, Indiana, for the Year 2003. Councilor Snyder presented this
matter to Council and moved to amend the date in paragraph one, line three, from "December 22," to

approved, as amended, by a vote of 7-0.

the Common Council of the City of Carmel, Indiana, Approving an Additional Appropriation for the Barrett

discussion. Ordinance No. D-1588-02 was approved by a vote of 6-1. Councilor Kirby voted in the
-- opposition.
Council President Wilson announced the Second Reading of Ordinance No. Z-381-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Establishing the Hunters Creek Office Park Planned Unit
Development District. Councilor Snyder presented a summary of this matter to Council and conveyed the
recommendation of the Committee to be unfavorable with a unanimous vote of 3-0 against the passage of
this Ordinance. There was extensive Council discussion. Ordinance No. Z-381-02 was defeated by a vote
of 0-7. All Councilors voted in the opposition.
Council President Wilson announced the Second Reading of Ordinance No. Z-386-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Establishing the U.S. Highway 31 and 146th Street
Planned Unit Development District (Clay Terrace). Council President Wilson advised of the petitioner's
request to table this matter until the next meeting of the Council on September 3, 2002. Councilor Rundle
moves as such. Councilor Carter seconded. Ordinance No. Z-386-02 was tabled by a vote of 6-0.
Councilor Snyder did not vote, recusing herself from this matter.
Council President Wilson announced the Second Reading of Ordinance No. Z-389-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, to Amend the Cannel Clay zoning Ordinance By Creating
a New Zoning District To Be Known as the OM-MM (Old Meridian - Mixed Medical) District. Jon
Dobosiewicz of the Department of Community Services advised Council that the petitioner has requested
that this item, together with its companion Ordinance, No. Z-390-02, be tabled to allow more time for
additional work to be done. Councilor Kirby moved to table Ordinance Nos. Z-389-02 and 390-02, as
requested. Councilor Snyder seconded. Ordinance No. Z-389-02 was tabled by a vote of 7-0.
Council President Wilson announced the Second Reading of Ordinance No. Z-390-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, to Amend the Official Zoning Map for the City of Carmel
and Clay Township By Rezoning an Area from Old Meridian District (OM) - Mixed Use (MU), Office (O),
and Single Family (SF) to Old Meridian District (OM) - Mixed Medical (MM). As a companion Ordinance
to the above-referenced matter, Jon Dobosiewicz of the Department of Community Services advised of the
petitioner's request to table this matter. Therefore, Ordinance No. Z-390-02 was tabled, together with
Ordinance No. Z-389-02, by a vote of 7-0.

seconded. Council President Wilson presented this matter to Council and then opened the matter for Public
Hearing at 8:45 p.m. Seeing no one who wished to speak, the Public Hearing was closed at 8:45 p.m. There
was brief Council discussion. Council President Wilson referred Ordinance No. D-1591-02 to the Finance
Committee for further review and consideration.

Common Council of the City of Carmel, Indiana, Rezoning District Classifications (Dixie Highway
Addition). Councilor Rundle moved to introduce this item into business. Councilor Battreall seconded.
Council President Wilson presented this matter to Council and then opened the matter for Public Hearing at
8:48 p.m. Seeing no one who wished to speak, the Public Heating was closed at 8:48 p.m. There was no
discussion. Council President Wilson referred Ordinance No. Z-391-02 to the Annexation and Land Use
Committee for further review and consideration.

the City of Carmel, Indiana for the Year 2003. Councilor Snyder moved to introduce this item into
business. Councilor Battreall seconded. There was brief discussion. Council President Wilson referred
Ordinance No. D-1585-02 to the Finance Committee for further review and consideration.
Council President Wilson announced Resolution No. CC-08-19-02-01; A Resolution of the Common
Council of the City of Carmel, Indiana, Adopting a Fiscal Plan for the Annexation of Property Contiguous
to the City of Carmel, Indiana (C-217 - Huse). Councilor Battreall moved to introduce this item into
business. Councilor Snyder seconded. Councilor Koven provided a brief summary of this matter to
Council. There was brief Council discussion. Resolution No. CC-08-19-02-01 was approved by a vote of
7-0.
Council President l~/ilson asked for a motion to move Item No. 12j, Resolution No. CC-08-19-02-09 to this
point on the Agenda. Councilor Rundle moved as such. Councilor Carter seconded. Councilor Battreall
then moved to introduce the following item into business: Resolution No. CC-08-19-02-09; A Resolution of
the Common Council of the City of Carmel, Indiana, Approving a Transfer of Funds by the Carmel Fire
Department ($10,300.00). Councilor Rundle seconded the motion to introduce. Councilor Battreall
presented this matter to Council. There was no discussion. Resolution No. CC-08-19-02-09 was approved
by a vote of T-O.

to the City of Carmel, Indiana (C-218 - North Keystone). Councilor Battreall moved to introduce this item
into business. Councilor Snyder seconded. Councilor Koven provided a brief summary of this matter to
Council. There was no discussion. Resolution No. CC-08-19-02-02 was approved by a vote ofT-0.

to the City of Carmel, Indiana (C-222 - 146th Street and East Central). Councilor Battreall moved to
introduce this item into business. Councilor Snyder seconded. Councilor Koven provided a brief summary
of this matter to Council. There was no discussion. Resolution No. CC-08-19-02-05 was approved by a
vote of 7-0.

to the City of Carmel, Indiana (C-243 - Northeast Tier). Councilor Kirby moved to introduce this item into
business. Councilor Snyder seconded. Councilor Koven provided a brief summary of this matter to
Council. There was brief Council discussion. Councilor Koven advised that the total acreage referenced in
this document should be 961.45 acres, not 61.30 acres and also stated that Section 3 of this document
should reference Annexation Ordinance No. C-243, not C-242 and moved to amend as such. Councilor
Kirby seconded. The motion to amend was approved by a vote of 7-0. Resolution No. CC-08-19-02-08
~vas approved, as amended, by a vote of 7-0.
Resolution No. CC-08-19-02-09; A Resolution of the Common Council of the City of Carmel, Indiana,
Approving a Transfer of Funds by the Carmel Fire Department ($10,300.00), was moved into business and
acted upon prior to Item No. 12c. Resolution No. CC-08-19-02-09 was approved by a vote of 7-0.
